ORDINANCE NUMBER 04-10233
AN ORDINANCE PROVIDING FOR THE VACATION OF AN EXISTING
PUBLIC UTILITY EASEMENT BETWEEN LOTS 1 AND 2, BLOCK 2, BROCK ADDITION
OF THE CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on September 20, 2004, the governing body conducted a public hearing
on the petition of Daniel C. and Nancy Lee King ("Petitioners") requesting vacation of an existing
north -south public utility easement located between Lots 1 and 2, Block 2, Brock Addition in the City
of Salina, Saline County, Kansas, excluding the north twenty (20) feet and the south ten (10) feet
thereof
hearing that:
Section 2. That the governing body finds from the evidence presented at the public
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by vacation of the utility
easement.
(c) In justice to the Petitioner vacation of the utility easement should be
granted.
Section 3. That the above described portion of the utility easement is hereby vacated and
full use of the property encompassed by the vacated portion shall revert to the owners of Lots 1 and 2,
Block 2, Brock Addition in the City of Salina, Saline County, Kansas.
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
