ORDINANCE NUMBER 22-11096
AN ORDINANCE ADOPTING NEW SECTION 42-229.1 PERTAINING TO SHORT TERM
RECREATIONAL VEHICLE PARKING, AMENDING CODE SECTIONS 42-318 AND 42-339
PERTAINING TO CONDITIONAL USES IN THE C-5 COMMERCIAL DISTRICT AND C-7
HIGHWAY COMMERCIAL DISTRICT AND REPEALING THE EXISTING SECTIONS 42-
318 AND 42-339.
BE IT ORDAINED by the Governing Body o f Salina, Kan sas:
Section 1. New Section. The Salina Code is amended by adding a sec ti o n to be numb ered 42 -229 .1 ,
which section reads as follows:
Sec . 42-229. l. -Short term recreational vehicle parkin g areas.
Short term recreational vehicle parking a rea s that are accessory to an ex istin g hote l, mote l, truck stop or
travel plaza located in a C-5 or C-7 di st rict shall be allowed o nl y up o n a pproval of a co nditi onal use
permit in accordance with the provisi o n of Section 42-597.2 of the Zo nin g Reg ulati o ns.
Accessory short term recreati o nal vehicle parkin g a re as sha ll not be co nsidered to be rec reati o nal
campgrounds and shall not be subject to the requireme nt s of Sect io n 42-229 of the Zo nin g Regulations ,
except as may be required by the conditions imposed pursuant to a co nditi o nal use permit. In
considering a conditional use permit application the Planning Commission may imp ose requirements
related to the tot a l number of parking spaces allowed, limit s o n continuous ni g ht s of rental or use of
parking spaces, and such other conditions as deemed nece ssa ry and appropriate to mak e the accessory
recreational vehicle parking area compatible with s urroundin g property a nd to protect healt h, safety , a nd
welfare of the public.
Section 2. Amendment. Section 42-318 of the Salina Code is amended to read as fo ll ows:
Sec. 42-318. -Conditional uses.
Conditional uses in the C-5 district are as follows:
(I) Amusement parks and skating rink s;
(2) Animal hospitals , provid e d that all pe ns shall be in a n enclosed stru c tur e;
(3) Automobile repair ;
(4) Electronic cigarette establishments ;
(5) Group care facilities ;
(6) Group rehabilitation facilities ;
(7) Hospitals , sanitariums, rest homes a nd nur s in g homes;
(8) Lumber yards;
(9) Mini-warehouses ;
(10) Multifamily dwellings , provided that:
a. New buildings and addition s to existing buildin gs s hall co mpl y with the requirement s of
the R-3 district and parking shall be provided in conformance with sect ion 42 -553;
b. Conversions of existing nonresidential buildings s hall comply with the lot s ize
requirements of the R-3 district (section 42-204) in additi o n to th e bulk reg ul ations in the
C-5 district and parking ma y be provided at o ne-h a lf ratio se t forth in section 42-553.

(11) Multifamil y dwellings for elderly a nd /o r handicapped persons provided that:
a. New buildings and additions to ex istin g buildings s ha ll comp ly with the requirements of
the R-3 district , with the exceptio ns to the bulk and lot size regulation s permitted in
section 42-203 and parkin g shall be provided in conformance with sectio n 42-553 ;
b. Conversions of existing nonresidential buildings sha ll co mpl y w ith the requirements of
the R-3 district , with the exce pti o n to lot s ize regulations permitted in section 42-203 in
addition to the bulk regulations in the C-5 di strict and park in g shall be provided in
conformance wit h sect ion 42-553.
( 12 ) Outdoor theatres ;
( 13) Shooting ranges (ind oo r);
( 14) Short term recrea tional vehicle parking a reas accessory to hotels , mote ls, truck stops a nd
travel plazas ;
( 15 ) Tattoo parlors and body piercing st udi os;
( 16 ) Taverns;
(17) Telephone exchanges and te lep ho ne tran smi ssion equ ipm ent structures;
(18) Tobacco shops.
Section 3. Amendment. Section 42-339 of the Salina Code is a me nd ed to read as follows:
Sec. 42-339. -Conditional us es.
Conditional uses in the C-7 distri ct are as fo ll ows:
(I) Agr icultural impl e ment sa les a nd service;
(2) Automobile a nd truck sa les, re nt a l a nd repair service;
(3) Automotive parts stores;
(4) Bevera ge di stribut o rs;
(5) Boat sales, rental and service ;
(6) Buildin g supply stores and lumber ya rd s;
(7) Busin ess a nd profe ss iona l offices;
(8) Commercial recreatio n facilities ;
(9) Department and di sco unt sto res;
(I 0) Equipm e nt sa les and rental ;
(I I) Foo d sto res a nd delicatesse ns;
(12) Fra ternal and service clubs ;
(13 ) Furniture sto res;
(14 ) Governmental buildin gs;
(15 ) Manufactured ho me and mob il e home sa les;
( 16 ) Private clubs;
(17) Public utility uses , includin g sub stat ions;

(18) Recreati o nal ve hicle campgrounds;
(19) Recreati o na l vehicles sa les, re nt a l a nd se rvic e;
(20) Shooting ranges (indoor);
(21) Short term recreational vehicle parkin g areas accessory to hotels , motels , truck stops and
travel plazas ;
(22) Warehouses and wholesale ho uses.
Section 4. Repealer. Existing Salina Code Sections 42 -3 18 and 42-339 are repealed.

On February 14 , 2022, the City Co mmis s io n passed Ordinance No. 22 -110 96. The Ordinance
adds Section 42-229.1 to allow sho rt term recre at io nal parking areas that are accessory to an
existing hotel , mo tel , truck stop or tra ve l pl aza to be approved through a cond iti onal use permit
