ORDINANCE NUMBER 89-9359
AN ORDINANCE AFFIRMING THE INTENT OF THE CITY OF SALINA,
KANSAS, TO CONSTRUCT CERTAIN STORM WATER DRAINS AND SEWERS AND
TO FINANCE SUCH CONSTRUCTION THROUGH THE ISSUANCE OF GENERAL
OBLIGATION BONDS OF SAID CITY.
WHEREAS, storm water does not drain rapidly in the area of Salina,
Kansas (the "City"), generally located on Second Street between Crawford Street
and the Smoky Hill River at Second and Prescott Streets; and
WHEREAS, the construction of new storm water drains and sewers in
such area would help to alleviate such problem; and
WHEREAS, the Governing Body of the City of Salina has previously
determined it is necessary to construct such storm water drains and sewers in
such area and has directed that such storm water drains and sewers be
constructed; and
WHEREAS, the construction of such storm water drains and sewers is
relatively large as compared with the estimated cost of lateral sewers or drains
tributary to such storm water drains and sewers; SO NOW, THEREFORE
Kansas:
BE IT ORDAINED by the Governing Body of the City of Salina,
Section 1. That the Governing Body hereby reaffirms and restates its
previously stated intent to construct storm water drains and sewers on Second
Street between Crawford Street and the Smoky Hill River at Second and Prescott
Streets, (the "Project") pursuant to the provisions of K.S.A. 12-631r and
12-631s.
Section 2. In accordance with the provisions of K.S.A. 12-619 and
12-631w, the Governing Body of the City hereby determines that the cost of the
Project shall be borne by the City as a whole and paid by the issuance of
general obligation bonds of the City as provided in K.S.A. 12-619, 12-624 and
12-631 w.
Section 3. Pending the issuance of such general obligation bonds, the
City shall issue its temporary notes to finance the Project pursuant to the
provisions of K.S.A. 10-123.
Section 4. That this ordinance shall be in full force and effect from
and after its adoption and publication once in the official city newspaper.
