AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE
SAME BEING CHAPTER 36 OF THE SALINA CODE AND THE ZONING DISTRICT MAP THEREIN AND
THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE
CITY AND PRESCRIBING THE PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning
District Map, the rezoning of certain land therein, hereinafter described has
been timely complied with, and SO NOW, THEREFORE,
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. AMENDMENT. DISTRICT "P.D.D". PLANNED DEVELOPMENT DISTRICT
That the Zoning District Map of the City of Salina, Kansas, hereto duly adopted
and published as a part of Ordinance Number 8526, the same being Chapter 36 of
the Salina Code, be and it is hereby amended so that the following described
property be rezoned as follows, to -wit:
Lot 1, Block 1, Frisbie Acres Addition to the City of Salina, Saline
County, Kansas
shall become a part of District "P.D.D" PLANNED DEVELOPMENT DISTRICT. That the
use of said described property shall be subject to all the conditions, restricti
and limitations as made and provided for in Ordinance Number 8526, the same
being Chapter 36 of the Salina Code, with reference to the PLANNED DEVELOPMENT
DISTRICT, and in addition thereto shall be subject to the following conditions,
to -wit:
I. Approval is subject to the approved Preliminary Development Plan
which is on file in the City Clerk's Office and is incorporated
hereby by reference.
2. Only single-family detached dwellings be permitted within the
Planned Development.
3• All exterior boundaries of the subdivision shall maintain the
setbacks of the "RS" zone.
4. No building permits shall be issued for Tracts 1 and 2 until
additional water lines are laid in the area or other measures
taken, which in the opinion of the City Engineer, insures a
sufficient supply of water for these tracts.
5. The following corrections shall be lettered on the Final
Development plan drawing:
(i) Indication that the private drive is in private ownership.
(ii) Notes 2, 3, and 4 shall be lettered on the plan drawing.
(iii) Drive reduced to 30 feet and Tract 1 enlarged by 20 feet.
Section 2. This ordinance shall be in full force and effect from and
after its adoption and publication once in the official city newspaper.
