FEBRUARY 7, 1938.
Regular meeting of the Board of Commissioners February
7, 1938. Meeting was called to order by Mayor Morgenstern, the roll
was called and Commissioners Morgenstern, Branson, Ferm, Jackson and
Mitchell and City Attorney Norris responded.
The minutes of the Regular Meeting of January 31, 1938
were read and approved as read.
An ordinance was introduced entitled: "An ordinance appro-
priating and transfer°ring certain money from the Waterworks Department
Fund to W. P. A. Project Number 6309 Account."
On motion of Commissioner Mitchell the ordinance was read
and a dopted by sections and on its final adoption the roll wascalled
and the following vote was had; Ayes: Iv2orgenstern, Branson, Ferm,
Jackson and Mitchell (5) Nays: (0) Mayor approved the ordinance
and it is numbered 4830.
A resolution was introduced entitled: "A Resolution relat-
ing to issuance of Temporary Note in the amount of $800.00 (WPA
Project No. 6309 Account).
On motion of Commissioner Ferm the resolution was adopted
as read and on its final adoption the roll was called and the following
vote was had• Ayes: Morgenstern, Branson, Ferm, Jackson and Mitchell
(5) Nays: �0) Mayor approved the resolution and it is numbered 718.
The above resolution is recorded in full On Page 78, Reso-
lution Book Number 3.
An ordinance was introduced entitled: "An ordinance making
an appropriation for the payment of certain claims.'
On motion of Commissioner Jackson the ordinance was read
and adopted by sections and on its final adoption the roll was called
and the following vote was had; Ayes: Morgenstern, Branson, Ferm,
Jackson and Mitchell (5) Nays: (0) Mayor approved the ordinance
and it is numbered 4831.
The following claim to be paid from Relief Highway Fund
was presented for payment:
Chas. E. Banker, City Clerk, Cash paid out for labor $166.52
On motion of Commissioner Branson claim was approved by the
Board of Commissioners. Lotion adopted.
An ordinance was introduced entitled: "An ordinance making
an appropriation from the Relief Highway end for the payment of a
certain claim."
On motion of Commissioner Jackson the ordinance was read
and adopted by sections and on its final adoption the roll was called
and the following vote was had; Ayes: Morgenstern, Branson, Ferm,
Mitchell and Jackson (5) Nays: (0) Mayor approved the ordinance
and it is numbered 483,1,.

On motion of Commissioner Jackson applications were approved
by the Board of Commissioners. Motion adopted.
A petition was presented asking for the rezoning of Lot 78, & 71
Ash Street , Original Townsite of Salina, Kansas, from Residential to
Commerical . Sadie was referred to the City Planning Commission.

The City Clerk announced that N. E. Spradley, R. H. Cravens
and J. Earl Wyatt, the Commissioners appointed by the Judge of the
District Court to assess damages and benefits in the matter of the
condemnation and appropriation by the City of Salina, Kansas of
certain private property in the City of Salina, Kansas, for the
purpose of widening certain portions of Olive Street and of the high-
way extending northerly therefrom, in said City, and such street and
highway as extended, to permit the construction thereon of a viaduct or
overpass over and across certain railroad tracks which cross certain
portions of said street and highway, and the same as extended, filed
their report on February 7, 1938, and said report was presented to the
Board of Commissioners by the City Clerk. On motion, report was accepted
by the Board of Commissioners. Motion adopted.
Commissioner Branson moved that negotiable bonds of the City
of Salina be authorized and issued to pay the cost, of acquiring such
lands by condemnation in the sum of y?�42,935.80, for the reason that it
is necessary, and the Board of Commissioners deem it necessary to issue
such bonds to pay such cost. T�Iotion adopted.
An ordinance was introduced for first reading entitled: "An
ordinance providing for and authorizing the issuance of Improvement
Bonds of the City of Salina, Kansas in the sum of $42,935,80 to pay
the cost of acquiring by condemnation and appropriation certain lands
for the purpose of widening certain portions of Olive Street and of the
highway extending northerly therefrom in the City of Salina, Kansas,
said bonds issue to be designated as Series No. C-117." Same was
referred to the Board of Commissioners.
Commissioner Mitchell moved that the City Clerk certify a
copy of the report'of said condemnation Commissioners and deposit such
certified copy with the City Treasurer, and that when the money is on
deposit with the City Treasurer sufficient to pay the property owners
whose lands have been appropriated in the amount due them as shown by
said report, that the City Treasurer certify such fact on the copy of
said report, and that the same then be filed in the office of the Regis-
ter of Deeds of Saline County, Kansas as required by law. Motion
adopted.
An ordinance was introduced for first reading entitled:
"An ordinance dividing the City of Salina into certain wards and voting
precincts Sad defining the boundaries thereof and repealing Ordinance
No. 3314. Same was referred to the Board of Commissioners.
An ordinance was introduced for first reading entitled: "An
ordinance creating and defining certain lateral sanitary sewer districts
in the City of Salina designated as Lateral Sanitary Sewer Districts
No. 17, 158, 175, 176, 177 and 178, providin8 for the construction of
lateral sanitary sewers in such districts and for the cost thereof and
for the levying of special assessments against the property in such dis-
trcits for the payment of such cost, and for the issuing of bonds there-
for.-' Same was referred to the Board of Commissioners.
On motion of Commissioner Jackson the Board of Commissioners
adjourned.
