82-8949 Zone Wheatridge AddORDINANCE NUMBER 82-8949 (Published in The Salina Journal �� C `�� 1-1 , 1982) AN ORDINANCE PROVIDING FOR THE REZONING OF WHEATRIDGE ADDITION FROM P.U.U. TO R-1; AMENDING ORDINANCE NUMBER 8711. WHEREAS, on the 23rd day of April, 1979, the City Commission adopted Ordinance Number 8711 whereby the Zoning District Map of the City of Salina, Kansas, was amended to provide for the rezoning of Wheatridge Addition to the City of Salina, Saline County, Kansas, from District "R-1", Single -Family Residential District, to District "P.D.D.", Planned Development District, subject however to certain conditions set forth in said ordinance; and WHEREAS, the conditions in said ordinance have not been complied with, SO NOW, THEREFORE BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That the Zoning District Map of the City of Salina, Kansas, hereto duly adopted and published as a part of Ordinance Number, 8526, the same being Chapter 36 of the Salina Code, as amended by Ordinance Number 8711, be and the same is hereby further amended so that the following described property, to - wit: WHEATRIDGE ADDITION A tract of land situated in the S 1/2 of Section 35, Township 14 South, Range 3 West of the Sixth Principal Meridian, Saline Country, Kansas, more particularly described as follows: Commencing at a chiseled square marking in the southwest corner of said Section 35; thence easterly on an assumed bearing of N 90°00'00" E along the south section line of said Section 35 a distance of 132.20 feet to a point; thence N 0029'04" W a distance of 51.50 feet to the point of intersection of the north right-of-way line of Schilling Road and the east right-of-way line of the Missouri Pacific Railroad and said point being the POINT OF BEGINNING; thence continuing N 0029'04" W along the east right-of- way line of the Missouri Pacific Railroad a distance of 1,577.50 feet to a point 1,629.00 feet north of the south section line of said Section 35; thence N 90°00'00" E along a line 1,629.00 feet north of and parallel to the south section line of said Section 35 a distance of 1,618.44 feet to a point 1,750.00 feet east of the west section line of said Section 35; thence S 0°27'43" E along a line 1,750.00 feet east of and parallel to the west section line of said Section 35 a distance of 250.00 feet to a point 1,379.00 feet north of the south section line of said Section 35; thence N 90°00'00" E along a line 1,379.00 feet north of and parallel to the south section line of said Section 35 a distance of 443.78 feet; thence S 21°24'45" W a distance of 256.67 feet; thence S 0°00'00" E a distance of 73.00 feet; thence S 90°00'00" W a distance of 54.00 feet; thence S 0°45'14" E a distance of 152.01 feet; thence S 8°18'37" E a distance of 179.89 feet; thence S 11°23'21" W a distance of 283.58 feet; thence S 28°47'38" E a distance of 149.48 feet; thence S 78011'35" E a distance of 361.65 feet; thence S 75°06'58" E a distance of 311.45 feet; thence S 59°45'11" E a distance of 243.19 feet to a point on the north right-of- way line of Schilling Road and said point being 51.50 feet north of the south section line of said Section 35; thence S 90°00'00" W along a line 51.50 feet north of and parallel to the south section line of said Section 35 a distance of 300.99 feet; thence N 0°13'57" W a distance of 10.50 feet to a point 62.00 feet north of the south section line of said Section 35; thence S 90000'00" W along a line 62.00 feet north of and parallel to the south section line of said Section 35 a distance of 759.89 feet; thence S 0°00'00" E a distance of 10.50 feet to a point 51.50 feet north of the south section line of said Section 35; thence S 90°00'00" W along a line 51.50 feet north of and parallel to the south section line of said Section 35 a distance of 1,751.34 feet to the POINT OF BEGINNING. The above described tract containing 71.650 acres, more or less, and being subject to all easements, reservations, and restrictions of record. shall be rezoned so as to become a part of District R-1, SINGLE --FAMILY RESIDENTIAy DISTRICT. Section 2. That Section 1 of Ordinance Number 8711 be and the same is hereby repealed insofar as it pertains to Wheatridge Addition, but this amendment) shall not effect the rezoning of Fox Run Addition provided for in Ordinance Number 8711.
