ORDINANCE NUMBER 88-9279
AN ORDINANCE PROVIDING FOR THE VACATION OF ROADWAY
EASEMENT ON THE EAST FIFTY (50) FEET OF LOTS ONE (1) AND NINE (9),
BLOCK C, PARK WEST ADDITION TO THE CITY OF SALINA, SALINE COUNTY,
KANSAS, AND FOR A BREAK IN THE RESTRICTED ACCESS CONTROL ON THE
WEST SIDE OF BROADWAY BOULEVARD.
Kansas:
BE IT ORDAINED by the Governing Body of the City of Salina,
Section 1. That the roadway easement on the East Fifty (50) feet of
Lots One (1) and Nine (9) , Block C, Park West Addition to the City of Salina,
Saline County, Kansas, is hereby vacated.
Section 2. That the above described roadway easement which is
vacated by this ordinance, shall revert to the adjacent property owners in
accordance with K.S.A. 13-443.
Section 3. That a break in the restricted access control on the west
side of Broadway Boulevard be granted to the petitioner, Falgers, Inc., subject
to the following conditions:
(a) The petitioner construct a ten (10) foot wide
deceleration land and acceleration lane (approximately
two hundred fifty (250) feet total length) on the west
side of Broadway Boulevard at the proposed driveway
location in accordance with the criteria established by
the City Engineer.
(b) No break in the raised median on Broadway be
permitted between Armory Road and Avalon Drive
(vacated).
(c) The thirty (30) foot break in the restricted access
control on the west side of Broadway Boulevard be
located approximately two hundred five (205) feet south
of the centerline of Avalon Drive (vacated).
(d) No "Certificate of Occupancy" be granted for any
building on said Lots One (1) and Nine (9) , Block C,
Park West Addition to the City of Salina, Saline
County, Kansas until all construction work has been
completed on the deceleration and acceleration lanes in
accordance with criteria established by the City
Engineer.
Section 4. This ordinance shall be in full force and effect from and
after its adoption and publication once in the official city newspaper.
