96-5009 Agr Exchange Propertyco�saoaa�ea-Sarna (Published in The Salina Journal May IS & ?3, 1996) RESOLUTION NUMBER 96-5009 A RESOLUTION DETERMINING THAT CERTAIN REAL ESTATE IS NO LONGER NEEDED BY THE CITY OF SALINA FOR PARK PURPOSES AND THAT THE SALE OF THE PROPERTY THEREOF WOULD BE IN THE BEST INTEREST OF THE CITY. WHEREAS, a shortage exists within the City of Salina of single-family homes affordable to low -to -moderate income families; and WHEREAS, the subject area is highly suitable for development of such housing; and WHEREAS, adequate land area will remain or be obtained to meet the park and open space needs of the surrounding area. SO, NOW THEREFORE, BE IT RESOLVED by the Governing Body of the City of Salina, Kansas: Section 1. That it is hereby determined that the following described real estate is no longer needed or required for park purposes by the City of Salina, Kansas: A tract of land located in Reserve A of the Fox Run Addition to the City of Salina in the Southeast Quarter of the Northwest Quarter of Section 2, Township 15, Range 3 West of the Sixth Principal Meridian in Saline County Kansas, described as follows: Beginning at the Southeast corner of said Southeast Quarter of the Northwest Quarter, thence on an assumed bearing of North 89 degrees 49 minutes 22 seconds West, along the south line of said Southeast Quarter, a distance of 155.00 feet, to a nontangent curve bearing to the right with a chord bearing of North 17 degrees 45 minutes 59 seconds East, and radius of 795.00 feet and central angle of 7 degrees 12 minutes 25 seconds; thence Northerly along said curve an arc distance of 492.08 feet to a tangent line; thence North 35 degrees 29 minutes 54 seconds East, a distance of 14.71 feet, to a point on the east line of said Southeast Quarter of said Northwest Quarter; thence South 00 degrees 09 minutes 28 seconds West, along the east line of said Southeast Quarter of the Northwest Quarter, a distance of 476.62 feet, to the point of beginning. Said tract of land contains 50, 043.32 square feet, or 1.15 acres, more or less. Said tract of land is subject to all easements and right of ways of record. And A tract of land located in Reserve A of the Fox Run Addition to the City of Salina, in the Southeast Quarter of the Northwest Quarter of Section 2, Township 15, Range 3 West of the 6th Principal Meridian in Saline County, Kansas, described as follows: Beginning at the Southeast corner of said Southeast Quarter of the Northwest Quarter, thence on an assumed bearing of North 00 degrees 09 minutes 28 seconds East, along the east line of said Southeast Quarter, a distance of 586.68 feet, to the point of beginning; thence North 54 degrees 30 minutes 06 seconds West, a distance of 45.60 feet; thence North 35 degrees 29 minutes 54 seconds East, a distance of 64.30 feet, to a point on the east line of said Southeast Quarter of the Northwest Quarter; thence South 00 degrees 09 minutes 28 seconds West, along said East line, a distance of 78.83 feet, to the point of beginning. Said tract of land contains 1466.02 square feet, Con,Odyd Sal , or 0.03 acres, more or less. Said tract of land is subject to all easements and right of ways of record. Section 2. That it would be in the best interest of the City of Salina, Kansas, that the above described land be sold or exchanged. Section 3. That if within thirty (30) days from the date of the last publication of this resolution there has not been filed with the City Clerk a protest signed by the qualified electors of the City of Salina equal in number to not less than ten percent (10%) of the electors who voted in the last preceding regular city election as shown by the poll books, then the City of Salina will proceed to sell or exchange said property. Section 4. That this Resolution shall be in full force and effect from and after its publication twice in the official city newspaper.
