89-9350 Vacate Fifth Street(Published in The Salina Journal November ly, 1989) ORDINANCE NUMBER 89-9350 Section 1. That a portion of Fifth Street, a public street in the West Half of the Southwest Quarter (WiSW4) of Section 36, Township 13 South, Range 3 West of the Sixth Principal Meridian in Saline County, Kansas, more particularly described as follows: Beginning at the South right-of-way line of Interstate 70 Highway, where the highway crosses Fifth Street; thence South on Fifth Street, a distance of nine hundred (900) feet and terminating approximately seventy (70) feet south of the south end of Mulberry Creek Bridge. This includes the existing roadway rights-of-way as shown in the County Road Records in the Kansas Highway Commission Plans of 1919, under Federal Aid Project #44; be and the same is hereby vacated; provided, however, the City retains the vacated street as a utility easement. Section 2. That the vacated Fifth Street, vacated by this ordinance, shall revert to the adjacent property owners in accordance with K.S.A. 13-443. Section 3. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
