"' "' CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS June 13, 2022 4:00 p.m. Mayor Davis asked the Clerk for verification that notice had been sent for today's City Commission meeting. The Clerk replied yes. The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107, City-County Building . A roll call was taken followed by the Pledge of Allegiance and a moment of silence. Those present and comprising a quorum: Mayor Trent W. Davis, M.D. (presiding), Michael L. Hoppock and Bill Longbine. Absent: Greg Lenkiewicz and Karl Ryan. Also present: Mike Schrage, City Manager, Shawn Henessee, Assistant City Manager , Greg Bengtson, City Attorney; and JoVonna A. Rutherford, City Clerk. AWARDS AND PROCLAMATIONS (3.1) Recognition of the day of June 18, 2022 , as Dana Adams Remembrance Day in the city of Salina. Scarlet Sharpe, a member of NAACP and student at Cottonwood Elementary, read the proclamation and announced related activities. (3 .2) Recognition of the day of June 18, 2022, as Juneteenth in the city of Salina. Jackie Anders, Founder of the Salina Juneteenth Celebration Committee, read the proclamation and announced related activities. (3.3) Recognition of the month of June, 2022, as Elder Abuse Awareness Month in the city of Salina. Brandi Bohm, Domestic Violence & Elder Abuse Program Manager at DV ACK, will read the proclamation. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (4.1) Public Hearing-Ordinance No. 22-11118 (4.la) Conduct Public Hearing. ( 4.1 b) Approve Ordinance No. 22-11118, on first reading, de-annexing that portion of the Chicago Addition lying west of the relocated Dry Creek channel. Mike Schrage, City Manager, stated there were only three commissioners present which was sufficient to call the meeting to order and conduct business; however, Commissioner Hoppock had a common law conflict of interest on the item . Greg Bengtson, City Attorney, explained the procedural aspect of the item and provided his recommended action. 22-0157 Moved by Commissioner Longbine, seconded by Commissioner Hoppock, that the public hearing ,..., and report on Petition 4418 filed by Tom Pestinger on behalf of Pestinger Enterprises, LLC, requesting de-annexation of that portion of the Chicago Addition lying west of the relocated Dry • Creek Channel in consideration of Ordinance No. 22-11118 be postponed until 4 p.m. or as soon Page 1 "' "' thereafter as the matter can be heard during the regular City Commission meeting on Monday, June 27, 2022. Aye: (3). Nay (0). Motion carried. CONSENT AGENDA (5.1) Approve the minutes of June 6, 2022. Moved by Commissioner Longbine, seconded by Commissioner Hoppock, to approve the consent agenda as presented. Aye: (3). Nay (0). Motion carried. ADMINISTRATION (6.1) Approve Ordinance No. 22-11116, on second reading, amending and supplementing Ordinance No. 22-11099 exempting certain property in the City of Salina, Kansas, from ad valorem taxation for economic development purposes pursuant to Article 11, Section 13 of the Kansas Constitution; providing the terms and conditions for ad valorem tax exemption; and describing the property so exempted. Mayor Davis stated that Ordinance No. 22-11116 was passed on first reading on June 6, 2022, and no comments have been received since that time. 22-0159 Moved by Commissioner Hoppock, seconded by Commissioner Longbine, to approve Ordinance No. 22-11116, on second reading. A roll call vote was taken. Aye: (3). Nay (0). Motion carried. (6.2) Approve Ordinance No. 22-11117, on second reading, changing the zoning district classification from R (Single-Family Residential) to C-3 (Shopping Center) district on property located at the southwest comer of Magnolia Road and Highland A venue. Mayor Davis stated that Ordinance No. 22-11117 was passed on first reading on June 6, 2022, and no comments have been received since that time. 22-0160 Moved by Commissioner Hoppock, seconded by Commissioner Longbine, to approve Ordinance No. 22-11117, on second reading. A roll call vote was taken. Aye: (3). Nay (0). Motion carried. (6.3) Approve Resolution No. 22-8051 authorizing the City Manager to enter into an agreement with Travelers for the renewal of the City's Comprehensive Property/Casualty Insurance Program. Nancy Schuessler, Risk Manager, explained the request, fiscal impact and action options. A discussion followed related to the deductible buy down option, buildings covered, premiums, cyber liability coverage, self-insurance and reserved funds . 22-0161 Moved by Commissioner Hoppock, seconded by Commissioner Longbine, to approve Resolution No. 22-8051 with no deductible buy down option. Aye: (3). Nay (0). Motion carried. DEVELOPMENT BUSINESS (7.1) Approve Resolution No. 22-8055 authorizing staff to submit an application on behalf of eligible local recipient agencies for the 2022 Kansas Emergency Solutions Grant Program. .Page 2 .. A discussion ensued related to applications , agency requests and agency match . Norman Mannel, Salina, Kansas, suggested U.S. military tents be used to house the homeless. Moved by Commissioner Longbine, seconded by Commissioner Hoppock , to approve Resolution No. 22-8055. Aye: (3). Nay (0). Motion carried. OTHER BUSINESS Mike Schrage provided a total amount of $51 ,315.50 for legal fees expended, through April , 2022, on the initiative referendum petition ordinance matter. Mr. Schrage further provided information on staffing numbers at the Salina Police Department. CITIZENS FORUM Kevin Brown, Rocking B Carriage , inquired about and shared his thoughts on the new downtown Arts, Commerce and Entertainment ordinance . Norman Mannel, suggested Mr. Brown talk to South Hutchinson about their similar ordinance . Karen Hecker Pratt, Salina, Kansas , shared her thoughts on housing Ukranian , Russian and Jewish refugees in Salina. Tracey Sin, Salina, Kansas , promoted assistance for elementary children and mental illness. Tracey also stated people should not be speaking out against homosexuals as all are God 's children. Tracey finished by thanking Brad Anderson and Arts & Humanities for the ri ver festival. Casey Flinn, Salina, Kansas , a member of the Kansas ISIS Shriner ' s, announced that the circus would be back in Salina in February of 2023 and asked for the community 's support. Chad Farber, Salina, Kansas , commented on the money spent for attorney's fees for the petition and encouraged the Governing Body to allow the will of the people to go forward. Mr. Farber also commented on the Governing Body 's pay, the need for younger individuals on the commission, crime rate in the city , morale issues at the Salina Police Department , police protest march and the Pridefest drag show. Jon Blanchard, Salina, Kansas, inquired about the location of the South Park property which was the subject of an executive session. Mr. Blanchard provided his thoughts on horse carriages downtown, retention study and Salina Police Department staffing . A discussion followed related to the retention study , crime rate , Salina Police Department staffing and pay rates . Page 3 "' "' Norman Mannel, Salina, Kansas , stated members of the Governing Body should divest themselves from businesses upon being elected so they do not have to recuse themselves. Mr. Mannel also mentioned Flag Day , Native American water rights and wage increases. Greg Bengtson, City Attorney , addressed the manner in which Commissioner Hoppock had carefully complied with Kansas law as a Commissioner and business person. Rosemary Mai, Salina, Kansas, shared her thoughts on disrespect of police officers and the planned anti-police march and stated we should be thanking them for their service. Karen Hecker Pratt stated the Governing Body was not serving for money but love of community . A brief discussion took place on pay of the Governing Body.
