05-09-2022 Minutes"' "' CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS May 9, 2022 4:00 p.m. Mayor Davis asked the Clerk for verification that notice had been sent for today 's City Commission meeting. The Clerk replied yes. The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107 , City-County Building. A roll call was taken followed by the Pledge of Allegiance and a moment of silence. Those present and comprising a quorum: Mayor Trent W. Davis, M .D. (presiding), Michael L. Hoppock, Greg Lenkiewicz, Bill Longbine and Karl Ryan. Also present: Mike Schrage, City Manager, Jacob Wood, Deputy City Manager, Shawn Henessee, Assistant City Manager, Greg Bengtson, City Attorney; and JoVonna A. Rutherford, City Clerk. AWARDS AND PROCLAMATIONS (3.1) Recognition of the week of May 15-21, 2022 , as Emergency Medical Services Week in the city of Salina. Tony Sneidar, Fire Chief, read the proclamation and announced related activities. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (4.1) Public Hearing -Dangerous structures located at 244 E. Diamond Dr., 615 S. 9th and 619 S. Santa Fe (4 .la) Conduct Public Hearing. (4 .lb) Approve Resolution No. 22-8047, finding that the structure at 244 E . Diamond Dr. is unsafe or dangerous; directing that the structure be repaired or removed and the premises made safe and secure; fixing a time of 30 days for commencement of work (on or before June 8th, 2022) and 60 days (on or before July 8th, 2022) within which the repair or removal shall be completed; and authorizing staff to proceed with the demolition or repair if the owner(s) fail to comply . (4 .lc) Approve Resolution No. 22-8048 , finding that the structure at 615 S. 9th is unsafe or dangerous ; directing that the structure be repaired or removed and the premises made safe and secure ; fixing a time of 30 days for commencement of work (on or before June 8th, 2022) and 60 days (on or before July 8th, 2022) within which the repair or removal shall be completed; and authorizing staff to proceed with the demolition or repair if the owner(s) fail to comply . Mayor Davis opened the public hearing on Item 4 .lb -Resolution No. 22-8047. Sean Pilcher, Building Official , explained the request , fiscal impact and action options . Ankit Patel , St. Louis , Missouri , current owner of the property, appeared via Zoom . Michele O 'Malley, Mr. Patel 's attorney , Kansas City, Missouri appeared via phone. A lengthy discussion followed related to the property 's ownership history , current status , possible resolution, sale of the property under contract, lack of insurance , licensed contractors, availability of contractors, requirements for securing property and suggested timelines. Mayor Davis closed the public hearing . Moved by Commissioner Hoppock, seconded by Commissioner Lenkiewicz, to approve Resolution No. 22-8047, with amendments , finding that the structure at 244 E. Diamond Dr. is unsafe or dangerous ; directing that the structure be repaired or removed; that premises be made safe and secure within 30 days; a contract be secured with a valid and licensed contractor within 60 days ; commencement of work within 150 days ; completion of repair or removal within 180 days; and authorize staff to proceed with the demolition or repair if the owner(s) fail to comply. Sean Pilcher, Building Official , explained the request , fiscal impact and . action options. A brief discussion ensued related to the inspection and violation process and timeline of demolition . Brian Herrs , Salina, Kansas , shared that his deceased wife had owned the property , he is no longer living there and her children did not want anything to do with the house. John Nelson, 231 W . Prescott, extended his sympathies to Mr. Herrs and shared his concerns about the cats living in the backyard of the house . Dalton McDowell, Salina, Kansas, suggested the Salina Animal Services/Shelter be contacted as it is a no kill shelter. Page 2 .. 22-0124 "' "' Mayor Davis closed the public hearing . Moved by Commissioner Ryan, seconded by Commissioner Longbine , to approve Resolution No . 22-8048 , with amendments , finding that the structure at 615 S. 9th is unsafe or dangerous ; directing that the structure be repaired or removed and the premises made safe and secure ; fixing a time of 60 days for commencement of work (on or before July 8th, 2022) and 90 days (on or before August 8th, 2022) within which the repair or removal shall be completed; and authorizing staff to proceed with the demolition or repair if the owner(s) fail to comply. Sean Pilcher Building Official , explained the request , fiscal impact and action options. A brief discussion followed related to the extent of Salina Regional Health Center 's interest in the property and ideas the owner had for the property that never came to fruition. Mayor Davis closed the public hearing. 22-0125 Moved 'by Commissioner Longbine , seconded by Commissioner Lenkiewicz, to approve Resolution No . 