ORDINANCE NUMBER 88-9257
AN ORDINANCE LEVYING SPECIAL ASSESSMENTS ON LOTS, PIECES,
AND PARCELS OF GROUND IN THE CITY OF SALINA, KANSAS FOR THE
PURPOSE OF PAYING A PORTION OF THE COST OF:
Curbing, guttering, paving and grading of HAGEMAN
AVENUE from the north line of Saturn Avenue to the south
line of Jupiter Avenue.
Curbing, guttering, paving and grading of SATURN AVENUE
from the east line of Hageman Avenue to the west line of
Tulane Avenue.
Water main and services for certain lots.
Wheatridge Addition
Curbing, guttering, paving, grading FOXBORO DRIVE from
the north line of Schilling Road to the north line of
Wheatridge Addition.
Twin Oaks II Subdivision
Curbing, guttering, paving, grading of OAKLAWN LANE
from Plantation Drive to the existing pavement at the west
line of Lot 1 , Block 2, Twin Oaks I I Subdivision.
Curbing, guttering, paving, grading of POST OAK LANE
from Carolina Drive to the existing pavement at the west line
of Lot 5, Block 1 , Twin Oaks I I Subdivision.
Curbing, guttering, paving, grading PLANTATION DRIVE
from Post Oak Lane to the cul-de-sac bordering the south
line of Lot 6, Block 2, Twin Oaks II Subdivision.
Curbing, guttering, paving, grading CAROLINA DRIVE from
Post Oak Lane to Burr Oak Lane.
Curbing, guttering, paving, grading BURR OAK LANE from
Carolina Drive to the existing pavement at a point
approximately 69 feet east of the southwest corner of Lot 9,
Block 7, Twin Oaks II Subdivision.
The installation of a storm drainage pipe beginning at the
west line of Plantation Drive opposite the southwest corner
of Lot 11, Block 2, Twin Oaks 11 Subdivision; thence
running east across Plantation Drive, along the south line of
Lots 11 and 26, Block 2, across Carolina Drive, and along
the south line of Oak Lane to the east side of Tara Lane;
thence running north along the east line of Tara Lane to the
north line of Lot 2, Block 5; thence running east along the
north line of Lots 2 and 7, Block 5, across vacated Redbud
Lane and Lot 1 , Block 6 to the existing drainage ditch at
the east side of Lot 1 , Block 6, Twin Oaks 11 Subdivision.
The installation of a storm drainage pipe in Burr Oak Lane
beginning at the intersection of Burr Oak Lane and Carolina
Drive; thence running east in Burr Oak Lane to the existing
storm drainage pipe located approximately 57 feet east of the
southwest corner of Lot 10, Block 7, Twin Oaks II
Subdivision.

The installation of a 6" C.I.P. water main in Post Oak Lane
by connecting to an existing water main located at the
northeast corner of Bret Avenue and Post Oak Lane; thence
running east along the north line of Post Oak Lane to the
east line of Carolina Drive; thence running north along the
east line of Carolina Drive to the south line of Burr Oak
Lane; thence running east along the south line of Burr Oak
Lane and connecting to an existing water main at the
northeast corner of Lot 2, Block 8, Twin Oaks II
Subdivision.
The installation of a 6" C.I.P. water main in Oaklawn Lane
by connecting to an existing water main at the northeast
corner of Bret Avenue and Oaklawn Lane; thence running
east in Oaklawn Lane to Plantation Drive; thence south in

grading of the north -south utility easement at the rear of
Blocks 3 and 7 to provide drainage to the inlet at the
southwest corner of Lot 10, Block 3.

located approximately 35 feet south of the north line of Lot
6, Block 33, Key Acres 2nd Addition; thence running south
along the west line of Highland Avenue to a point which is
approximately 75 feet south of the north linee of Lot 15,
Block 33, Key Acres 2nd Addition.

from the existing pavement of Applewood Road to Village
Lane.
The installation of a 6" C.I.P. water main and services in
Village Lane by connecting to an existing water main located
at the northwest corner of Village Lane and Fairdale Road;
thence running west along the north line of Village Lane to
the cul-de-sac bordering the east line of Lot 23, Block 1,
Georgetown Addition.
The installation of a 6" C.I.P. water main and services in
Beechwood Road by connecting to an existing water main
located at the southeast corner of Applewood Lane and
Beechwood Road; thence running in a southwesterly direction
to the west line of Beechwood Road; thence running south to
the southwest corner of Village Lane and Beechwood Road.

and such contracts have been duly performed, and
WHEREAS, the Board of Commissioners has determined that the total
cost of such improvements is Six Hundred Fifty-three Thousand Twenty-eight
and 27/100 Dollars ($653,028.27) and that 96.79 percent in the amount of Six
Hundred Thirty-two Thousand Ninety-three and 10/100 dollars (632,093.10) be
assessed against the improvement district and that 3.21 percent in the amount of
Twenty Thousand Nine Hundred Thirty-five and 17/100 dollars ($20,935.17) be
assessed against the city -at -large
WHEREAS, the Board of Commissioners has, after due notice, met and
determined the amount of special assessments, SO NOW, THEREFORE
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. That special assessments to pay the cost of such
improvements, with accrued interest, be and the same are hereby levied against
the several lots, pieces and parcels of land liable for special assessments for
said improvements as follows:

Section 2. Said amounts so levied, apportioned and assessed as
aforesaid will be due and collectible in ten equal installments, the first becoming
due with the taxes levied for the year 1988, and one of said installments falling
due each and every year thereafter until all are paid and all to be collected with
interest as in this ordinance provided, HOWEVER, that the owner of any piece
or parcel of property liable for any such assessments may redeem his property
from such liability by paying to the City Treasurer the entire amount chargeable
against the same, as in this ordinance provided, at any time within thirty days
after the publication of this ordnance and before the issuance of bonds of said
City in payment of the balance of the cost of said improvements, the property so
paid on shall not thereafter be liable for any further assessments for the cost of
said improvements, nor for any part of said bonds.
Section 3. There is hereby levied further and assessed against such
lots and pieces of ground described in this ordinance, interest at such rate per
annum as shall be borne by bonds hereafter to be issued for the payment of the
remaining unpaid cost of such improvements to be hereafter determined and fixed
by ordinance, when such bonds are issued on all of said installments mentioned
and provided for in this ordinance, from the date of the bonds which may be
issued at the end of thirty days as specified in the preceding section hereof,
as by law provided, to the time of the collection of the installments as provided
by law, which said interest shall be collected and after the taking effect of this
ordinance and the fixing of said interest rate when such bonds are authorized
and issued, however such interest rate shall not exceed 12 percent per annum,
it shall be the duty of the City Clerk of said City to annually, at the same time
other taxes are certified, and until all of said assessments so apportioned and
levied have been certified to the County Clerk of Saline County, Kansas, certify
a full list of all property liable to assessment and taxation for such work and
improvements, except such property on which the special assessments aforesaid
have been paid in full, as hereinbefore provided, together with the respective
amounts due on each of said lots and pieces of ground, which amounts shall
include the annual installments on special assessments together with the interest
for one year at the rate to be fixed as provided for in this ordinance, on all
unpaid balances of such assessments, such amounts so certified as herein
provided shall be placed upon the tax roll by the County Clerk of Saline
County, Kansas, and collected as other taxes are collected.
