ORDINANCE NUMBER 89-9324
AN ORDINANCE LEVYING SPECIAL ASSESSMENTS ON LOTS, PIECES
AND PARCELS OF GROUND IN THE CITY OF SALINA, KANSAS FOR THE
PURPOSE OF PAYING A PORTION OF THE COST OF:
Trockenbach Addition
Curbing, guttering, paving, grading THIRTEENTH STREET
from the north line of Woodland Avenue to the south line of
Pacific Avenue.
The installation of 6" C.I.P. water main in Thirteenth Street
by connecting to an existing water main located on Pacific
Avenue; thence running south to the south line of Pacific
Avenue; thence running west to the west line of Thirteenth
Street; thence running south along the west line of
Thirteenth Street and connecting to an existing water main
located at the northwest corner of Woodland Avenue and
Thirteenth Street.
EASTRIDGE ACRES PLANNED DEVELOPMENT DISTRICT
The installation of a 6" C.I.P. water main in Barlow Drive
by connecting to an existing water main located at the
southwest corner of Tract Seven (7) , Block Three (3) ,
Eastridge Acres Planned Development District; thence
running east along the north line of Barlow Drive and north
along the west line of Barlow Drive to the cul-de-sac at the
southwest corner of Tract Nine (9) , Block Three (3) ,
Eastridge Acres Planned Development District, in the City of
Salina, Saline County, Kansas.

MAYFAIR ADDITION
The curbing, guttering, paving and grading of SHALIMAR
DRIVE from the north line of Oxford Drive to the existing
pavement at the south line of Lot Six (6) , Block Three (3) ,
Mayfair Addition to the City of Salina, Saline County,
Kansas.
The curbing, guttering, paving and grading of BENTLEY
AVENUE from Shalimar Drive to the cul-de-sac in Block
Three (3), Mayfair Addition to the City of Salina, Saline
County, Kansas.

by connecting to an existing water main located at the
southwest corner of Shalimar Drive and Bentley Avenue;

side of Lot One (1) , Block Four (4) , Mayfair Addition.

OFF-SITE WATER MAIN IMPROVEMENTS
In order to allow additional water taps on the existing 8"
C.I.P. water main on Marymount Road between Crawford
Street and Cloud Street, certain off-site water main
improvements must be accomplished to increase the water
flow capability of the Marymount Road water main. At the
request of several property owners desiring water taps along
Marymount Road, it has been determined that eight (8)
additional 1" water taps could be made in this area, without
decreasing the existing capacity of existing 8" C.I.P. on
Marymount Road, if a connecting section of water main was
installed on Fairdale Road between Crawford Street and
Country Hills Road as an off-site improvement.
MEYER ADDITION
The curbing, guttering, paving and grading of MARTIN
AVENUE from the east line of Manchester Road to the west
line of Meyer Drive.
The installation of a storm drainage pipe in Martin Avenue
beginning at a point near the center of Lot Fifteen (15),
Block Four (4), Meyer Addition; thence running east in
Martin Avenue to an existing storm sewer manhole near the
west line of Meyer Drive.
The installation of 1" water service lines for Lots Fourteen
(14), Fifteen (15), Sixteen (16), Seventeen (17), Eighteen
(18), Nineteen (19), Twenty (20), Twenty-one (21), Block
Four (4) , Meyer Addition, and
The installation of 1" water service lines for Lots Three (3),
Four (4) , Five (5) , Six (6) , Seven (7) , Eight (8) , Nine
(9), Ten (10), Block Five (5), Meyer Addition by connecting
to the existing 6" C.I.P. water main along the north line of
Martin Avenue.
COUNTRY CLUB HEIGHTS ADDITION NUMBER 5
The curbing, guttering, paving and grading of SEITZ DRIVE
from the north line of Glen Avenue to the north line of
Country Club Heights Addition Number 5 in the City of
Salina, Saline County, Kansas.
The installation of a 6" water main and 1" water service lines
to serve Lots Eleven (11), Twelve (12), Thirteen (13),
Block Three (3); Lots Thirteen (13), Fourteen (14), Fifteen
(15), Block Five (5); Lots One (1), Two (2), Three (3),
Four (4), Five (5), Six (6), Seven (7), Block Six (6), all
in Country Club Heights Addition Number Five (5) to the
City of Salina, Saline County, Kansas.
The installation of 4" sanitary sewer service lines to serve
Lots Eleven (11), Twelve (12), Thirteen (13), Block Three
(3); Lots Thirteen (13), Fourteen (14), Fifteen (15), Block
Five (5); Lots One (1), Two (2), Three (3), Four (4), Five
(5), Six (6), Seven (7), Block Six (6), all in Country Club
Heights Addition Number Five (5) to the City of Salina,
Saline County, Kansas.
As authorized by Resolution Number 88-3980, adopted by the
Board of Commissioners on the 13th day of June, 1988.

