ORDINANCE NUMBER 85-9092
AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF
A CERTAIN NORTH SOUTH ALLEY LOCATED BETWEEN FOURTH STREET AND
FIFTH STREET, FROM THE NORTH LINE OF ELM STREET TO A POINT 25 FEET
NORTH OF THE SOUTHEAST CORNER OF LOT 37, FIFTH STREET, ORIGINAL
TOWNSITE, IN THE CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. That a portion of a certain north south alley located
between Fourth Street and Fifth Street, described as follows:
The ten foot (101) north south alley from the north line of
Elm Street to a point 25 feet north of the southeast corner
of Lot 37, Fifth Street, Original Townsite, abutting the
South Z of Lot 37, all of Lots 39, 41, 43, 45, and 47 on
Fifth Street, Original Townsite, and the South J of Lot 38,
all of Lots 40, 42, 44, 46, 48 on Fourth Street, Original
Townsite
be and the same is hereby vacated; provided, however, the City reserves the
right to construct, repair and maintain sewer lines, water lines, electric lines,
telegraph lines, gas lines and other utility lines in said alley.
Section 2. That the alley hereby vacated shall revert, subject to the
reservations aforesaid to the adjoining land as provided by law.
Section 3. That this ordinance shall be in full force and effect from
and after its adoption and publication once in the official city newspaper.
