Meeting was celled to order by Mayor Hargett the roll was called and Commissioners Hargett, Dyar and Chambers and City Attorney N,rris responded. The minutes of the Regular Meeting of June 23rd, 1924 were read and approved as read. City Engineer submitted final estimate and approval on 1924 paving contracts of C. P. Barrington, and on motion of Commis- sioner Dyar same was accepted and approved by the Board of Commis- sioners. The following resolution was introduced: WHEREAS, heretofore on the 18th day of eebruary 1924, on consideration by the Board of Commissioners of the City of Salina, Kansas, an ordinance was adopted, approved and published, author- izing street improvements as follows: The excavating, grading, curbing, guttering and paving of the following streets: SUNSET DRIVE from the west line of Ninth Street to Highland circle. EIGHTH STREET from the north line of Elm Street to the south line of eine 7treet. ELEVETITH STREET from the north line of Park Street to the south ne of Elm Street. ELEVENTH STREET from the north line of lilashington t�venue to tFie nort line of Prescott tivenue. FRONT STPFET from the north line of Elm Street to the south line of amine Street. ELEVENTH STREET from the south line of 14orrison Avenue to the nortbline of vashington Avenue. IJORRISON AVENUE from the west line of Tenth Street to the east line of L event Street. AND, J F.MEAS, the Erngineer',s preliminary estimate of the cost of such improvements is^y?116,147.20; and WHEREAS, heretofore on the 17th day of !'larch, 1924, on consideration by the Board of Commissioners of the City of Salina, Kansas, an ordinance was adopted, approved and published authoriz- ing street improvements as follows: The excavating, grading and paving of the unpaved portion of IRON AVENUE in the center of said Iron Avenue now occupied by Me tracks of the Salina Street Railway Company, from the east line of Penn Avenue to the west line of Delaware Jtreet, and The excavating, grading and paving of all og the unpaved portion of SANTA FE AVENUE in the center of s aid anta Fe Avenue now occupied Ey the trc7c'Ycs of the Salina Street Railway Company from a point two hundred thirty (230) feet south of South Street to the north line of Beloit Avenue. AND, i`JHEREAS, the L'nginee2 s preliminary estimate of the cost of such improvements id 0333080.00. AND, MEREAS, the cost of such imporvements is authorized to be paid for in whole or in part by the issuance of bonds. AND, `JIHEREAS, in the contracts heretofore entered into between C. P. Barrington, the contractor, and the City of Salina, Kansas, it has been provided that payments shall be made to said contractor in partial estimates in cash or in warrants. AND.9 'MIME MS, the Engineer has now filed his certificate and report, showing final completion of the work under said con- tracts in accordance with the plans and specifications therefor, and that there is now due the contractor in addition to the sum heretofore paid in the form of Temporary Notes, the sum of N18,258.77, being the final payment on work completed under the above contracts, the Engineers estimate Number 5 thea -for having - been approved and accepted by the -Board of Commissioners, said Estimate Number 5 in the amount of X18,258.77, showing the en- tire amount of work completed and constructed under said con- tracts dated February 18th, 1924 and March 17th, 1924. AND, 'WHEREAS, under Section 10-123 the Revised Statutes of Kansas 1923, proper and full authority is conferred upon the City of Salina, Kansas to issue its Temporary Notes for the purpose of providing the payment of partial estimates under said contracts, NOW THEREFORE, BE IT :SOLVED by the Board of Commissioners of the City of Salina, Kansas: That the 14ayor and City Clerk be and they are hereby authozrized to issue the Temporary Note of the City of Salina, Kansas in the sum of X18,258.77 dated July lst, 1924, said su, being in final and full payment of work covered by said contracts above described, said work having been finally completed and approved. Said note to draw interest at the rate of 1-1/4 Ol per annum from its date to the date on which it is retired. Said note to be delivered to C. P. Barrington or to his order. The curbing and guttering of the east side of NINTH STREET from the south line of Jewell avenue to the north line of Vloud Street, and VIHE52AS, the Engineer's preliminary estimate of the cost of such improvements if 9"11,975.00 and WHIMEAS, the cost of such improvements is authorized to be paid for in whole or in