Paving, grading, and drainage pipe in ETHERINGTON COURT from Fairdale Road to cul-de-sac. Water main to serve Lots Seventeen (17) through Twenty-four (24), Block Two (2), and Lots Twenty-one (21) through Twenty-five (25), Block Three (3), Country Hills Addition Number Two. Lateral Sanitary Sewer 611. Lateral Sanitary Sewer 612. Replat of Blocks 3, 4, 5, 6, and 8, Lakewood Addition Curbing, guttering, paving and grading of CIRCLE DRIVE from Ohio Street to Elm Street and the Circle Drive and Elm Street intersection and the storm sewer system to serve the above described street improvement. Water system to serve Lots Two (2) through Five (5), Block One (1); and Lots One (1) through Four (4), and part of Lot Twenty-two (22), Block Two (2), Replat of Blocks 3, 4, 5, 6, and 8, Lakewood Addition to the City of Salina, Saline County, Kansas. Twin Oaks II Subdivision Curbing, guttering, paving and grading of BURR OAK LANE from Ohio Street to a point 230.8 feet west of the west line of Redbud Lane. A drainage ditch over and upon the following described parcel of land in the South Half of the Northwest Quarter of Section Thirty-one (31), Township Fourteen (14) South, Range Two (2) West of the Sixth Principal Meridian beginning at a point on the east right-of-way line of Ohio Street, and ninety-three feet (93') south of the northwest corner of the south half of the Northwest Quarter of the above mentioned section, thence running east a distance of two thousand nine hundred eighty-two feet (2,982') and parallel to the north line of the south half of the above mentioned Northwest Quarter Section to the Smoky Hill River Channel. A drainage ditch beginning at a point ninety-three feet (93') south and sixty-five feet (65') west of the northwest corner of the South Half of the Northwest Quarter of Section Thirty-one (31), Township Fourteen (14) South, Range Two (2) West of the Sixth Principal Meridian, thence running south along a line and sixty-five feet (65') west of the center line of Ohio Street to the south line of the Northwest Quarter of said Section where the ditch intercepts the existing west ditch of Ohio Street. There shall be a sixty (60) RCP with end sections installed where the drainage system crosses Ohio Street and where it crosses Burr Oak Lane. There shall be a storm sewer pipe installed in Burr Oak Lane from Ohio Street to the west line of Lot 9, Block 7, Twin Oaks II Subdivision. Lateral Sanitary Sewer 615. Six inch water main beginning by connecting to an existing six inch water main in the intersection of Burr Oak Lane and Ohio Street, thence running west in Burr Oak Lane to the intersection of Burr Oak Lane and Redbud Lane. WHEREAS, pursuant to proceedings regularly had according to law, contracts have been let for the following improvements in the City of Salina, Saline County, Kansas Country Hills Addition Number 2 Paving, grading, and drainage pipe in FAIRDALE COURT from Fairdale Court to Etherington Court. Paving, grading, and drainage pipe in ETHERINGTON COURT from Fairdale Road to cul-de-sac. Water main to serve Lots Seventeen (17) through Twenty-four (24), Block Two (2), and Lots Twenty-one (21) through Twenty-five (25), Block Three (3), Country Hills Addition Number Two. Replat of Blocks 3, 4, 5, 6, and 8, Lakewood Addition Curbing, guttering, paving and grading of CIRCLE DRIVE from Ohio Street to Elm Street and the Circle Drive and Elm Street intersection and the storm sewer system to serve the above described street improvement. Twin Oaks II Subdivision Curbing, guttering, paving and grading of BURR OAK LANE from Ohio Street to a point 230.8 feet west of the west line of Redbud Lane. A drainage ditch over and upon the following described parcel of land in the South Half of the Northwest Quarter of Section Thirty-one (31), Township Fourteen (14) South, Range Two (2) West of the Sixth Principal Meridian beginning at a point on the east right-of-way line of Ohio Street, and ninety-three feet (93') south of the northwest corner of the south half of the Northwest Quarter of the above mentioned section, thence running east a distance of two thousand nine hundred eighty-two feet (2,982') and parallel to the north line of the south half of the above mentioned Northwest Quarter Section to the Smoky Hill River Channel. A drainage ditch beginning at a point ninety-three feet (93') south and sixty-five feet (65') west of