ORDINANCE NUMBER 04-10230
AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE
NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA, CODE, AND THE
ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED ANI) PROVIDING FOR
THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE
PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the
rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW,
THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. AMENDMENT. DISTRICT "PC -5". PLANNED SERVICE
COMMERCIAL DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly
adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina
Code, be and it is hereby amended so that the following described property be rezoned as follows, to -
wit:
The South 5.87 feet of the West 55 feet of Lot 2 and the West 55 feet of Lots 3
and 4, Block 3, Evergreen Park Addition to the City of Salina, Saline County,
Kansas (addressed as 314 W. Cloud Street) and
The East 25 feet of the West 80 feet of the South 5.87 feet of Lot 2; and Lot 3,
less the West 55 feet and less the North 15.26 feet of the East 120 feet thereof,
Block 3, Evergreen Park Addition to the City of Salina, Saline County, Kansas
(addressed as 1720 S. 9th Street).
shall become a part of District "PC -511. PLANNED SERVICE COMMERCIAL DISTRICT.
Section 2. CONDITIONS OF APPROVAL. That the use of said described property
shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance
Number 8526, the same being Chapter 42 of the Salina Code with reference to the "C-5" SERVICE
COMMERCIAL DISTRICT regulations except as set out in this ordinance. Development of the
property shall be subject to the plans on file with the City Planning Commission and/or City Clerk and
the following conditions, to -wit:
1. Permitted uses on this property shall be limited to outdoor merchandise
display on the 9th Street frontage plus other uses permitted in the C-3
district. Development on this property shall be subject to the bulk and
use limitations of the C-5 district.
2. Paving coverage shall be limited to 75% of the required front yard on 9th
Street.
3. Proposed trees in the display area shall comply with city guidelines for
type and size and be from the City's approved street tree list.
4. Development of this property shall be completed in substantial
conformance with the site plan and associated submittals.
5. If the applicant fails to remove the existing house within 12 months, the
Planned C-5 zoning shall be deemed to be revoked, the subject property
shall automatically revert back to its former C-3 zoning classification and
the property shall not be used for the display of merchandise..
Section 3. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
