09-12-2022 MinutesL L L CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS September 12, 2022 4:00 p.m. Mayor Davis asked the Clerk for verification that notice had been sent for today 's City Commission meeting. The Clerk replied yes . The Regular Meeting of the Board of Commissioners was called to order at 4 :00 p .m. in Room 107 , City-County Building. A roll call was taken followed by the Pledge of Allegiance and a moment of silence . Those present and comprising a quorum: Mayor Davis (presiding), Michael L. Hoppock, Bill Longbine and Karl Ryan (via Zoom). Also present: Mike Schrage , City Manager, Jacob Wood , Deputy City Manager, Shawn Henessee , Assistant City Manager, Greg Bengtson, City Attorney; and Jo Vonna A. Rutherford , City Clerk. Mayor Davis acknowledged and remembered the heroes and victims of 9/11 . AWARDS AND PROCLAMATIONS (3.1) Recognition of the month of September, 2022 , as National Childhood Cancer Awareness Month in the city of Salina. Ellason Ballou, sister of cancer hero Hayden Ballou, read the proclamation. Heidi Feyerherm-Smith, of the Love Chloe Foundation, provided information on related events. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME ( 4.1) 2023 Budget Process (4.la) Conduct a public hearing to consider exceeding Revenue Neutral Rate and the proposed 2023 budget for the City of Salina. ( 4.1 b) Approve Resolution No. 22-8069 to levy property tax rate exceeding the Revenue Neutral Rate. (4.lc) Approve Ordinance No . 22-11129 , on first reading, adopting and appropriating the 2023 annual budget. Debbie Pack , Director of Finance and Administration , explained the request, fiscal impact and action options. Mayor Davis opened the public hearing. Mark Labes , Salina, Kansas, shared his thoughts on the budget, reducing costs and taxation. Chad Farber, Salina, Kansas , suggested the Governing Body reject exceeding the Revenue Neutral Rate as now is not the time to raise taxes. Ben Windholz, Salina, Kansas , recommended cutting expenses as the future is unknown. Tonya Greer, Salina, Kansas , shared her thoughts on property taxes. Page 1 ... A discussion ensued related to the revenue neutral rate, mill levy , property value , expenses , spending, taxation , employment and sales tax. Moved by Commissioner Hoppock , seconded by Commissioner Ryan, to approve Resolution No. 22-8069 to levy property tax rate exceeding the Revenue Neutral Rate. Aye : (3). Nay (1 - Longbine). Motion carried. Norman Mannel, Salina, Kansas , stated all citizens were affected by this issue and it should require a vote. Chad Farber, Salina, Kansas , declared taxes are too high and government is too big in Salina. Mark Labes , Salina, Kansas , indicated there are still ways to cut the budget and the city does not hold itself accountable . Mayor Davis stated the budget is actually a very long process, the city 's budget is rather conservative and the Governing Body was trying to accommodate as many citizens as possible . Moved by Commissioner Hoppock , seconded by Commissioner Longbine , to approve Ordinance No. 22-11129 , on first reading, adopting and appropriating the 2023 annual budget. Aye: (4). Nay (0). Motion carried. CONSENT AGENDA (5.1) Approve the minutes of August 22, 2022 . (5.2) Authorize the City Manager to sign a request from the Kansas Department of Transportation to exchange 2022 federal funds per the KDOT master agreement governing the annual use. 22-0240 Moved by Commissioner Longbine , seconded by Commissioner Hoppock , to approve the consent agenda as presented. Motion carried . - L ADMINISTRATION ( 6.1) Authorize the submission of a Fall 2022 Cost Share Program application by the City of Salina to the Kansas Department of Transportation (KDOT) for West Magnolia Road from Centennial Road to Interstate 135, City Project No. 22026. Dan Stack, City Engineer , explained the request, fiscal impact and action options . A brief discussion followed which included funding , proposed roundabout , purpose of a roundabout and future planning meetings . Norman Mannel, Salina, Kansas , shared his thoughts on the roundabout and proposed size to accommodate tractor trailers. Mayor Davis stated the roundabout would not be directly connected to the interstate and would be easier to maneuver. Ken Reitz , Salina, Kansas , shared his experiences with roundabouts . Tonya Greer , Salina, Kansas , commented on roundabouts in Loveland, Colorado. Moved by Commissioner Longbine , seconded by Commissioner Hoppock , to authorize the submission of a KDOT Cost Share Program application for West Magnolia Road from Centennial Road to Interstate 135 , City Project No. 22026. Aye: (4). Nay (0). Motion carried. DEVELOPMENT BUSINESS (7.1) Approve Resolution No. 22-8067 setting the date for a public hearing to consider whether a dangerous structure at 901 N. 7th St. shall be condemned and ordered demolished or repaired. Sean Pilcher, Building Official , explained the request, fiscal impact and action options. A brief discussion arose regarding the dangerous structure process. 