22-8049 , finding that the structure at 619 S. Santa Fe is unsafe or dangerous; directing that the ,. structure be repaired or removed and the premises made safe and secure; fixing a time of 30 days for commencement of work (on or before June 8th, 2022) and 60 days (on or before July 8th, 2022) ... within which the repair or removal shall be completed ; and authorizing staff to proceed with the demolition or repair if the owner(s) fail to comply . The meeting resumed at 5:38 p.m. CONSENT AGENDA (5.1) Approve the minutes of May 2 , 2022. (5.2) Award the bid for project number 22018B, 2022 Minor Concrete -Pavement Repair 2 for $110 ,727.50 with a 5% construction contingency for a total project authorization not to exceed $116 ,263.88 and authorize the City Manager to execute a contract with Lancaster Construction, Inc. of Salina upon fulfillment of all prerequisites under the bid documents. 22-0126 Moved by Commissioner Hoppock , seconded by Commissioner Lenkiewicz, to approve the consent agenda as presented. ADMINISTRATION (6.1) Approve Charter Ordinance No. 41 , on second reading, exempting the City of Salina from the provisions of K.S.A. 13-1024a and providing for substitute and additional provisions on the same subject relating to general improvements and the issuance of bonds for the purpose of paying for said improvements and repealing Charter Ordinance No . 39 . Page 3 "' "' z Cl. w "' .!: ;;; (/) i :2 g c: 8 Mayor Davis stated Charter Ordinance No. 41 was passed on first reading on May 2, 2022; and, since that time, no comments have been received other than by email. Commissioner Longbine expressed his opinion that 4 million was more than what was needed and suggested the amount be lowered to 3 million. Chad Farber, Salina, Kansas, voiced appreciation for Commissioner Longbine's comments and encouraged the Governing Body to at least consider the proposal. Mayor Davis confirmed the 4 million amount would only apply to project category I - baseball/softball. Jon Blanchard, Salina, Kansas, provided his thoughts on the amount to be approved, costs and transient guest tax; and, he asked the Governing Body to consider Commissioner Longbine's argument. A discussion followed related to transient guest tax, ongoing maintenance and costs~ scope of project, drainage issues, lighting, upgrades to facilities and timeline. Commissioner Longbine motioned to approve Charter Ordinance No . 41 with an amendment striking the 4 million amount in project category I and replacing it with 3 r million. There was no second and the motion failed. • 22-0127 Moved by Commissioner Hoppock, seconded by Commissioner Lenkiewicz, to approve Charter Ordinance No. 41, on second reading. A roll call vote was taken. Aye: (4). Nay (1 -Longbine). Motion carried. 22-0128 r .. (6.2) Salina Airport Authority Air Service Update. Tim Rogers, Executive Director of Salina Airport Authority, provided a review and update on Skywest's termination. No action was taken. DEVELOPMENT BUSINESS (7.1) Approve Ordinance No. 22-11112, on first reading, approving an amended PC-5 (Planned Service Commercial) district on a 44 acre tract of land located on the west side of South 9th Street north of Water Well Road. Dean Andrew, Director of Planning, explained the request, fiscal impact and action options. Moved by Commissioner Hoppock, seconded by Commissioner Ryan, to approve Ordinance No. 22-11112 on first reading. Aye: (5). Nay (0). Motion carried. "' "' z "-w "' c: 22-00.29 ~ :g g c: 8 (7.2) Acceptance of the offered easement and restricted access dedications from McArthur Enterprises, Ltd. and the Stephen and Stacey Marshall Trust No. 1 to serve Long- McArthur Addition No. 3 , a 7 lot subdivision of a 44.16 acre tract of land located on the west side of South 9th Street north of Water Well Road. Dean Andrew, Director of Planning, explained the request, fiscal impact and action options. Moved by Commissioner Hoppock, seconded by Commissioner Lenkiewicz, to accept the offered easement and restricted access dedications and authorize the Mayor to sign the plat on behalf of the City. Aye: (5). Nay (0). Motion carried. OTHER BUSINESS Commissioner Hoppock reiterated that Salina Animal Services/Shelter should visit the property located at 615 S . 9th Street to address the cat issue. Commissioner Davis inquired about the selection process for houses to be deemed dangerous structures. It was noted that inspections are performed often times as a result of comments received by concerned citizens or neighbors to initiate said inspection. Commissioner Longbine shared his concerns about the dangers of the pond at Jerry Ivey Park after visiting the park over the weekend. CITIZENS FORUM Norman Mannel, Salina, Kansas, shared his thoughts on the pond at Jerry Ivey Park. Jon Blanchard, Salina, Kansas, provided his opinions about staffing levels at the Salina Police Department, safety of the community and retention study done by the city as well as encourage the Governing Body to schedule a public meeting to address the issues. Chad Farber, Salina, Kansas, restated his belief that the city of Salina is missing a marketing opportunity at Bill Burke Park with so many people attending games. Mr. Farber also shared his concerns about the increasing crime rate in the city and stated a town hall meeting should be scheduled to address the issue. Dalton McDowell, Salina, Kansas, commented on the city 's process of contractor bidding and awarding of contracts for projects.
