AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE
SAME BEING CHAPTER 36 OF THE SALINA CODE AND THE ZONING DISTRICT MAP THEREIN AND
THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE
CITY AND PRESCRIBING THE PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning
District Map, the rezoning of certain land therein, hereinafter described has
been timely complied with, and SO NOW, THEREFORE,
Kansas:
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Section 1. AMENDMENT. DISTRICT "P.D.D." PLANNED DEVELOPMENT DISTRICT.
That the Zoning District Map of the City of Salina, Kansas, hereto duly adopted
and published as a part of Ordinance Number 8526, the same being Chapter 36 of
the Salina Code, be and it is hereby amended so that the following described
property be rezoned as follows, to -wit:
The West three hundred twenty-five feet (325') of Lot 2,
Surveyor's Plat 18 in the S/2 of the SEA of Section %,
Township 14 South, Range 2 West of the Sixth Principal
Meridian, in Saline County, Kansas.
The West three hundred twenty-five feet (325') of Lot 1,
Surveyor's Plat 34, in the N/2 of the NE/4 of Section 18,
Township 14 South, Range 2 West of the Sixth Principal
Meridian, in the Saline County, Kansas.
The East two hundred forty feet (240'.) of Lot 1, Surveyor's
Plat 8 in the N/2 of the NW/4 of Section 18, Township 14
South, Range 2 West of the Sixth Principal Meridian, in
Saline County, Kansas.
shall become a part of District "P.D.D." PLANNED DEVELOPMENT DISTRICT. That
the use of said described property shall be subject to all the conditions,
restrictions and limitations as made and provided for in Ordinance Number 8526,
the same being Chapter 36 of the Salina Code, with reference to the PLANNED
DEVELOPMENT DISTRICT, and in addition thereto shall be subject to the following
conditions, to -wit:
1. Approval is subject to the approved Preliminary Development
Plan which is on file in the City Clerk's Office and is
incorporated herein by reference.
2. Execution and recording of all public utility easements
within the Planned Development District (P.D.D.) boundaries
and the permanent ponding easement immediately adjacent
and to the east of the P.D.D. as shown on the approved
Preliminary Development Plan. This must all be accomplished
prior to City Planning Commission approval of the Final
Development Plan.
3. Vacation of all existing public utility easements within
the boundaries of the P.D.D. prior to City Planning
Commission approval of the Final Development Plan.
4. Detailed plans and specifications for the drainage
improvements, including all storage ponds, outlet works,
inlets, storm sewers, etc. must be approved by the Engineering
Department prior to their construction.
5. No building permits shall be issued for any structure within
this proposed P.D.D. until the drainage improvements have
been constructed in accordance with the above conditions.
Section 2. This ordinance shall be in full force and effect from and
after its adoption and publication once in the official city newspaper.
