04-10-1939 Minutes Organizational440 COMMISSIONERS PROCEEDINGS, REGULAR MEETING. f COMMISSIONERS ROOM, SALINA, KANSAS. APRIL 10, 1939. Regular meeting of the Board of Commissiore rs April 10, 1939. Meeting was called to order by Mayor Morgenstern, the roll wasc alled and Commissioners !Morgenstern, Branson, Ferm, Jackson and Mitchell and City Attorney Norris responded. The minutes of the Regular Meeting of April 3, 1939 were read and approved as read. Applications for taxicab drivers license for the year 1939 received from: _ Edwin T. Price, Clifford Curtis Commissioner Ferm moved that applications be granted by the Board of Commissioners. Motion adopted. D. A. Nelson and Genevieve Katherine Nelson presented amended plat for the Replat of Lots 2, 3, 4 and 5 in Mt. Barbara Park Addition. Commissioner Branson moved that plat be approved subject to the approval of the City Planning Commission. Motion adopted. An ordinance was introduced entitled: "An ordinance making appropriation for the payment of certain claims." On motion of Commissioner Mitchell the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Morgenstern, Branson, Ferm, Jackson and Mitchell (5) Nays: (0) Mayor approved the ordinance and it is numbered A-18. An ordinance was introduced entitled: "An ordinance making appropriation for the payment of certain claims." On motion of Commissioner Ferm the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Morgenstern, Branson, Ferm, Jack- son and Mitchell (5) Nays: (0) Mayor approved the ordinance and it is numbered A-19. An ordinance was introduced for second reading entitled: "An ordinance relating to and apportioning and levying special assess- ments on certain lots and pieces of ground in the Uity of Salina to pay the cost of curbing and guttering Clark Street. from the north line of Walnut Street to the south line of Marietta Avenue; Delaware Avenue from the south line of Iron Avenue to the center line `oi`r stown Avenue; Des Moines Avenue from the north line of Ash Street to the south line o m treet; ig_hth Street from the north line of Pacific Avenue to the north line of Harsh treet; Johnstown Avenue from the east line of Columbia Avenue to the east line of ansas Avenue; Kansas Avenuefrom the south line of Iron Avenue to the north line of Gypsum venue; Kirwin Avenue from the west line of Santa rye Avenue to the east line o igh an venue; Merrill Streetfrom the south line of Crawford Street to the north line o , son treet; Oakdale Avenue from the south line of Johnstown Avenue to the south line of Ash treet; Republic Avenue from the east line of Eleventh Street to the west line of Sherman street; Tenth Street from the north line if Frost Street to the north line of Franklin treet; and relat- ing to and providing for the collection and payment of such assess- ments." On motion of Commissioner Mitchell the ordinance was read and adopted by sections and on its final adoption the roll wasc celled and the following vote was had; Ayes: Morgenstern, Branson, Ferm, Jack- son and kitchell (5) Nays: (0) Mayor approved the ordinance and it is numbered 4931. A resolution was introduced for second reading entitled: "A. resolution relating to the construction of certain sidewalks in the City of Salina." On motion of Commissioner Jackson the resolution was adopted as read and on its final adoption the roll was called and the following voje was had; Ayes: Morgenstern, Branson, Ferm, Jackson and Mitchell (5; Nags: (0) Mayor approved the resolution and it is numbered 761. 4,1 f I The above resolution is recorded in full on Pages 125 to 127 inclusive, Resolution Book Number 3. i Aetition was p presented asking for the construction of a water main on Phillips Street between Prescott Avenue and Morrison Avenue. � Petition was referred to the Waterworks Advisory Board. i A petition was resented asking for the construction of a sani- tary sewer on Phillips ►street between Prescott Avenue and Washington Street. Petition was referred to the City Engineer. The following application for Cereal Malt Beverage License for 1939 was received: _ GENERAL RETAIIE R CLASS "B" INDIVIDUAL _ — Application No. _Name of Applicant Name and location of Place of Business 57 -Mrs. Ola Wiesner The Diamond Cafe, 129 North Fifth Street Commissioner Ferm moved that application be granted by the Board of Commissioners and that the City Clerk be directed to issue license tos aid applicant. Motion adopted. Notice of cancellation of taxicab insurance policy covering taxicab of John Meredith, Number 41, 1935 Plymouth Sedan, Motor Number 78025, Serial No. 2443184, was received. Moved by Commissioner Mitchell that taxicab license of the above named party be cancelled, and that he be notified by the City Clerk of such cancellation, and that the Chief"'6f Police notify Mr. Meredith to cease operation of such taxicab. Motion adopted. Commissioner Ferm moved that the benefit assessed against Lots 4, 5 and 6, Elmdale Addition, in the amount of $375.00, being the amount of benefit assessed for the No. 81 By -Pass be remitted. Motion adopted. A resolution was introduced entitled: rrr, resolution relating to maintenance and operation of street lights (U. P. R. R. ) from June 30, 1939 to June 30, 1941." On motion of Commissioner Mitchell the resolution wasadopted as read and on its final adoption the roll wascalled and the following vote was had; Ayes: 11orgenstern, Branson, Ferm, Jackson and Mitchell (5) Nays: (0) Mayor approved the resolution and it is numbered 76.2. The above resolution is recorded in full on Page 128, Resolu- tion Book Number 3, Commissioner Jackson moved that a sidewalk be constructed on the east side of Kenwood Park Bridge. Motion adopted. On motion of Commissioner Jackson the present Board of Commis- sioners adjourned. City Clerk f 442 COMMISSIONERS PROCEEDINGS, REGULAR MEETING. COMMISSIONERS ROOM, � — SALINA, KANSAS. APRIL 10, 1939. i Commissioners meeting re -convened. Chas. E. Banker, City Clerk presided. The newly elected Commissioners having filed their bonds, and the same having been approved by the Judge of the District Court, and being present, the oath of office was administered by the City Clerk to 1%n. H. Ferm, Psi. L. Mitchell and B. A. Breon. The roll wascalled and the following responded to roll call: Mor- genstern, Branson, Breon, Ferm and Mitchell arrd City Attorney Norris, Commissioner Ferm nominated Ed Morgenstern for the office of Chairman of the Board of Commissioners and Mayor for the ensuing year, who was duly elected. I Commissioner Branson nominated Wm. H. Ferm for the office of Vice Chairman of the Board of Commissioners and Acting Mayor for the ensuing year, who was duly elected. On motion of Commissioner Mitchell the Board of Commissioners adjourned. City Clerk