the northwest corner of the South Half of the Northwest Quarter of Section Thirty-one (31), Township Fourteen (14) South, Range Two (2) West of the Sixth Principal Meridian, thence running south along a line and sixty-five feet (65') west of the center line of Ohio Street to the south line of the Northwest Quarter of said Section where the ditch intercepts the existing west ditch of Ohio Street. There shall be a sixty (60) RCP with end sections installed where the drainage system crosses Ohio Street and where it crosses Burr Oak Lane. There shall be a storm sewer pipe installed in Burr Oak Lane from Ohio Street to the west line of Lot 9, Block 7, Twin Oaks II Subdivision. Lateral Sanitary Sewer 615. Six inch water main beginning by connecting to an existing six inch water main in the intersection of Burr Oak Lane and Ohio Street, thence running west in Burr Oak Lane to the intersection of Burr Oak Lane and Redbud Lane. and such contracts have been duly performed, and WHEREAS, the Board of Commissioners has determined that the total cost of such improvements is Four Hundred Seventy-nine Thousand Nine Hundred Ninety-seven and 68/100 dollars ($479,997.68) and that 96.77 percent in the amount of Four Hundred Sixty-four Thousand Four Hundred Ninety-two and 46/100 dollars ($464,492.46) be assessed against the improvement district and 3.23 percent in the amount of Fifteen Thousand Five Hundred Five and 22/100 dollars be assesed against the city -at -large. WHEREAS, the Board of Commissioners has, after due notice, met and determined the amount of special assessments, SO NOW, THEREFORE BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. Said amounts so levied, apportioned and assessed as aforesaid will be due and collectible in ten equal installments, the first becoming due with the taxes levied for the year 1983, and one of said installments falling due each and every year thereafter until all are paid and all to be collected with interest as in this ordinance provided, HOWEVER, that the owner of any piece or parcel of property liable for any such assessments may redeem his property from such liability bypaying to the City Treasurer the entire amount chargeable against the same, as in this ordinance provided, at any time within thirty days after the publication of this ordinance and before the issuance of bonds of said City in payment of the balance of the cost of said improvements, the property so paid on shall not thereafter be liable for any further assessments for the cost of said improvements, nor for any part of said bonds. Section 3. There is hereby levied further and assessed against such lots and pieces of ground described in this ordinance, interest at such rate per annum as shall be borne by bonds hereafter to be issued for the payment of the remaining unpaid cost of such improvements to be hereafter determined and fixed by ordinance, when such bonds are issued on all of said installments mentioned and providedfor in this ordinance, from the date of the bonds which may be issued at the end of thirty days as specified in the preceding section hereof, as by law provided, to the time of the collection of the installments as provided by law, which said interest shall be collected and after the taking effect of this ordinance and the fixing of said interest rate when such bonds are authorized and issued, however such interest rate shall not exceed 12 percent per annum, it shall be the duty of the City Clerk of said City to annually, at the same time other taxes are certified, and until all of said assessments so apportioned and levied have been certified to the County Clerk of Saline County, Kansas, certify a full list of all property liable to assessments and taxation for such work and improvements, except such property on which the special assessments aforesaid have been paid in full, as hereinbefore provided, together with the respective amounts due on each of said lots and pieces of ground, which amounts shall include the annual installments on special assessments together with the interestfor one year at the rate to be fixed as provided for in this ordinance, on all unpaid balances of such assessments, such amounts so certified as herein provided shall be placed upon the tax roll by the County Clerk of Saline County, Kansas, and collected as other taxes are collected. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
