COMMISSIONERS PROCEEDINGS, REGULAR MEETING.
COMMISSIONERS ROOM,
SALINA, KANS AS.
JUNE 1, 1936.
Regular meeting of the Board of Commissioners June 1, 1936.
Meeting; was called to order by Mayor Peters, the -roll was called and
Commissioners Peters, Jackosn, Mitchell, Morgenste rn and Surface
and City Attorney Norris responded.
The minutes of the Special Meeting of May 25, 1936 and
Regular Meeting of May 25, 1936 were read and approved as read.
An ordinance was introduced entitled: "An ordinance making
an appropria tion for the payment of certain claims."
On motion of Commissioner Morgenstern the ordinance was
read and adopted by sections and on its final adoption the roll was
called and the following vote was had; Ayes: Peters, Jackson,
Mitchell, Morgenstern and Surface (5) Nays: (0) Mayor approved
the ordinance and it is numbered 4644.
The following claim to be paid from Relief Highway Fund
was presented for payment:
Chas. E. Banker, City Clerk, Cash paid out for labor $231.95
Commissioner Jackson moved that claim be approved by the Board
of Commissioners. Motion adopted.
An ordinance was introduced entitled: "An ordinance making
an appropriation from the Relief Highway Fund for the payment of a
certain claim.'
On motion of Commissioner Mitchell the ordinance was read
and adopted by sections and on its final adoption the roll was called
and the following vote was had; Ayes: Peters, Jackson, Mitchell,
Morgenstern and Surface (5) Nays: (0) Mayor approved the ordinance
and it is numbered 4645.
City Engineer submitted the following report in reference to
the construction of Drainage and Waving Improvements, Job No. 85,
Public Works Administration Docket State File No. 1050-R by the
H J. Taylor Construction Company of Salina, Kansas, under contract
dated October 28, 1935:

Gentlemen:
The construction of drainage and
paving improvements, being Job No, 85, Public
Works Administration Docket State File No.
1050-R by the H. J. Taylor Construction Com-
pany,, United Life Building, Salina, Kansas,
under contract dated October 28, 1935, has
been completed, in accordance with the contract,
plans and specifications providing for the
work.
I hereby approve the work done
under the above contract and recommend the
acceptance of the work, and that the final
estimate due the contractor be allowed.

Commissioner Morgenstern moved that City Engineers report be
filed and the work accepted by the Board of Commissioners. Motion
adopted.

City Engineer submitted Final Estimate to H. J. Taylor
Construction Company of Salina, Kansas, for material furnished and
labor performed in the construction of drainage and paving improve-
ments Public Yorks Administration Docket State file No. 1050-R
under contract dated October 28, 1935, Commissioner Surface moved
that estimate be approved by the Board of Commissioners. Motion
adopted.
An ordinance was introduced entitleds "An ordinance appro-
priating and transferring certain money from the Waterworks Department
Fund to the Drainage and Paving Improvements Construction Account,
Public Works Administration State File No. Kan. 1050 R Account.'
On motion of Commissioner Jackson the ordinance was read
and adopted by sections and on its final adoption the roll was
called and the following vote was had; Ayess Peters, Jackson,
Mitchell, Morgenstern and Surface. (5) Nayss (0) Mayor approved
the ordinance and it is numbered 4646. -
An ordinance was introduced entitled: "An ordinance making
an appropriation from the Drainage and paving Improvements Con-
struction Account Public Works Administration State mile No. Kansas
1050-R Account for the payment of a certain claim."
On motion of Commissioner Surface the ordinance was read
and adopted by sections and on its final adoption the roll was called
and the following vote was had; Ayes: Peters, Jackson, Mitchell,
Morgenstern and Surface (5) Nays: (0) Mayor approved the ordi-
nance and it is numbered 4647.
An ordinance was introduced entitled: "An ordinance appro-
priating and transferring certain money from the Waterworks Department

