Boole 1415 Page: 122 ORDINANCE NUMBER 22-11125 AN ORDINANCE PROVIDING FOR THE ANNEXATION AND ZONING OF CERTAIN TRACTS OF LAND IN SALINE COUNTY, KANSAS IN CONFORMITY WITH THE PROVISIONS OF K.S.A. 12-519 TO 12-526, INCLUSIVE. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. Findings. The following findings support the annexation of the property described in Section 2 by the City of Salina: 1. The subject property is the site of an existing vacant building whose owner wishes to receive City utilities and services. 2. Annexation is being requested by the property owner in order to allow the property to receive City water service and fire protection. 3. The subject property is located in the City's Urban Service Area and is adjacent to the city limits on the east. Section 2. Annexation. The following described tract of land: A tract of land located in the Southwest Quarter and the Northwest Quarter of Section 11 , Township 14 South, Range 3 West of the Sixth Principal Meridian in Saline County, Kansas and part of Park No. l , all of Park No. 2, and part of Lot 1, Lot 2, and Lot 3 of Block 6, Chicago Addition, City of Salina, Saline County, Kansas and more particularly described as follows: Commencing at the Northeast corner of said Southwest Quarter; thence on an assumed bearing of South 89° 51' 28" West on the north line of said Southwest Quarter, a distance of 540.54 feet to the center of Dry Creek and the POINT OF BEGINNING; thence North 00° 08' 32" West on the centerline of Dry Creek, a distance of 33.01 feet to the north K-140 right of way line; thence South 89° 51' 28" West on the north K-140 right of way line , a distance of 81.64 feet; thence continuing on the north K-140 right of way line on a curve to the left with a radius of 633.00 feet, an arc len gth of 567 .89 feet, a chord bearing of South 64° 09' 25" West, and a chord distance of 549.03 feet; thence South 38° 22' 59" West on the north K-140 right of way line, a distance of 302.37 feet; thence South 51° 37' 0 l" East, a distance of 66.00 feet to the south K-140 right of way line; thence South 59° 03' 45" East, a distance of 334.44 feet; thence South 48° 41' 33" East, a distance of33.00 feet to the centerline of Dry Creek; thence North 41 ° 18' 27" East on the centerline of Dry Creek, a distance of 138.28 feet; thence North 44° 57' 08" East on the centerline of Dry Creek, a distance of272.12 feet; thence continuing on the centerline of Dry Creek on a curve to the left with a radius of 400.00 feet, an arc length of 314.82 feet, a chord bearing of North 22° 24' 18" East, and a chord distance of306. 76 feet; thence North 00 ° 08' 32" West on the centerline of Dry Creek, a distance of 98.20 feet to the POINT OF BEGINNING. Zoning. The building site described in Section 2 above shall be classified as lying in an I-2 (Light Industrial) zoning district upon annexation which is consistent with its current Saline County zoning classification. Section 4. Repealer. That all prior ordinances in conflict herewith as they relate to the above described real estate are hereby repealed. Section 5. Summary of ordinance for publication. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper. Ordinance No . 22-11125 Summary On July 25, 2022, the City of Salina, Kansas passed Ordinance No. 22-11125. The ordinance annexes a 5.04 acre tract ofland located on the south side of West North Street and West Old Highway 40 west of Broadway Boulevard and the abutting Old Highway 40 right-of-way into the city limits and classifies the tract as lying in an I-2 (Light Industrial) zoning district consistent with its current Saline County zoning classification.