WHEREAS, pursuant to proceedings regularly had according to law,
contracts have been let for the following improvements in the City of
Salina, Saline County, Kansas.
Trockenbach Addition
Curbing, guttering, paving, grading THIRTEENTH STREET

WHEREAS, the Board of Commissioners has determined that the total
cost of such improvements is Three Hundred Sixty-two Thousand Seven Hundred
Fifty-five and 36/100 Dollars ($362,755.36) and that 99.8086 percent in the
amount of Three Hundred Sixty-two Thousand Sixty-one and 17/100 dollars
($362,061.17) be assessed against the improvement district and that .1914
percent in the amount of Six Hundred Ninety-four and 19/100 dollars ($694.19)
be assessed against the city -at -large
WHEREAS, the Board of Commissioners has, after due notice, met and
determined the amount of special assessments, SO NOW, THEREFORE
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. That special assessments to pay the cost of such
improvements, with accrued interest, be and the same are hereby levied against
the several lots, pieces and parcels of land liable for special assessments for
said improvements as follows:

Section 2. Said amounts so levied, apportioned and assessed as
aforesaid will be due and collectible in ten equal installments, the first becoming
due with the taxes levied for the year 1989, and one of said installments falling
due each and every year thereafter until all are paid and all to be collected with
interest as in this ordinance provided, HOWEVER, that the owner of any piece
or parcel of property liable for any such assessments may redeem his property
from such liability by paying to the City Treasurer the entire amount chargeable
against the same, as in this ordinance provided, at any time within thirty days
after the publication of this ordnance and before the issuance of bonds of said
City in payment of the balance of the cost of said improvements, the property so
paid on shall not thereafter be liable for any further assessments for the cost of
said improvements, nor for any part of said bonds.
Section 3. There is hereby levied further and assessed against such
lots and pieces of ground described in this ordinance, interest at such rate per
annum as shall be borne by bonds hereafter to be issued for the payment of the
remaining unpaid cost of such improvements to be hereafter determined and fixed
by ordinance, when such bonds are issued on all of said installments mentioned
and provided for in this ordinance, from the date of the bonds which may be
issued at the end of thirty days as specified in the preceding section hereof,
as by law provided, to the time of the collection of the installments as provided
by law, which said interest shall be collected and after the taking effect of this
ordinance and the fixing of said interest rate when such bonds are authorized
and issued, however such interest rate shall not exceed 12 percent per annum,
it shall be the duty of the City Clerk of said City to annually, at the same time
other taxes are certified, and until all of said assessments so apportioned and
levied have been certified to the County Clerk of Saline County, Kansas, certify
a full list of all property liable to assessment and taxation for such work and
improvements, except such property on which the special assessments aforesaid
have been paid in full, as hereinbefore provided, together with the respective
amounts due on each of said lots and pieces of ground, which amounts shall
include the annual installments on special assessments together with the interest
for one year at the rate to be fixed as provided for in this ordinance, on all
unpaid balances of such assessments, such amounts so certified as herein
provided shall be placed upon the tax roll by the County Clerk of Saline
County, Kansas, and collected as other taxes are collected.
