AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE
NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE
ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR
THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING
THE PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning
District Map, the rezoning of certain property therein, hereinafter described
has been timely complied with, and SO NOW, THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. AMENDMENT. DISTRICT P.D.D. PLANNED DEVELOPMENT
DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly
adopted and published as a part of Ordinance Number 8526, the same being
Chapter 42 of the Salina Code, be and it is hereby amended so that the
following described property be rezoned as follows, to -wit:
Lot Two (2), Surveyor's Plat 18, except the west 75' of said Lot 2;
The West 261' of Lot 4, Surveyor's Plat 18, except the following
described tract:
Beginning at a point 261' east of the southwest corner
of said Lot 4; thence north and parallel with the west
line of said Lot 4 a distance of 1121; thence west and
parallel with the south line of said Surveyor's Plat 18
a distance of 751; thence south and parallel with the
west line of said Lot 4 a distance of 1121; thence east
on the south line of Surveyor's Plat 18 a distance of
75' to the point of beginning.
The East 619' of the West 694' of Lot 1 , Surveyor's Plat 34, except
the following described tract:
The surface of a triangular tract in the southeast corner
of said property containing approximately 0.28 of an acre
heretofore conveyed to the City of Salina, Kansas for flood
control purposes.
shall become a part of District "P.D.D.". PLANNED DEVELOPMENT DISTRICT.
That the use of said described property shall be subject to all the conditions,
restrictions and limitations as made and provided for in Ordinance Number 8526,
the same being Chapter 42 of the Salina Code, with reference to PLANNED
DEVELOPMENT DISTRICTS, and in addition thereto shall be subject to the
following conditions, to -wit:
1. Only single-family dwellings be permitted within the planned
development district.
2. All exterior boundaries of the development shall maintain the
setbacks of the "RS" zone.
3. All public easements (drainage and utility) must be recorded by
separate instrument.
4. The additional 15' of right-of-way on the north side of Iron
Avenue must be recorded by separate instrument.
5. The restricted access control on Iron Avenue and along the flood
control dike must be recorded by separate instrument.
6. Detailed plans and specifications for the drainage
improvements, including all outlet works, inlets, storm sewers,
etc, must be approved by the Engineering Department prior to
their construction.
7. No building permits shall be issued for any structure within
this proposed PDD until the drainage improvements have been
constructed in accordance with the preceding condition.
8. The following corrections made on a revised preliminary
development plan drawing prior to January 30, 1984:
(i) The legal description, to be approved by the
Engineering Department, must be included on the
site plan;
(ii) Delineate the property lines with a darker or wider
line on the "existing conditions" sheet so that they
can be more easily seen;
(iii) Indicate abutting land uses and zoning on the
"existing conditions" sheet.

10. Application for approval of a final development plan, or
all stages thereof, shall be filed within three (3) years.
Section 2. That this ordinance shall be in full force and effect from
and after its adoption and publication once in the official city newspaper.
