96-5032 Amended Curfew OrdCanealioeIld 8el11 RESOLUTION NUMBER 96-5032 A RESOLUTION SETTING OUT THE POLICY CONSIDERATIONS RELATING TO ADOPTION OF AN AMENDED CURFEW ORDINANCE. WHEREAS, in recognition of the role of the City of Salina in the safety and well-being of its children, the governing body has sought the input of a broad based group of interested citizens (the "Curfew Working Group") regarding the many issues presented by any effort to protect children through the use of a curfew ordinance; and WHEREAS, the Curfew Working Group has recommended that the children of this community would be best served by the continued use of a curfew ordinance, based upon certain policy considerations outlined in its report to the governing body; and WHEREAS, the governing body wishes to set out the policy considerations upon which it intends to adopt and implement an amended curfew ordinance for the City of Salina; SO NOW, THEREFORE Kansas: BE IT RESOLVED by the Governing Body of the City of Salina, Section 1. Protection of Children. Consideration of an amended curfew ordinance should be focused upon the intent of providing reasonable restrictions and a productive enforcement process for the protection of children during those hours of the night and under those circumstances in which they are particularly vulnerable. Section 2. Uniform Time Restrictions. In order to enhance public awareness of more readily understandable time restrictions, an amended curfew ordinance should contain uniform time restrictions for all days of the week. Section 3. Enforcement Procedures. Enforcement of the City's amended curfew ordinance should be consistent with Kansas law, particularly the Kansas Code for Care of Children. The Salina Police Department is encouraged to implement policies encouraging voluntary compliance through verbal warnings. When appropriate, use of juvenile intake and assessment process should be utilized as a means of determining what factors may be contributing to the child's prohibited conduct. Section 4. Education Program. Consideration of an amended curfew ordinance must anticipate an ongoing education program for parents and children through a wide range of media, emphasizing both the conduct prohibited by the curfew and the process for identifying factors which may be prompting the prohibited conduct in specific cases. Section 5. Effective Date. and after its adoption. This resolution shall be effective from Adopted by the Board of Commissioners and signed by the Mayor this 15th day of July, 1996.
