AN ORDINANCE PROVIDING FOR THE VACATION OF CERTAIN ALLEYS BETWEEN
FOURTH AND FIFTH STREETS, AND BETWEEN ASH AND ELM STREETS, IN THE ORIGINAL
TOWNSITE OF THE CITY OF SALINA, SALINE COUNTY, KANSAS.
Kansas:
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Section 1. That certain alleys in the Original Townsite of the City
of Salina, Saline County, Kansas, more particularly described as follows,
to -wit:
Tract 1. All of the ten foot (10') wide platted alley lying
east of Lots 59, 61, 63, 65, 67, 69, 71, 73, 75, and 77 on
Fifth Street, Original Townsite of the City of Salina, Saline
County, Kansas.
Tract 2. All of the alley located in Lots 58 and 60 on Fourth
Street, Original Townsite of the City of Salina, Saline
County, Kansas, more particularly described as follows:
Beginning at a point on the north line of said Lot 58
that is ninety (90) feet west of the west line of Fourth
Street; thence south forty-three feet (43'); thence south
forty-five degrees west (N.450W.) approximately nine and
nine -tenths feet (9.9') to a point on the south line of
said Lot 58 that is twenty-three feet (23') east of the
west line of said Lot 58; thence west twenty-three feet
(23') to the northwest corner of said Lot 60; thence
south along the west line of said Lot 60 a distance of
seventeen feet (17'); thence north forty-five degrees
east (N.45°E.) approximately nine and nine -tenths feet
(9.9') to a point that is ten feet (10') south of the
north line of said Lot 60; thence east thirty-three feet
(33'); thence north sixty feet (60') to the north line of
said Lot 58; thence west ten feet (10') to the point of
beginning.
Tract 3. All of the alley located in Lot 56 on Fifth Street,
Original Townsite of the City of Salina, Saline County, Kansas,
being more particularly described as follows:
Beginning at a point on the north line of said Lot 56
that is seventy feet (70') west of the northeast corner
of said Lot 56; thence south a distance of fifty feet
(50') to the south line of said Lot 56; thence west along
the south line of said Lot 56 a distance of twenty feet
(20'); thence north a distance of fifty feet (50') to the
north line of said Lot 56; thence east twenty feet (20')
to the point of beginning.
Tract 4. All of the alley located in Lot 53 on Fifth Street,
Original Townsite of the City of Salina, Saline County, Kansas,
being more particularly described as follows:
The South twenty feet (20') of said Lot 53•
Tract 5. All of the alley located in Lot 54 on Fourth Street,
Original Townsite of the City of Salina, Saline County, Kansas,
being more particularly described as follows:
The South twenty feet (20') of said Lot 54.
Tract 6. All of the ten foot (10') wide platted alley lying
east of the south twenty feet (20') of Lot 53 on Fifth Street,
Original Townsite of the City of Salina, Saline County, Kansas
be and the same are hereby vacated.
Section 2. That the alleys hereby vacated shall revert to the adjacent
property owners in accordance with K.S.A. 13-443; provided that the United States
Postal Service shall be responsible for the relocation of all city utilities
within these easements.
Section 3. This ordinance shall be in full force and effect from and
after its adoption and publication once in the official city newspaper.
