REGULAR MEETING OF THE BOARD OF COMMISSIONERS
August 22, 2022
4:00 p.m.
Mayor Davis asked the Clerk for verification that notice had been sent for today 's City
Commission meeting . The Clerk replied yes.
The Regular Meeting of the Board of Commissioners was called to order at 4 :00 p.m. in
Room 107 , City-County Building. A roll call was taken followed by the Pledge of
Allegiance and a moment of silence.
Those present and comprising a quorum: Mayor Davis (presiding), Michael L. Hoppock,
Greg Lenkiewicz, Bill Longbine and Karl Ryan.
Also present: Mike Schrage, City Manager, Jacob Wood, Deputy City Manager, Shawn
Henessee, Assistant City Manager, Greg Bengtson, City Attorney ; and Jo Vonna A.
Rutherford, City Clerk.
AWARDS AND PROCLAMATIONS
(3.1) Recognition of the month of September, 2022 , as National Recovery Month in the
city of Salina. Valarie Hicks , Senior Recovery Coach at CKF Addiction Treatment,
read the proclamation and announced related activities.
(3.2) Recognition of the day of September 11, 2022, as National Day of Service and
Remembrance Day in the city of Salina. Chief Tony Sneidar, Salina Fire
Department, read the proclamation and announced related activities.
PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAJN TIME

CONSENT AGENDA
(5.1) Approve the minutes of August 15, 2022.

ADMINISTRATION
(6 .1) Approve Resolution No. 22-8063 appointing members to citizen boards ,
commissions and committees.
Mayor Davis provided comments related to boards, commissions and committees .

(6.2) Discussion of City Commission Agenda Order.

Ben Windholz, Salina, Kansas , presented statistics he compiled related to the Citizen Forum
portion of past City Commission meetings and provided possible suggestions which
included start time of the meetings and the placement of Citizen Forum on the meeting
agenda.
Chad Farber, Salina, Kansas , stated that if Citizen Forum was not scheduled for a specific
time, it should be placed back at the beginning of the agenda so as to serve citizens first.
Norman Manne!, Salina, Kansas , stated citizens should vote on issues .
Rosemary Mai, Salina, Kansas , voiced the need to move Citizen Forum back to where it was
or change the time of the meeting.
Cheri Harp, Salina, Kansas , reiterated Mr. Windholz's suggestion to change the start time of
the meeting or have Citizen Forum at a specific time .
Mark Labes , Salina, Kansas, shared his thoughts on public comment.
A discussion followed which included percentage and number of citizens speaking during
Citizen Forum, positive flow of meetings with new format , email communication with
Governing Body, Zoom meeting capabilities, absence of Citizen Forum in other
municipalities, no requirement for Citizen Forum, important of conducting business at the
meetings , lack of communication, means of communication, placement of Citizen Forum on
the agenda, difficulty of stopping a meeting at a specified time , 3-minute time limit, possible
adjustment of time limit, advantages and disadvantages of time limit and dialogue between
Governing Body and citizens .
22-0233 Moved by Commissioner Longbine to instruct staff to prepare a resolution amending Resolution
No . 22-8027 providing direction about an alternative order of business to be adopted and to have
more free dialogue with the Commission. There was no second. The motion died. There was no
further action taken.
DEVELOPMENT BUSINESS
(7 .1) Aero Plains Addition
(7.la) Consider acceptance of the offered right-of-way , easements and restricted
access dedications from Storage Mart, LLC to serve the proposed Aero Plains
Addition; a 170 lot subdivision of a 53.26 acre tract of land located on the
east side of Centennial Road between Schilling Road and Magnolia Road.
(7 .lb) Approve Ordinance No . 22-11107, on second reading, changing the zoning
classification of this property from A-1 (Agricultural) to R-2 (Multi-Family
Residential).
Dean Andrew, Planning and Zoning Administrator, explained the request, fiscal impact and
action options of item 7 .1 a.

