ORDINANCE NUMBER 88-9229
AN ORDINANCE APPROVING AND AUTHORIZING THE MAYOR TO
EXECUTE AN INTERLOCAL AGREEMENT BY AND BETWEEN THE BOARD OF
COUNTY COMMISSIONERS OF SALINE COUNTY, KANSAS, AND THE BOARD OF
CITY COMMISSIONERS OF THE CITY OF SALINA, KANSAS, FOR COOPERATION
AND COORDINATION IN THE APPROVAL OF SUBDIVISION PLATS WITHIN
THREE (3) MILES OF THE SALINA CITY LIMITS.
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. In recognition of the need for cooperation and coordination
between Saline County and City of Salina in order to insure orderly development
of Salina's urban fringe and the need for joint review and approval of proposed
subdivision plats located within the City's future growth patten, the Governing
Body approves and the Mayor is hereby authorized to execute the Interlocal
Agreement Between Saline County, Kansas, and the City of Salina, Kansas, for
Cooperation and Coordination in the Approval of Subdivision Plats Within Three
Miles of the Salina City Limits (the "Interlocal Agreement").
Section 2. Upon approval and execution of the Interlocal Agreement
by the Board of County Commissioners the City Attorney is hereby authorized
and directed to submit the Interlocal Agreement for approval by the Attorney
General
pursuant to K.S.A.
12-2904. Upon notification of approval
of the
Interlocal
Agreement by the
Attorney General, the City Clerk is
hereby
authorized
and directed to file
the Interlocal Agreement with the Saline
County
Register
of Deeds and with
the Secretary of State as required by
K.S.A.
12-2905,
upon which the Interlocal Agreement shall enter into force.
Section 3. No less than three (3) copies of the Interlocal Agreement
shall be kept on file in the Office of the City Clerk for examination by the
public during normal business hours.
Section 4. Upon its entry into force, the Interlocal Agreement shall
take precedence over any conflicting provisions contained in existing ordinance,
rule, regulation or procedure regarding approval of subdivision plats within
three miles of the Salina City Limits.
Section 5. This ordinance shall be in full force and effect after its
adoption by the Board of Commissioners and publication once in the official city
newspaper.