22-0242 Moved by Commissioner Hoppock , seconded by Commissioner Longbine , to approve Resolution No. 22-8067 setting October 24, 2022 , as the public hearing date for the dangerous structure located at 901 N. 7th St. Aye: (4). Nay (0). Motion carried. (7.2) Approve Resolution No. 22-8066 setting the date for a public hearing to consider whether a dangerous structure at 316 W . South St. shall be condemned and ordered demolished or repaired. Sean Pilcher, Building Official, explained the request, fiscal impact and action options . 22-0243 Moved by Commissioner Longbine , seconded by Commissioner Hoppock, to approve Resolution No. 22-8066 setting October 24, 2022 , as the public hearing date for the dangerous structure located at 901 N. 7th St. Aye : (4). Nay (0). Motion carried . (7.3) Approve Resolution No. 22-8073 requesting an extension of the compliance deadline date as ordered by Resolution No . 22-8058 related to repairs or demolition of a dangerous structure located at 619 S. Santa Fe. Sean Pilcher, Building Official, explained the request , fiscal impact and action options . Dana Lively , Salina, Kansas , explained the ownership of the property and the need for more time to complete the demolition . 22-0244 Moved by Commissioner Longbine , seconded by Commissioner Ryan , to approve Resolution No. 22-8073 setting a compliance deadline of October 31 , 2022 , for substantial completion of demolition for repairs and authorizing staff to proceed with the demolition if the owner fails to comply. Aye : (4). Nay (0). Motion carried. Page 3 OTHER BUSINESS Mike Schrage, City Manager , provided an update on legal expenses incurred for the initiative petition/lawsuit through the end of July, 2022. Commissioner Longbine expressed his appreciation to Chief Sneidar and the Salina Fire Department for the inaugural 9/11 stair climb/walk at the KWU stadium and stated it was a great event. Tonya Greer, Salina, Kansas , thanked employees of the Salina Fire Department for their assistance when it was needed. CITIZENS FORUM Tonya Greer, Salina, Kansas, shared information related to a dog that was confiscated from her home that she had been training to be a service dog. Ms. Greer indicated the dog was taken because it was believed to be a pit bull which it is not. Ms . Greer had previously discussed the situation with Jacob Wood, Deputy City Manager, and it was established they would continue that discussion outside of the meeting . Norman Mannel, Salina, Kansas , shared his thoughts on the water shortage . Linda Reynolds, Salina, Kansas, presented a timeline of the process followed by city staff for a city code violation they received involving a mural on the side of their office building. Ms. Reynolds stated the result of the process showed there was no violation and taxpayer funds had been wasted. Mark Labes, Salina, Kansas , shared his thoughts on nuisance abatements and the need for a traffic study on Highland A venue. Chad Farber, Salina, Kansas, commented on the attorney 's fees that had been expended for the initiative petition/lawsuit and inquired about the status of the proposed community meetings. Greg Bengtson, City Attorney, explained the executive session language and process. EXECUTIVE SESSION 22-0245 Moved by Commissioner Longbine, seconded by Commissioner Hoppock, to recess into a three minute break, followed by an executive session for 30 minutes, to discuss the subject of data relating to the financial affairs and trade secrets of a corporation within an executive session on the basis of the need to discuss data relating to financial affairs or trade secrets of corporations, partnerships, trusts, and individual proprietorships pursuant to K.S.A. 75-4319(b )( 4). The open meeting will resume in this room at 6:25 p.m. with no action anticipated. The City Commission recessed into executive session at 5:52 p.m. and reconvened at 6:24 p.m. No action was taken. Also present in the executive session were Mike Schrage, City Manager, Jacob Wood , Deputy City Manager, Shawn Henessee, Assistant City Manager, Greg Bengtson, City Attorney , Sarah Steele, Jeff Thompson and Mitch Robinson.
