OhioGo daed.Sa,n (Published in The Salina Journal December�2001) ORDINANCE NUMBER 01-10068 AN ORDINANCE PROVIDING FOR THE ANNEXATION OF CERTAIN TRACTS OF LAND, IN SALINE COUNTY, KANSAS IN CONFORMITY WITH THE PROVISIONS OF K.S.A. 12-519 TO 12-526, INCLUSIVE AND REPEALING ORDINANCE NO. 01-10035 AND ORDINANCE NO. 01-10059. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That the following described tracts of land, to -wit: A tract of land located in the NE 1/4& SE 1/4 of Section 36, Township 13 South, Range 3 West and the NW 1/4 & SW 1/4 of Section 31, Township 13 South, Range 2 West of the Sixth Principal Meridian in Saline County, Kansas, more particularly described as follows: Commencing at the southwest corner of the NW 1/4 of said Section 31; - thence N 00° 00' 00" E along the West line of said Section 31, a distance of 1048.86 feet to the point of beginning; - thence N 90° 00' 00" E a distance of 100.00 feet to a point on the east right-of- way line of Ohio Street; - thence S 03° 07' 02" W a distance of 735.57 feet along the east right-of-way line of Ohio Street; - thence S 00° 00' 00" E a distance of 314.33 feet along the east right-of-way line of Ohio Street to a point on the south line of said NW 1/4 ; - thence N 89° 56' 52" E a distance of 687.50 feet; - thence N 00° 00' 00" W a distance of 60.00 feet; - thence N 89° 56' 52" E a distance of 160.00 feet; - thence N 00° 00' 00" W a distance of 520.00 feet; - thence S 89° 56' 52" W a distance of 160.00 feet; - thence N 00° 00' 00" W a distance of 1212.94 feet to a point on the south right- of-way line of Interstate 70; - thence N 58° 20' 13" E a distance of 823.43 feet along the said south right-of- way line of Interstate 70; - thence S 00° 00' 00" E a distance of 2224.58 feet to a point on the south line of said NW 1/4; - thence continuing S 00° 00' 00" E into the SW 1/4 a distance of 1327.08 feet; - thence S 57° 30' 13" W a distance of 831.05 feet; - thence S 89° 56' 52" W a distance of 747.51 feet to a point on the west line of said Section 31; - thence N 00° 00' 00" E a distance of 71.26 feet along the west line of said Section 31; - thence West to a point that is 37.50 feet West and 390.00 feet South of the northeast corner of the southeast quarter (SE 1/4) of the southeast (SE 1/4) of said Section 36 and is on the west right-of-way line of the Ohio Street; - thence Northwesterly to a point that is 700.93 feet west and 370.00 feet south of said northeast corner of said SE 1/4 of the SE 1/4; - thence Northwesterly to a point that is on the west line of the said SE 1/4 of the SE 1/4, said point being 330.00 feet south of the northwest corner of said SE 1/4 of the SE 1/4; - thence North along said west line of said SE 1/4 of the SE 1/4a distance of 330.00 feet to the northwest corner of said SE 1/4 of the SE 1/4; - thence N 00° 00' 00" E parallel with the East line of the of said SE 1/4a distance of 1310.60 feet to a point on the North line of said SE 1/4; - thence West on the North line of said SE 1/4a distance of 13.98 feet; - thence continuing N 00° 00' 00" E parallel with the East line of said NE 1/4a distance of 506.66 feet to a point on the South right-of-way line of Interstate 70; - thence Northeasterly along said Interstate 70 right-of-way a distance of 812.89 feet; - thence Northeasterly along said Interstate 70 right-of-way a distance of 541.61 feet to a point on the west right-of-way of Ohio Street; Co'WIaiea U"m - thence N 90° 00' 00" E a distance of 100.00 feet back to the point of beginning. The above described tract of land has an exception of: A parcel of land located in the Northeast Quarter (NE 1/4) of the Southeast Quarter (SE 1/4) of Section Thirty-six (36), Township Thirteen (13) South, Range Three (3) West of the 6" P.M., Saline County, Kansas, more particularly described as follows: Commencing at the Northeast corner of said SE '/4; thence West along the North line of said SE 1/4a distance of 37.50 feet to a point on the west right-of-way of Ohio Street; - thence South along said west right-of-way of Ohio Street and parallel with the East line of said SE 1/4a distance of 748.00 feet to the point of beginning; - thence continuing South along said right-of-way parallel with said East line of said SE 1/4a distance of 354.00 feet; - thence West on a line which is perpendicular to said East line of said SE 1/4a distance of 391.65 feet; - thence North parallel with the East line of said SE'/4 a distance of 354.00 feet; - thence East perpendicular with said East line a distance of 391.65 feet to the point of beginning. Said parcel of land contains 138,644 square feet, more or less. The above described of land less the exception contains 7,145,558.77 square feet and/or 164 acres, more or less. meeting one or more of the classifications for annexation prescribed by K.S.A. 12-519 to 12-526, inclusive, is hereby annexed and made a part of the City of Salina, Kansas. Section 2. That the tract of land described in Section 1 is shown in Attachment "A" of this ordinance. Section 3. That the 5.2 acre tract located at the southwest corner of I-70 and Ohio Street shall be zoned C-7 Highway Commercial District upon annexation. All other property within the annexation area show in Attachment "A" shall be zoned A-1 Agricultural except for Lot 1, Block 1 of the Lindsfors Addition and Lots 1, 2 and 3, Block 1 of the Foley Addition which were rezoned by separate ordinance. Section 4. That the certain tract of lands that are included in this annexation are addressed as follows: 2301 N. Ohio Street 1960 N. Ohio Street repealed. Section 5. That Ordinance No. 01-10035 and Ordinance No. 01-10059 are hereby Section 6. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
