CITY OF SALINA, KANSAS
REGULAR MEETING OF THE BOARD OF COMMISSIONERS
June 6, 2022
4:00 p.m.
Mayor Davis asked the Clerk for verification that notice had been sent for today's City
Commission meeting. The Clerk replied yes.
The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in
Room 107 , City-County Building. A roll call was taken followed by the Pledge of
Allegiance and a moment of silence.
Those present and comprising a quorum: Mayor Trent W. Davis, M .D. (presiding), Greg
Lenkiewicz, Bill Longbine (via Zoom) and Karl Ryan. Absent: Michael L. Hoppock.
Also present: Mike Schrage, City Manager, Jacob Wood, Deputy City Manager, Shawn
Henessee , Assistant City Manager, Greg Bengtson, City Attorney ; and JoVonna A.
Rutherford, City Clerk.
AWARDS AND PROCLAMATIONS
None.
PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME
None.
CONSENT AGENDA
(5.1) Approve the minutes of May 23, 2022 .
(5.2) Approve Resolution No. 22-8056 amending fees in the 2022 Comprehensive Fee
Schedule related to Ambulance Fees .
(5.3) Authorize the City Manager to execute a five-year agreement with AXON
Enterprise, Inc. for the purchase of 68 new AXON Taser 7 Conductive Energy
Weapons.
(5.4) Approve Resolution No. 22-8052 setting the date for a public hearing to consider
whether a dangerous structure at 1123 W. Ash shall be condemned and ordered
demolished or repaired.

ADMINISTRATION
(6.1) Approve Ordinance No . 22-11114, on second reading, amending Chapter 6 of the
Salina Code by amending its title and by adding an article to Chapter 6 to be
numbered Article IV to authorize , permit and regulate food trucks , horse.-drawn
vehicles and pedicabs , outdoor merchandise and minor sidewalk dining areas ,
sidewalk vending, and street performers within the area designated as the Downtown
Arts , Commerce and Entertainment District in the city of Salina, Kansas.

Mayor Davis stated that Ordinance No. 22-11114 was passed on first reading on May 23,
2022 .
Lauren Driscoll, Director of Community and Development Services, explained technical
:2 items which were amended.
22-0 51 Moved by Commissioner Ryan , seconded by Commissioner Lenkiewicz, to approve Ordinance No.
~ 22-11114, on second reading, with amendments as stated. A roll call vote was taken . Aye: (4). Nay i (0). Motion carried.
"!2 g 8 (6.2) Approve Resolution No. 22-8057 establishing fees for downtown activity permits.
Lauren Driscoll, Director of Community and Development Services , explained the request,
fiscal impact and action options.
A brief discussion followed related to how lewd and lascivious behavior would be
addressed.
22-0152 Moved by Commissioner Lenkiewicz, seconded by Commissioner Longbine , to approve Resolution
No. 22-8057. Aye: (4). Nay (0). Motion carried.
(6.3) Approve Ordinance No . 22-11116, on first reading, amending and supplementing
Ordinance No. 22-11099 exempting certain property in the City of Salina, Kansas ,
from ad valorem taxation for economic development purposes pursuant to Article 11,
Section 13 of the Kansas Constitution; providing the terms and conditions for ad
valorem tax exemption; and describing the property so exempted .
Mike Schrage , City Manager, explained the request , fiscal impact and action options.

22-11116, on first reading. Aye: (4). Nay (0). Motion carried.
DEVELOPMENT BUSINESS
(7.1) Approve Ordinance No . 22-11117, on first reading , changing the zoning district
classification from R (Single-Family Residential) to C-3 (Shopping Center) district
on property located at the southwest comer of Magnolia Road and Highland A venue.
Dean Andrew, Director of Planning, explained the request, fiscal impact and action options.
22-0154 Moved by Commissioner Ryan, seconded by Commissioner Lenkiewicz, to approve Ordinance No.
22-11117, on first reading. Aye: (4). Nay (0). Motion carried.
OTHER BUSINESS
Greg Bengtson, City Attorney, provided a brief overview of the initiative referendum
petition ordinance opinion rendered by Judge Hickman.
Mayor Davis suggested the back of the stage facing the intersection of Santa Fe & Ash
would be a good location for an interactive message system/video board for events
happening in downtown Salina. Mike Schrage, City Manager, indicated staff would look at
options.

Commissioner Lenkiewicz shared he helped welcome the Kansas Square Dance Association
to Salina over the past weekend and stated they were a great group of people.
Mayor Davis commented on the Relay for Life event at KWU over the weekend stating it
was a great event and the campus was beautiful.
CITIZENS FORUM
Norman Mannel, Salina, Kansas, provided his thoughts on safety and security for the Smoky
Hill River Festival.
Tracey Sin, Salina, Kansas, shared information about a recent crime incident at Oakdale
Park and inquired as to what could be done to make sure the citizens of Salina were safe.
Tracey also stated Salina's homeless should not be bullied.
Carol Reed, Salina, Kansas, inquired about the final amount of attorney's fees expended for
the initiative referendum petition ordinance matter.
Chad Farber, Salina, Kansas, stated Tracey Sin had valid concerns and citizens around the
city were voicing similar concerns about the crime rate and what can be done about it adding
that law enforcement was gravely understaffed, underpaid, and under-respected . Mr. Farber
also recognized the 7gth anniversary of D-Day and shared his thoughts on the ordinance.
Jon Blanchard, Salina, Kansas, echoed Mr. Farber's recognition of D-Day. Mr. Blanchard
also voiced his opinions on retention at the Salina Police Department and inquired about
repair of a section on Crawford Street.
Cheri Harp, Salina, Kansas, inquired about the city commission email being fixed, stated she
would like to have a public forum, and shared her frustration about yard signs being stolen
from private property.
EXECUTIVE SESSION
22-0155 Moved by Commissioner Ryan, seconded by Commissioner Lenkiewicz that the city commission
recess into executive session for 25 minutes to discuss the subject of the legal implications of the
district court ruling in the initiative ordinance case with legal counsel based upon the need for
consultation with an attorney for the public body which would be deemed privileged in the attorney-
client relationship, pursuant to K.S.A. 75-7319(b )(2). The open meeting will resume in this room at
5: 17 p.m. Possible action to follow. Aye: ( 4). Nay (0). Motion carried.
The City Commission recessed into executive session at 4:52 p.m. and reconvened at 5:17
p.m. No action was taken.
Also present in the executive session were Mike Schrage, City Manager, Jacob Wood,
Deputy City Manager, Shawn Henessee, Assistant City Manager, and Greg Bengtson, City
Attorney.
