12-06-1937 Minutes217 COI ,,IISSION-7RS PROCEEDINGS3 REGULAR MEETING. Now Therefore, be it moved that said licenses, H. J. Weightman, be given five days notice of hearing to be held by the Board of Com- missioners of the City of Salina at the regular meeting room of said Board of Commissioners in the City Hall in Salina, Kansas, on December 140 1937 at 4:30 P. M. for the purpose of determining whether or not said license should be revoked as provided by law and by said Ordinance N'o. 4741, and that notice of hearing be served on said H. J. Weightman five days before said date by the Chief of Police of Salina Kansas by delivering to him a copy of this motion duly certified by the City Clerk. Commissioner Mitchell moved the adoption of said motion, which is duly seconded by Commissioner Jackson, and the same is duly carried and adopted by the unanimous vote of all the Commissioners. An ordinance was introduced entitled: "An ordinance making an appropriation for the payment of certain claims." On motion of Commissioner Mitchell the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes : I'IorL-enstern, Branson, Ferm, Jackson a nd Mitchell (5) Nays: (0 Mayor approved the ordinance and it is numbered 4806. The following claim to be paid from Relief. Highway Fund was presented for payment: Chas. E. Banker, City Clerk, Cash paid out for labor $522.47 Commissioner Perm moved that claim be approved by the Board of Commissioners. Motion adopted. An ordinance was introduced entitled: "An ordinance making an appropriation from the Relief Highway Fund for the payment of a certain claim." On motion of Commissioner Jackson the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Yorgenstern, Branson, Fern, Jackson and Mitchell (5) Nays: (0) Mayor approved the ordinance and it is numbered 4807. Yeeting was called to order by Mayor Morgenstern, the roll was called and Commissioners I-Iorgenstern, Branson, Perm, Jackson and Mitchell and City Attorney Norris responded. i The minutes of the Regular Meeting of-Ilovember 29, 1937 were read and approvedd as read. F. C. Branson appeared before the Board of Commissioners and asked permission to construct a canvas sign in front of Townsend Store on %uth Santa Fe Avenue. Commissioner Perm moved that permission be granted by the Board of Commissioners. Motion adopted. Application was made for permission to operate a pop corn stand on West Walnut Street. On motion, permission was granted provided the stand does not extend over 30 inches on sidewalk and license taken out as provided by ordinance. Motion adopted. Information -was presented to the Board of Commissioners relative to the revocation of malt and cereal beverage license hereto- fore issued to H. J. Weightman as a General Retailer Class "B", being License No. 6105, granted by the Board of Commissioners on May 3, 19370 under the provisions of Ordinance No. 4741 on account of alleged ' violation of said H. J. Weightman of certain provisions of said ordi- r_ance. Therefore, the following motion was presented:. WIiEREAS� it appears to the Board of Commissioners that there is cause to believe that the I+Ialt and Cereal Beverage license hereto- fore issued to H. J. Weightman as a General Retailer Class "B" under Ordinance No. 4741, being License 6105, granted to H. J. Weightman by the Board of Commissioners on May 3, 1937, is subject to revocation for e the following, reason: 1. The sale of Cereal Malt Beverates to those under the age of eighteen years. J. Taylor Con- struction Company of Salina, Kansas, for materials furnished and labor performed in the construction of paving improvements on Beloit Avenue from Highland Circle to Funs ton Street; and on Sunset Drive from Per- shing er-shing Street to a line 125 feet west of the west line of Funs ton Street. Commissioner Ferm moved that same be approved by the Board of Cormnissioners. Motion adopted. An ordinance was introduced entitled: "An ordinance making an appropriation,from the Waterworks Fund for the payment of certain claims.11 On motion of Commissioner Mitchell the ordinance was read and adopted by sections and on its final adoption the roll was called �nd the following vote was had; yes: Morgenstern, Branson, Ferm, ackson and Mitchell (5) Nays; 0) Mayor approved the ordinance and it is numbered 4809. - An ordinance was introduced entitled: "An ordinance appro- priating and transferring certain money from the Waterworks Department Fund for the purchase of a Temporary Noteat On motion of Commissioner Ferm the ordinance was read and adopted by sections and on its final adoytion the roll was called and the following vote was had; try@s: orgenstern, Branson, Ferm, Jackson and Mitchell (5) Nays: %0J Mayor approved the ordinance and it is numbered 4810. On motion of Commissioner Jackson, H. L. Brown, City Manager, was authorized to purchase the used Essex car from the Water Department for the sum of $1.00 and other consideration. Motion adopted. An ordinance was introduced for first reading entitled: "An Ordinance providing for the issuance of Refunding Bonds of the City of Salina, Kansas, in the aggregate amount of $70,000.00 for the purpose of refunding certain outstanding bonds of such city in a like amount, to be designated as Series R-115." Ordinance was referred to the Board of Commissioners. An ordinance was introduced for first reading entitled: "An ordinance providing for and authorizing the issuance of negotiable coupon bonds of the City of Salina, Kansas, to be designated as Series J-116, in payment of a certain judgment a;ainst said city in favor of Board of County Commissioners of Saline County, Kansas.'} Ordinance was referred to the Beard of Commissioners.
