88-9275 Est Recreation Divisionnn -Cox Priming — Sarna K11-1 (First Published in The Salina Journal August �-6, 1988) ORDINANCE NUMBER 88-9275 AN ORDINANCE AUTHORIZING AN AGREEMENT WITH THE BOARD OF EDUCATION OF UNIFIED SCHOOL DISTRICT #305 AND THE SALINA RECREATION COMMISSION TO TERMINATE THE SALINA RECREATION COMMISSION AND TO ESTABLISH A RECREATION DIVISION WITHIN AN EXISTING DEPARTMENT OF THE CITY PURSUANT TO K.S.A. 12-1933. BE IT ORDAINED by the Governing Body of the City of Salina, Section 1. Policy statement. It is the desire of the governing body to enter an agreement with the Board of Education of Unified School District #305 ( "the School Board") and the Salina Recreation Commission ("the Recreation Commission") to terminate the Recreation Commission and to establish a recreation division within an existing department of the City, all pursuant to K.S.A. Section 2. Authorization of agreement. The Mayor is hereby authorized to execute and the City Clerk to attest an agreement with the School Board and the Recreation Commission, which agreement shall provide for: a. Termination of the existing Interlocal Agreement between the City and the School Board dated January 2, 1980. b. Termination of the Recreation Commission. Establishment of a Recreation Division within the City department to be known as the Department of Parks and Recreation. Establishment of a Park and Recreation Advisory Board. Transfer of the current operating fund of or budgeted for the recreation system under the Recreation Commission to the credit of the combined City Parks and Recreation Department, to be maintained in an individual fund and used for the purpose for which levied. Authorization of annual tax levy upon all taxable tangible property of the city for recreation purposes in such amount and in such manner as provided under K.S.A. 12-1933. g. Transfer of any property currently owned by the Recreation Commission to the City. h. Use of School Board property for recreation purposes. i. Employment of current employees of the Recreation Commission as employees of the City. Section 3. Publication of ordinance. This ordinance shall be published once each week for two consecutive weeks in The Salina Journal, the official city newspaper. Section 4. Effective date. This ordinance is adopted pursuant to K.S.A. 12-1933 and shall take effect thirty (30) days after final publication unless a petition signed by at least 5% of the qualified voters of the City requesting an election on the question is filed and an election held on the ordinance as provided in K.S.A. 12-1933, in which case this ordinance shall become effective if approved by a majority of the electors voting thereon.
