06-20-1938 Minutes312 COMMISSIONERS ROOM, SALINA, KANSAS. JUNE 200 1938. Regular meeting of the Board of Commissioners June 20, 1938. Meeting was called to order by Mayor Morgenstern, the roll was called and Commissioners Morgenstern, Branson, Ferm. and Mitchell and City Attorney Norris responded. Commissioner Jackson absent. The minutes of the Regular Meeting of June 13, 1938 were read and approved as read. City Engineer submitted Final Estimate of Cost to Alfred Lindgren, General Contractor, for the construction of Well House Buildings Nos. 8 and 9, in Kenwood lark and on Lot 10, Block 11, Oakdale Addition in the City of Salina, Kansas. On motion of Commissioner Branson same was approved by the Board of Commissioners. Motion adopted. An ordinance was introduced entitled: "An ordinance making an appropriation for the payment of certain claims." On motion of Commissioner Branson the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Morgenstern, Branson, Ferm and Mitchell (4) Nays: (0) Commissioner Jackson absent. Mayor approved the ordinance and it is numbered 4878. The following claims to be paid from Relief Highway Fund were presented for payment: The Texas CompanyAsphalt 087.20 Putnam Sand & Bldg. Co. Ashton Supplies 5.11 Blaine Miller, Drugs Supplies 1.35 Consolidated -Salina Crayons 1.00 Superior Welding Mixer Repairs 1.00 Total - - - - - - - - 6 Commissioner Ferm moved that claims be approved by the Board of Commissioners. A resolution was introduced entitled: "A Resolution author- izing the City Manager of Salina, Kansas, to file an application to the United States of America through the Federal Emergency Administra- tion of Public Works for a grant to aid in financing the construction of a City Hall Annex Building to be erected in Salina, 'Saline County, Kansas, and designating Chas. W. Shaver, Architect, Salina, Kansas, to furnish such information as the government may request." On motion of Commissioner Branson the resolution was adopted as read and on its final adoption the roll was called and the follow- ing vote was had; Ayes: Morgenstern, Branson, Ferm and Mitchell (4) Nays: (0) Commissioner Jackson absent. Mayor approved the resolution and it is numbered 726. The above resolution is recorded in full on Page 86, Resolu- tion Book Number 3. A petition was presented asking for the curbing and gutter- ing of Merrill Street from Crawford Avenue to Franklin Street. Re- ferred to the City Engineer. 313 Pursuant to notice published in the aalina Journal bids were received fro the curbing and guttering of: Clark Street from the south line of Walnut Street tot he north line o pruce Street; { Columbia Avenue from the south line of Iron Avenue to the north line of ffypsum venue; Front Street from the north line of Iron Avenue to the south line of AshStreet; Kirwin Avenue from the west line of Santa Fe Avenue to the east line of highland venue; i Seventh Street from the north line of Pacific Street to the south line oT Harshteat; and for the paving of alleylying between Santa Fe Avenue and Fifth Street from the north line alnut 6treet to the south line of Mulberry Street, as follows: H. J. Taylor Construction Company, Salina, Kansas. Johnson Bros. Construction Company, Salina, Kansas. City Engineers estimate of cost for the above named improve- ments was read. Bids were tabulated by the City Engineer, and it appeared that the bids received were higher than the engineers estimate. Commissioner Perm moved that bids be rejected and thAt the certified checks be returned to the bidders, and that no bids having been received for the construction of such work within the Engineers estimate that the work be done and constructed by the City and that the City Engineer be authorized and directed to construct all of the im- provements above provided for, such work to be done within the Engineers estimate, and that the City Engineer be authorized to purchase such materials, equipment, tools and apparatus, and to hire such labor as may be necessary to construct such work. Motion adopted. Information was presented to the Board of Commissiore rs relative to the revocation of 14alt and Cereal Beverage License hereto- fore issued to Richard F. Wiesner as a Gera ral Retailer Class "B".. being License Nol 6321 granted by the Board of Commissiore rs on January 30 1938, under the provisions of Ordinance Number 4741, on account of the alleged violation of said Richard F. Wiesner of certain provisions of said ordinance. Therefore, the following motion was presented: WHEREAS, it appears to the Board of Commissioners that there is cause to believe that the Malt and Cereal Beverage License heretofole issued to Richard F. 'ffiesner as a General Retailer Class "B" under the provisions of Ordinance Number 4741 being License No. 6321, granted to said Richard F. Wiesner by the Board of Commissioners on January 3, 1938, is subject to revocation for the following reason: 1. The sale of Cereal Malt Beverages after twelve o'clock or midnight. NOW THEREFORE, be it moved that said licensee, Richard F. Wiesner, be given five days notice of hearing to be held by the Board of Commissioner of the City of Salina at the regular meeting room of said Board of Commissioners in the City Hall in Salina, Kansas, on June 27, 1938 at 4:30 P. M. for the purpose of determining whether or not said license should be revoked as provided by law and by said Ordinance Number 4741, and that notice of said hearing be served on said Richard F. Wiesner five days before said date by the Chief of Police of Salina, Kansas, by delivering to him a copy of this motion duly certified by the City Clerk. adjourned.
