ORDINANCE NUMBER 89-9314
AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE
NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE
ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING
FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND
PRESCRIBING THE PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning
District Map, the rezoning of certain property therein, hereinafter described has
been timely complied with, and SO NOW, THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. AMENDMENT.

PLANNED DEVELOPMENT
DISTRICT. That the Zoning
District
Map of the
City of Salina, Kansas, duly
adopted and published as a
part of
Ordinance Number 8526, the same being
Chapter 42 of the Salina Code,
be and
it is hereby
amended so that the following
described property be rezoned
as follows, to wit:
All of Blocks One (1) through Six (6) , Mariposa Addition to
the City of Salina, Saline County, Kansas
shall become a part of District "PDD", PLANNED DEVELOPMENT DISTRICT.
Section 2. CONDITIONS OF APPROVAL. That the use of said
described property shall be subject to all the conditions, restrictions and
limitations as made and provided for in Ordinance Number 8526, the same being
Chapter 42 of the Salina Code, with reference to PLANNED DEVELOPMENT
DISTRICTS. Development of the property shall be subject to the plans on file
with the Planning Commission and/or City Clerk and the following conditions,
to -wit:
1. Approval is subject to the approved Preliminary
Development Plan and supporting documents which are
on file in the City Clerk's Office and is incorporated
herein by reference.
2. A final plat shall be submitted and approved prior to
final approval of the preliminary planned development
district.

3. The Declaration of Covenants, Conditions and
Restrictions shall be revised prior to recording to
provide for the transfer of title of the common area to
the Homeowners Association on or before the sale of
fifty-one (51) percent of the parcels.
4. The City Engineer shall review and approve storm
drainage construction plans, including the discharge of
private storm water onto public land, prior to final site
plan approval.
5. The City Engineer shall determine that adequate water
and sewer facilities exist to serve Blocks Five (5) and
Six (6) prior to final site plan approval.
6. Restricted access shall be shown along Marymount Road
abutting Block Six (6) or this street segment may be
subject to required improvement to collector street
standards.
7. Mariposa Drive shall be improved to collector street
standards prior to final site plan approval of Blocks
Five (5) and Six (6).
8. The requested fifteen foot (15') setback for one front
yard on a corner lot shall be approved; however Note 3
shall be revised to read as follows: "The front yard
building
setback shall be twenty-five
feet
(25'),
except
that on
corner lots where shown one
front
yard
may be
reduced
to no less than fifteen feet

upon
written
approval of the Architectural Review Committee."
9. The requested street and sidewalk construction waiver
shall be granted in lieu of an interior system of paved
common pathways.

Section 3. TIME SCHEDULE FOR COMPLETION. Development of the
site shall be timed according to the following schedule, to -wit:
1. Application for approval of final site development plan shall be
filed as follows:
Blocks 1 and 2 - 5 years
Blocks 3 and 4 - 10 years
Block 5 - 15 years
Block 6 - 20 years
2. Complete Development - Twenty-five (25) years from the date of
publication of this ordinance.
Section 4. Upon receipt of certification by the Office of the Saline
County Treasurer
that all
ad
valorem
property
taxes are current
on the
real
estate described in
Section
1 ,
the City
Clerk is
hereby directed to
publish
this
ordinance once in the official city newspaper.
Section 5. That this ordinance shall be in full force and effect from
and after its adoption and publication once in the official city newspaper.