part by the issuance of bonds, and y1HEREAS, in the contract heretofore entered into between C. P. An ordinance was introduced entitled: "An ordinance making an appropriation for the payment of a certain claim." On motion of Commissioner Dyar the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Hargett, Dyar and Chambers (3) Nays: (0) The Tdayor approved the same and is numbered 3005. An ordinance was introduced entitled: "An ordinance making an appropriation for the payment of a certain claim." An ordinance was introduced for second reading entitled: "An ordinance changing the name of that part of Tenth Street lying between the south line of Crawford Avenue and the north line of "epublic Avenue in the City of Salina, to Seitz Street. On motion of Commissioner Dyar the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Hargett, Dyar and Chambers (3) Nays: (0) The Mayor approved the same and is numbered 3007. An ordinance was introduced for first reading entitled: "An ordinance relating to and apportioning and levying special assessments on certain lots and pieces of ground on the City Of alina, Kansas to pay the cost of excavatill, grading and paving all of the unpaved portion of Santa Fe venue in said City, in the center of said Santa F venue as now occupied by the tracks of the Salina Street ailway Company, from the south line of Beloit Avenue thence south to Claflin Avenue there- in, and relating to and providing for the collection and payment of such assessments." On motion of Commissioner Chambers same was referred to the Board of Commissioners. An, ordinance was introduced for first reading entitled: "An ordinance relating to and apportioning and levying special assgssments on cer':ain lots and pieces of ground in the City of alines, Kansas to pay the cost of curbing and guttering the east sige of Ninth Street in said City from the south line of Jewell venue tothe norAi line of Cloud Street therein, and relating to and providing for the collection and payment of such assessments.' On motion of Commissioner Dyar same was referred to the Board of Commissioners. An ordinance was introduced for first reading entitled: "An ordinance relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas to pay the cost of curbing, guttering, excavat- ing, grading and paving Claflin Avenue in said City from the west line of Highland Avenue o t e east line of Ninth Street therein, and relating to and providing for the collection and payment of such assessments." On motion of Commissioner Chambers the same was referred to the Board of Commissioners. A bill from the Salina Water Works Company in the amount of X38,554.68 was presented for ayment of hCreh ant rental and water furnished the City of alina from 24th, 1923 to July 1st, 1924. Commissioner Dyar moved that the same be not allowed. Aiotion adopted. Commissioner Dyar moved that the City Attorney draft an ordnance appropriating the correct amount due the Salina eater "orks Colpany for hydrant rental Dnd grater rental furnished the City of Salina as per agreement of ebruary 8th, 1921 and accepted by the Salina ':later Works Company February 16th, 1921. R2otion adopted. Bond of Chas. 14. Hagler as Building Inspector was received and ordered filed. Bond of Keberlein Taxi Company was received, approved and ordered filed. The performance bond, statuatory bond and maintenance bond of C. P. Barrington for the paving contract awarded him June 2nd, 1924 was received, approved and ordered filed. The following resolution was introduced for first reading: 'I R4' S, the franchise heretofore granted b� the City of Salina, Kansas to the Salina Water Uorks ompany, a corporation for supplying hater to said City of Salina and to the inhabitants thereof has expired, and +r,'HL 'AS, the Board of Commissioners of the City of Salina, Kansas deem it necessary and for the interest of the City of Salina that said City acquire, control and operate the plant belonging to the Salina ':,rater Vdorks Company and now used by it in supplying water as aforesaid, IQ04'1 TIE -F=ORE, Br IT RESOLVED by the Board of Commissioners of the City of Salina, Kansas that it is necessary dnd for the interest of the City of Salina to acquire and control and to operate the plant now owned, in the City of Salina, I" ansas by the Salina 17ater Yorks Company, a corporation, and now used by said corporation in furnishing water to the City of Salina and to the inhabitants thereof, and that said plant be acquired and purchased by the City of Salina in the manner provided by law.
