Acceptance of expanded public drainage easement dedication on a portion of Lot 1, Block 1 of the
Hageman Addition to the City of Salina, Saline County, Kansas (to serve the USD No. 305 Hageman
Operations Center).
BACKGROUND:
In 2010, USD No. 305 purchased all of the Kroneberger family's remaning land holdings in this area
and combined them with the former Hageman School site to create an 18 acre campus. In July 2011,
USD No. 305 filed a request for PDD zoning to create a USD No. 305 Operations Center Campus on
a single zoning lot.
The Planning Commission met on November 1, 2011 and considered USD No. 305's proposed final
plat of the Hageman Addition. Following presentatoin of the staff report, comments from the School
District's architect and comments and questions from Commission members, the Planning
Commission voted 6-0 to approve a plat creating a single platted lot to serve as a c8mpus for a USD
No. 305 Operations Center subject to certain technical corrections being made to the plat drawing and
the following conditions:
1. Restricted access markings shall be shown along Broadway Boulevard, Hageman Avenue and
Cloud Street except for the Icoatoins of approved driveway openings.
2. The City Engineer shall approve design plans and specifications for the proposed storm water
collection system and the proposed detention pond prior to issuance of a building permit for
Phase I. A detailed drainage analysis shall be prepared and submitted for the northwest corner
of the property (Phase II and III) and the undeveloped six (6) acres along Broadway Boulevard
at the time that final deveopment plans for those areas are reviewed by the Planning
Commission.
3. The Director of Utilities shall approve design plans and specifications for any proposed public
water and sewer line extensions prior to issuance of a building permit for Phase I. The
proposed new fire hydrant will either need to be located within the 20 ft. utility easement shown
on the plat drawing or the easement on the plat will need to be modified to incorporate the fire
hydrant location.
4. An all weather emergency access road and an operational water system must be in place prior
to beginning vertical construction within this subdivision.
At their November 21, 2011 meeting, the City Commission concurred with the action of the Planning
Commission and approved a motion to approve a break in access on Broadway Boulevard to allow a
right in, right out driveway entrance, to accept the offered easement, right-of-way and restricted
access dedications on the Hageman Addition plat and to authorize the Mayor to sign the plat. The City
Commission also gave final approval to an ordinance rezoning this proeprty to a Planned
Development District (PDD).

Construction of Phases I (the maintenance facility) and Phase II (the alternative school) are complete.
Phase III, the USD No. 305 warehouse/storage building at 1855 South Broadway Boulevard is nearing
completion and will soon be requesting a Certificate of Occupancy. The facility contains 12,000 sq. ft.
with a plan for future expansion.
During review of this project, USD No. 305's design engineer (Earles Engineering) determined that the
capacity of the existing detention pond needed to be expanded. Due to the flat terrain and the
elevation of the discharge point on the east, they recommended that the area of the pond be
expanded rather than increasing the depth. The result is that the pond expansion extends beyond the
boundries of the orginal platted drainage easement and the drainage easement needs to be expanded
in addition to the pond. The basin was constructed as a "detention pond" meaning that collected runoff
is detained before being discharged into the City's storm water collection system.
The primary purpose of requiring detention ponds to be located within the public drainage easements
is to insure that they are not converted to other uses without City approval. The expanded drainage
easement has been legally described and executed by the land owner.
FISCAL NOTE:
There would be no fiscal impact to the City if this expanded public drainage easement is accepted.
USD No.305 would remain responsible for all maintenance of the pond.
COMMISSION ACTION OR RECOMMENDED ACTION:
Staff has identified the following options for the Commission's consideration:
Accept the offered drainage easement dedication for the expanded detention basin serving the
USD No. 305 Hageman Operations Center.
2. Decline to accept the offered drainage easement and provide USD No.305 and staff with
further direction.

GRANT OF PERMANENT DRAINAGE EASEMENT
Unified School District No. 305, Saline County, State of Kansas, (the "Grantor"), being the
owner of the hereinafter described real estate located on a portion of Lot 1, Block 1 of the
Hageman Addition to the City of Salina, Saline County, Kansas, does hereby give, grant,
dedicate, and convey unto the City of Salina, Kansas, a municipal corporation, (the "Grantee")
A Permanent Drainage Easement, in perpetuity, on, over, under, and through the real
estate legally described on the attached and incorporated Exhibit A and depicted on the
attached and incorporated Exhibit B for the purposes of:
(a) locating, constructing, excavating, and maintaining storm water detention and
transmission facilities, including a storm water pipeline; and
(b) collecting, detaining and transmitting surface storm water from the USD No. 305
Operations Center and former Hageman School site across the described real
estate.
Grantor acknowledges that this Grant of Permanent Drainage Easement shall neither alter nor
affect the Grantor's obligation to maintain the easement area as set out on the plat of the
Hageman Addition and the easement area shall continue to be maintained in a state of good
repair by the Grantor and Grantor's successors and assigns.
Grantor hereby covenants that it is the lawful owner of the described premises and has the
right, power, and authority to convey the rights granted hereby.
