89-9322 Zone Georgetown AddK�ihn-Coy 1 1 1 (Published in The Salina Journal June 1989) ORDINANCE NUMBER 89-9322 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, and SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT "PDD." PLANNED DEVELOPMENT DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: Lot 7 less the North 17 feet thereof, and less the following described tract: Beginning at the southwest corner of Block 5; Thence East along the south property line, 220 feet; Thence North 160 feet along a line parallel with the East property line; Thence West 138 feet along a line parallel with the north property line; Thence at an angle of Thirty-nine degrees (391) Northwest 74.38 feet; Thence West 12.31 feet to the west property line; Thence South along the west property line 207.41 feet to the point of beginning, all in Block 5, in the Replat of Blocks 4, 10, 11 and 12, Georgetown Addition to the City of Salina, Saline County, Kansas. shall become a part of District "PDD." PLANNED DEVELOPMENT DISTRICT. That the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the PLANNED DEVELOPMENT DISTRICT. That the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code, with reference to PLANNED DEVELOPMENT DISTRICTS. 1. Development shall be in accordance with the approved preliminary development plan, incorporated herein by reference. 2. A final site development plan shall be filed within Three (3) years. 3. The revised, final development plan shall be prepared and stamped by a registered architect, engineer or land surveyor. 4. The applicant shall submit a recorded easement or some other guaranteed right -of -access across the adjoining lots to the north to allow access to the 8" sewer line, prior to issuance of a building permit. 5. The applicant shall submit a grading plan, satisfactory to the City Engineer, showing that runoff from the site will flow toward existing storm sewers in Georgetown Road and Crawford Street, prior to issuance of a building permit. 6. The applicant shall install or submit a valid petition for the installation of a 6" public water line running from Pheasant Lane to Crawford Street, prior to issuance of a building permit. 7. The applicant shall obtain removal of the twenty-four foot (241) reservation for a shared private drive off Georgetown Road from the recorded deed, prior to issuance of a building permit. 1 8. The applicant shall show a twenty foot (201) utility easement or designate a forty foot (40') street / utility easement for the 6" public water line on the final plan. The ten foot (10') public sewer line easement shall be deleted. 9. Bearings and distances to two corners of each building shall be provided on the final plan, in order to tie down the location of each unit. 10. The final development plan shall show separate letters for each of the six (6) building clusters (A - F) along with corresponding numbers for each unit. 11. Submission of a revised set of Covenants, Conditions and Restrictions containing the revisions requested by staff. Section 3. That upon receipt of certification by the Office of the Saline County Treasurer that all ad valorem property taxes are current on the real estate described in Section 1 , the City Clerk is hereby directed to publish this ordinance in the official city newspaper. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
