ORDINANCE NUMBER 86-9134
AN ORDINANCE PROVIDING FOR THE VACATION OF A CERTAIN
BORROW EASEMENT ON SOUTH NINTH STREET IN NW4SW4 SECTION 36,
TOWNSHIP 14 SOUTH, RANGE 3 WEST OF THE 6TH PRINCIPAL MERIDIAN IN
THE CITY OF SALINA, SALINE COUNTY, KANSAS.
Kansas:
BE IT ORDAINED by the Governing body of the City of Salina,
Section I. That a portion of a certain borrow easement in the City of
Salina, Saline County, Kansas, described as follows:
A tract of land in the Northwest Quarter of the Southwest
Quarter (NW4SW4) of Section Thirty-six (36), Township
Fourteen (14) South, Range Three (3) West of the Sixth
Principal Meridian in Saline County, Kansas, more
particularly described as follows:
Beginning
at the intersection of the East
right-of-way line of the existing highway and the
South line
of the Northwest Quarter of the
Southwest
Quarter (NW4SW4) of said Section
Thirty-six
(36), said point being one hundred two
and seven
tenths feet (102.71) East of the
southwest corner of said Northwest Quarter of the
Southwest
Quarter ( NW4SW4) ; thence Northerly
along said
East right-of-way line a distance of
seven hundred ninety-two feet (792.01) to a point
ninety-nine
and six tenths feet (99.61) East of the
West line
of said Northwest Quarter of the
Southwest Quarter ( NW4SW4) ; thence East at right
angles to said right-of-way, a distance of ninety
feet (90.01);
thence Southerly parallel with said
East right-of-way line to the South line of said
Northwest
Quarter of the Southwest Quarter
(NW4SW4);
thence West along said South line a
distance of
ninety feet (90.01) back to the point of
beginning.
Said tract contains 1.64 acres, more
or less.
Section 2. That the above described borrow easement, which is
vacated by this ordinance, shall revert to the adjacent property owners in
accordance with K.S.A. 13-443.
Section 3. That this ordinance shall be in full force and effect from
and after its adoption and publication once in the official city newspaper.
