AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE
NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE
ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR
THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING
THE PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning
District Map, the rezoning of certain property therein, hereinafter described
has been timely complied with, and SO NOW, THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. AMENDMENT. DISTRICT P.D.D. PLANNED DEVELOPMENT
DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly
adopted and published as a part of Ordinance Number 8526, the same being
Chapter 42 of the Salina Code, be and it is hereby amended so that the
following described property be rezoned as follows, to -wit:
A tract of land in Section Twenty (20) , Township Fourteen
(14) South, Range Two (2) West of the Sixth Principal
Meridian in Saline County, Kansas, described as follows:
Beginning at a point whichis North Eighty-nine degrees
fifty-one minutes East (N.89051'E.) a distance of one
thousand three hundred twelve and sixteen hundredths feet
(1,312.16') and south zero degrees fifty-two minutes west
(S.00521W.) a distance of one thousand forty-nine and five
tenths feet (1,049.51) of the northwest corner of said
Section Twenty (20) , which point being on the east line
of the West Half (Wj) of the Northwest Quarter (NW') of
said Section Twenty (20);
Thence south zero degrees fifty-two minutes west (S.00521W. )
along said west line of the Northeast Quarter of the
Northwest Quarter (NEJ NWf) a distance of seven hundred
fifty-nine and thirty-five hundredths feet (759.351);

Thence north eighty-nine degrees fifty-six minutes east
(N. 890561E. ) a distance of seven hundred fifty-six and
thirty-five hundredths feet (759.351);
Thence south eighty-nine degrees fifty-six minutes west
(S.891561W.) a distance of three hundred sixty-one and
forty-seven hundredths feet (361.471) to the point of
beginning, containing 6.08 acres, more or less.
shall become a part of District "P.D.D.". PLANNED DEVELOPMENT DISTRICT.
That the use of said described property shall be subject to all the conditions,
restrictions and limitations as made and provided for in Ordinance Number 8526,
the same being Chapter 42 of the Salina Code, with reference to PLANNED
DEVELOPMENT DISTRICTS, and in addition thereto shall be subject to the
following conditions, to -wit:
1. Use is limited to a maximum of 38 multiple-family/townhouse/
condominium units.
2. Detailed grading and pavement plans must be submitted to the
City Engineering Department for approval prior to the issuance
of any building permit.
3. Approval is subject to the approved Preliminary Development
Plan which is on file in the City Clerk's Office and is
incorporated herein by reference.
4. Application for approval of a final development plan, or all
stages thereof, shall be filed within three (3) years.
Section 2. That this ordinance shall be in full force and effect from
and after its adoption and publication once in the official city newspaper.
