88-9280 Vacate Parkwood Village(Published in The Salina Journal October),/, 1988) ORDINANCE NUMBER 88-9280 AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF A CERTAIN FRONTAGE ROAD IN PARKWOOD VILLAGE ADDITION TO THE CITY OF SALINA, SALINE COUNTY, KANSAS. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. There is hereby vacated, subject to the conditions specified in Section 2 below, a portion of the Fifty (50) foot frontage road between the South line of Cloud Street and the North line of Lot 1 , Block 1 , Parkwood Village Addition, which is adjacent to the East 154.5 feet of said Lot One (1), and is more particularly described as follows: Beginning at the northeast corner of said Lot 1 ; Thence west along the north line of said Lot 1 a distance of 154.5 feet; Thence north a distance of 50 feet to the south right-of-way line of Cloud Street; Thence east along the south right-of-way line of Cloud Street a distance of 154.5 feet; Thence south a distance of 50 feet back to the point of beginning. The above described vacated frontage road right-of-way contains 7,725 square feet, more or less. Section 2. The vacation of frontage road right-of-way granted in Section 1 is subject to the following conditions which shall be satisfied prior to second reading of this ordinance: (a) The petitioner construct a thirty-three (33) foot back to back street intersection, including storm sewer additions and modifications at the location shown on the attached drawing. All construction shall be in accordance with criteria established by the City Engineer. (b) The petitioner shall also install a standard traffic barrier at the west end of the vacated street right-of-way at the location established by the City Engineer. Section 3. The above described frontage road right-of-way shall be reserved by the City of Salina as a public utility easement. Section 4. That the above described frontage road right-of-way which is vacated by this ordinance, shall revert to the adjacent property owners in accordance with K.S.A. 13-443. Section 5. This ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
