84-8987 Zone Twin Oaks II(Published in The Salina Journal JGn Is , 1984) AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, and SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT P.D.D. PLANNED DEVELOPMENT DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: Lot 13, Block 4; Lots 5, 6, 7, 8, Block 5; Lot 1 , Block 6; Lots 5, 6, 7, 8, Block 7, all in Twin Oaks II Subdivision of the City of Salina, Saline County, Kansas shall become a part of District "P.D.D.". PLANNED DEVELOPMENT DISTRICT. That the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code, with reference to PLANNED DEVELOPMENT DISTRICTS, and in addition thereto shall be subject to the following conditions, to -wit: 1. The city reserves the right to review and approve any storm drainage system construction plans which provide for the discharge of any private storm sewer system into any public storm sewer facilities including the Ohio Street drainage ditch and all of the enclosed underground system. 2. Use is limited to a maximum of 69 multiple-family/townhouses/condominium units. 3. The Planning Commission is hereby authorized to modify the schedule of development of the various phases in accordance with Section 42-403(a) (8) of the Salina Code. 4. Approval is subject to the approved Preliminary Development Plan which is on file in the City Clerk's Office and is incorporated herein by reference. 5. Application for approval of a final development plan, or all stages thereof, shall be filed within three (3) years. Section 2. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