A discussion developed regarding the number of lots in phase 1, access points, the location
of electrical transmission lines and vacation of railroad tracks.
Gary Hobbie, Salina, Kansas, stated the goal with the RHID, Phase 1, was to have 75
building lots containing duplexes for a total of 150 units to be completed over a three year
period. Mr. Hobbie indicated Phase 2 would be a separate issue.
Norman Mannel, Salina, Kansas, shared his thoughts on agricultural land and food
production.
Carol Reed, Salina, Kansas, inquired about the cost per unit to which she received an answer
of approximately $249 ,900 .
Mark Labes, Salina, Kansas, shared his concern about railroad tracks and the flood plain.
Mr. Andrew provided an explanation for the flood plain issue.
Moved by Commissioner Ryan, seconded by Commissioner Lenkiewicz, to accept the offered right-
of-way, easement and restricted access dedications and to authorize the Mayor to sign the plat on
behalf of the city. Aye: ( 4). Nay (0). Motion carried.
Mayor Davis stated that Ordinance No. 22-11107 was passed on first reading on April 4,
2022. Since that time, Building Kansas, LLC has submitted a final plat of the property that
was reviewed and approved by the Planning Commission on August 2, 2022.
Moved by Commissioner Long, seconded by Commissioner Lenkiewicz, to approve Ordinance No .
22-11107, on second reading. Aye: (4). Nay (0). Motion carried.
Commissioner Hoppock rejoined the meeting.
(7.2) Consider renewal of the Certified Local Government (CLG) agreement between the
City of Salina and the State Historic Preservation Officer (SHPO), allowing the
Salina Heritage Commission to retain its current responsibility for performing
National/State Register project review under the State Historic Preservation Act.
Dean Andrew, Planning and Zoning Administrator, explained the request, fiscal impact and
action options.
Commissioner Longbine inquired if St. John's Hospital was on the register and it was
indicated that it is on the state register but not the national register.
Carol Reed, Salina, Kansas, shared her concerns with Pioneer Presidents' Place and the need
for more places for elderly to reside .
Norman Mannel, Salina, Kansas, stated money is being given away for projects such as
these.
Mark Labes, Salina, Kansas, suggested the power needs to go back to the state.

Moved by Commissioner Lenkiewicz , seconded by Commissioner Hoppock, to accept the
recommendation of the Heritage Commission and authorize the City Manager to enter into a new
CLG agreement and approve the administrative review listing as presented. Aye: (5). Nay (0).
Motion carried.
OTHER BUSINESS
Mayor Davis inquired about an update on the ability of tenants of an apartment building to
make complaints about the property. It was discussed that tenants do not have authorization
to make a complaint. Mayor Davis also inquired about the city 's open container ordinance.
It was further discussed that the city 's ordinance was consistent with state statute in that
consumption is a violation but an open container is not.
CITIZENS FORUM
Linda Reynolds , Salina, Kansas , stated she received another v iolation notice for the wall of
their building but now the violation is having a mural that is too large; and , she indicated
there were other murals within the city that were also bigger than the one in question. Ms .
Reynolds stated she has to deal with homeless people coming into their building but the city
is more worried about the sign.
Dalton McDowell , Salina, Kansas , shared his concerns about invasive weeds.
Mark Labes, Salina, Kansas , shared his thoughts on intersections within the city with no
traffic devices present as well as citations being given to landlords instead of tenants for
nuisance violations .
Jackie Heins , Director of Marketing for 24/7 Travel Stores, and Karen Couch , Executive
Director at the Salina Emergency Aid Food Bank, announced an upcoming food drive and
provided information on related events .
Jerry Hinrikus , Salina, Kansas , provided his thoughts on crime within the city and the city 's
homeless situation as well as the city's attention to a sign problem rather than the homeless
problem.
Cheri Harp , Salina, Kansas , also provided her thoughts on the current sign issue at the
Reynolds ' office building .
A brief discussion de veloped related to ordinances involving signs , murals and
electioneering , enforcement and potential harassment.
Norman Mannel , Salina, Kansas , suggested planting food instead of building buildings.
Carol Reed , Salina, Kansas , commented on the Reynolds ' mural and requested an updated
amount of attorney 's fees spent on appealing Kevin Korb 's ordinance petition.
Ken Reitz, Salina, Kansas , shared his thoughts on electromagnetic radiation emitting from
power lines.

Rosemary Mai, Salina, Kansas , questioned whether or not there would be any complaints if
a new mural was painted on the Reynolds' building and stated it was harassment.
Chad Farber, Salina, Kansas , stated the attention given to the mural on the Reynolds '
building has escalated to the point of harassment as election day has passed. Mr. Farber
further stated he believed there was a morale issue within the police department stemming
from being called to address code violations while there are bigger issues in the city.
