That the Board (Published in The Salina Journal1980) hereby reaffirms all of AN ORDINANCE ORDERING THE CONDEMNATION AND APPROPRIATION OF CERTAIN declarations of the necessity for LAND IN SALINE COUNTY, KANSAS, FOR CONSTRUCTION OF IMPROVEMENTS TO EAST CRAWFORD lands for public use STREET, ALL AS AUTHORIZED BY K.S.A. 13-1023, AND AMENDMENTS THERETO, AND PURSUANT of improvements to East Crawford Street, TO THE EMINENT DOMAIN PROCEDURE ACT, K.S.A. CHAPTER 26, AND AMENDMENTS THERETO, and all other public purposes now in AS THE SAME RELATES TO CONDEMNATION BY CITIES AND FURTHER PURSUANT TO RESOLUTION NUMBER 80-3483 OF THE CITY OF SALINA, KANSAS. The interest be taken WHEREAS, the Board of Commissioners of the City of Salina, Kansas, did to be condemned shall be the fee on the 14th day of April, 1980, adopt Resolution Number 80-3483 thereby finding Section 2. and determining it necessary and in the public interest to appropriate for required to be taken for such public use is public use and purposes certain private property located in Saline County, described as follows: Kansas, needed for the construction of improvements on East Crawford Street, and all other public purposes now or hereafter required by said City and not in conflict therewith; and, WHEREAS, the Board of Commissioners of the City of Salina, Kansas, has heretofore authorized a survey to be made of such lands by the City Engineer, which said survey has been filed with the City Clerk, SO NOW, THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: A tract of land in the Northwest Quarter (NW/4) of the Northeast Quarter (NE/4) of Section Nineteen (19), Township Fourteen (14) South, Range Two (2) West of the Sixth Principal Meridian in Saline County, Kansas, and more particularly described as follows: I. Beginning at a point Two Thousand One Hundred Seventy-five and Thirty-one Hundredths feet (2,175.31') West and Forty-five and Nineteen Hundredths feet (45.199 South of the northeast corner of Section Nineteen (19), Township Fourteen (14) South, Range Two (2) West; 2. Thence Southwesterly to a point which is Two Thousand Two Hundred Twenty-five and Thirty-one Hundredths feet (2,225.31') West and Sixty feet (60`) South of the said northeast corner; 3. Thence Westerly and parallel to the north line of said Section a distance of Three Hundred Fifty feet (3509; 4. Thence Southwesterly to a point Two Thousand Six Hundred Twenty- five and Forty-eight Hundredths feet (2,625.48') West and Seventy feet (709 South of the said northeast corner; 5. Thence North Seventeen and Fifty-six Hundredths feet (17.56') to the existing South right-of-way line of Crawford Street; 6. Thence Easterly along the said existing right-of-way line to a point Two Thousand Five Hundred Forty and Fifty-three Hundredths feet (2,540.53') West and Fifty-two and Two Hundredths feet (52.02') South of said northeast corner; Section 1. That the Board of Commissioners hereby reaffirms all of its prior orders and declarations of the necessity for appropriation of certain lands for public use for construction of improvements to East Crawford Street, and all other public purposes now in conflict therewith. The interest be taken in the subject tract to be condemned shall be the fee title thereto. Section 2. That the land required to be taken for such public use is described as follows: A tract of land in the Northwest Quarter (NW/4) of the Northeast Quarter (NE/4) of Section Nineteen (19), Township Fourteen (14) South, Range Two (2) West of the Sixth Principal Meridian in Saline County, Kansas, and more particularly described as follows: I. Beginning at a point Two Thousand One Hundred Seventy-five and Thirty-one Hundredths feet (2,175.31') West and Forty-five and Nineteen Hundredths feet (45.199 South of the northeast corner of Section Nineteen (19), Township Fourteen (14) South, Range Two (2) West; 2. Thence Easterly along the said existing right-of-way line to a point Two Thousand Five Hundred Forty and Fifty-three Hundredths feet (2,540.53') West and Fifty-two and Two Hundredths feet (52.02') South of said northeast corner; 7. Thence North along the said existing right-of-way line a distance of Five feet (5'); 8. Thence Easterly along the said existing right-of-way line to the point of beginning. (Said tract contains 0.13 acres, more or less) Section 3. That the real estate described in Section 2 above is hereby ordered condemned for the purpose as set forth in Section 1 above. Section 4. That the City Attorney and any attorney employed by said City for such purposes, if hereby directed and authorized to file a verified petition in the District Court of Saline County, Kansas, for the condemnation and appropriation of the land described in Section 2 of this ordinance pursuant to K.S.A. 13-1023 and the Eminent Domain Proceedings Act, K.S.A. Chapter 26, and amendments thereto, and to do all that is necessary for the condemnation and acquisition of said lands for said public purposes and improvements. Section 5. This ordinance shall constitute the final order setting forth the condemnation of the land described herein and the purpose for which the same is to be used. Section 6.