On motion of Commissioner. Morgenstern the ordinance was
read and adopted by sections and on its final adoption the roll was
called and the following vote was had; Ayes: Peers, Jackson,
Mitchell, Morgenstern and Surface (5) Nays: (0 Mayor approved
the ordinance and it is numbered 4648. ^
City Engineer submitted Estimate No. 3 to Chicago Bridge
and Iron Works for the construction of steel elevated storage tank,
Public Works Administration State R.le No. 1031-R Account, under
contract dated October 28, 1935, Commissioner Surface moved that
estimate be approved by the Board of Commissioners.
An ordinance was introduced entitled: "An ordinance making
an appropriation from the Public Works Administration Docket State
File No. 1031 Account for the payment of a certain claim."
On motion of Commissioner Jackson the ordinance was read and
adopted by sections and on its final adoption the ordinance was
read and adopted by sections and on its final adoption the roll was
called and the following vote was had• Ayes: Peters, Jackson,
Mitchell, Morgenstern and Surface (5� Nays: 0) Mayor approved
the ordinance and it is numbered 4649.
A resolution was introduced entitled: "A Resolution
relating to P. W. A. State File Kan, 1050-R Construction Account."
On motion of Commissioner Morgenstern the resolution was
adopted as read and on its final adoption the roll was called and
the following vote was had; Ayes: Peters, Jackson, Mitchell,
Morgenstern and Surface (5) Nays: (0) Mayor approved the resolu-
tion and it is numbered 661.
The above resolution is recorded in full on Pages numbered
380 and 381, Resolution Book Number 2.
A petition was presente d asking for the construction of a
sanitary sewer in Tenth Street from the center line of Frost Street
to a point 40 feet north of the north line of Republic Avenue.
Commissioner Surface moved that petition be approved by the Board of
Commissioners. Motion adopted.

An ordinance was introduced for first reading entitled: *An
ordinance creating and defining certain lateral sanitary sewer dis-
tricts in the City of Salina designated as Lateral Sewer Districts
No. 172 and 173, providing for the construction of lateral sanitary
sewers in such districts and for the cost thereof and for the levying
of special assessments against the property in such districts for the
payment of such cost, and for the issuing of bonds therefor.' Same
was referred to the Board of Commissioners•
Notice of cancellation of Policy No. K-52378 issued to
Chas. Coffman, d/b/a DeLuxe Cab Company was received from Central
Mutual Auto Insurance Company. On motion same was ordered filed.
Commissioner Surface moved that Taxicab Application
received from Alvin T. Powell and presented to the Board of Commis-
sioners May 25, 1936 be approved. Motion adopted.
Application for taxicab license received from dim. O. Bush.
Commissioner Surface moved that same be approved by the Board of Com-
missioners. Motion adopted.
Commissioner Jackson moved that taxicab drivers applications
received from A. E. Cooper and Alvin T. Powell and presented to the
Board of Commissioners May 25, 1936 be approved. Motion adopted.
The following communication was received from L. Co Housels

Gentlemen:
The Mausoleum Builders Corpora-
tion issued me a deed in 1933 to Companion
Section 4, Row E (two crypts) in Hillcrebt
Memottal Mausoleum, subject to the endowment
of 10% on the listed sellingrice, which in
this cas a is $100.00, check #606 which I
am enclosing.
Mr. Norris'eites an agreement
with the Mausoleum Builders Corporation
whereby 15% of the list price on all spaces
conveyed be paid the city until a deficiency
of $4988.25 in the endowment fund be made up.
These crypts were conveyed to me account money
advanced involuntarily, it is true, to the
corporation prior to the completion of the
mausoleum. To attempt to make me responsible
for the debt of the corpora tion on old en-
dowment would be manifestly unjust and also in
all other cases where creditors take title
to crypt space in order to reduce the corpo-
ration's indebtedness .
The City has ample crypt security
for the endowment fund. The corporation
still owes me more than a thousand dollars.
What we both want is a sale of crypt space so
that what is owing us is cleaned up. I have
written Mr. Bond asking that he come and put
on a selling campaign# because present crop
prospects have made such a campaign promise

Commissioner Surface moved that the City Attorney notify Mr.
Housel that the City demands the 25% as per agreement.
Board of Education asked permission to use a portion of City
Park for use of a building to be moved in on said ground. Commisslon-
er Surface moved that the matter be referred to the City Manager.
On motion of Commissioner Surface the oa d of Commissioners
adjourned.
