12-04-1922 MinutesCOMMlSbiONERS PROCEEDINUS, REGULAR MEETING. �I WHEREAS, there was on June 26th, 1922 assessed against the North one-half of Lot 51, Block 16, South Park Addition to the City of Salina, Kansas the sum of $23.67 for the purpose of paying a portion of the cost building and constructing a ten - inch Sanitary Lateral Sewer in Lateral Sewer District Number 1-F in the City of Salina, Kansas, and WHEREAS, the property hereinbefore described and against which said assessment was so made was not benefited by said later- al sewer and, WHEREAS, said assessment was so made by inadvertaince and mistake, NOW THEREFORE., BE IT RESOLVED by the Board of Commissioners of the City of Salina that said assessment of $23.67 so levied and assessed against the property before described be remitted and not collected, and that the County officials of Saline County, Kansas be and they are hereby authorized and directed to remit the same and to strike the levy and assessment of said sum from the tax roll of said County. DECEMBER 4th, 1922. Board of Commissioners met in regular session, December 4th, 1922. Meeting was called to order by Mayor Dyar, the roll was called and Commissioners Dyar and Hargett and City Attorney Buziek responded. The minutes of the Regular Meeting of November 27th, 1922, were read and approved as read. An ordinance was introduced entitled: "An ordinance making appropriations for miscellaneous purposes." On motion of Commissioner Hargett the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Dyar and Hargett (2) Nays: (0) Commissioner Campbell absent. The ITayor ap- proved the same and is numbered 2628. An ordinance was introduced entitled: "An ordinance making an appropriation for the payment of a certain claim." On motion of Commissioner Hargett the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Dyar and Hargett. (2) Nays (0) Commissioner Campbell absent. The Mayor approved the same and is numbered 2629. Dyar, Mayor Commissioner Hargett moved that the resolution be adopted as read and at this meeting because of a public emergency making the same necessary, and on its final adoption the roll was called and the following vote was had; Ayes: Dyar and Hargett (2) Nays: (u) Commissioner Campbell absent. 117 Its The following resolution was introduced: WHEREAS, on August 21st, 1922 there was levied and assessed against .iot Number 29 in Block Number 6 in River- side Park Addition to the City of Salina, Kansas, the sum of $81.05 for the purpose of paying the cost of constructing a sidewalk abutting Ash Street upon the east 100 feet of said lot, and WHEREAS, said lot, prior to such levy and assessment had been divided and a conveyance dividing the same was of record in the office of the Register of Deeds of Saline County, Kansas, and WHEREAS, said sum of $81.05 should have been levied and assessed only against the east 100 feet of said Lot Plumber 29, Block Number 6, in Riverside Park Addition to said City, said 100 feet of said lot being the only property benefited thereby, and WHEREAS, the west 65 feet of said Lot Number 29, Block Number 6, should not have been assessed for any portion of the cost of said sidewalk and was in no wise benefited thereby, NOW THEREFORE, BE IT RESOLVED, by the Board of Com- missioners of the City of Salina, Kansas that said levy and assessment hereinbefore mentioned be and the 'same is hereby remitted, vacated and annulled in so far as the same relates to the west 65 feet of Lot Number 29, in Block Number 6, in Riverside Park Addition to the City of Salina, Kansas, and that the County officials of Saline County, Kansas be and they are hereby authorized and directed to vacate and strike from the tax rolls such assessment so far as the same relates to the west 65 feet of said Lot Number 29, PROVIDED, HOWEVER, that nothing herein contained shall be construed in any way as vacating or annulling the levy and assessment of said sum against the east 100 feet of said described Lot Number 29. On motion of Commissioner Hargett same was referred to the Board of Commissioners. On motion of Commissioner Hargett same was referred to the Board of Commissioners. A resolution was presented for first reading providing for the laying and installing of a 6 -inch water main on Crawford Avenue from Ninth Street to Tenth Street. On motion of Commissioner Hargett same was referred to the Board of Commissioners. A resolution was presented for first reading providing for the laying and installing of a 6 -inch water main on Charles Street from Tenth Street to Eleventh Street. On motion of Commissioner Hargett same was referred to the Board of Commissioners. A resolution was presented for first reading providing for the laying and installing of a 6 -inch water main on Eleventh Street from Charles Street to Crawford Avenue. On motion of Commissioner Hargett same was referred to the Board of Commissioners, A resolution was presented for first reading providing for the laying and installing of a 4 -inch water main on Ledar Street from Baker Street to Phillips Street. On motion of Commissioner Hargett same was referred to the Board of Commissioners. A resolution was presented for first reading providing for the laying and installing of a sig -inch water main on Jewell Avenue from Santa Fe Avenue to Ninth Street. On motion of Commissioner Hargett same was referred to the Board of Commissioners. A petition was received asking for the excavating, grading and paving of Eleventh Street from Walnut Street to Iron Avenue. On motion, same was referred to the City Manager. A petition was received asking for the location of a Filling Station on the corner of Fifth Street and Ash Street. On motion, same was referred to the City Manager. Mayor Dyar appointed Alex Berg, J. E. Putnam and Edd Mathews as appraisers to ascertain the cost and benefit of opening Frost Street between Sherman Street and Ninth Street; for the opening and extending of Tenth Street from the south line of Frost Street to the north line of Republic Avenue; For the widening of Republic Avenue between Ninth Jtreet and Sherman Street; For the opening of Sherman Street from the south line of ► Crawford Avenue to the norfE line -o-public Avenue; For the opening and extending of Eleventh Street from Craw- ford Avenue to Republic Avenue; For the opening of Franklin Street between Sherman Street and Ninth Street.
