Commissioners Room,
Salina,Kansas.
December 20, 1921.
Adjourned meeting; of the Board of Commissioners,
Tuesday, December 20th, 1921. i:ieeting was called to
order by ?�.ayor Dyar, the roll was called and Commission-
ers Campbell, Dyar and City Attorney Buzick responded.
Commissioner Hargett absent.
The following resolution was introduced:
f1HERE;AS, the City of Salina, Kansas had on
deposit to its credit in The Peoples State Bank of Salina,
Yansas, the sum of Three Thousand Eight Hundred and Sixty -
Nine Dollars and Forty-two Cents (!0869.42) as'of the
date when a receiver was appointed to take charge of and
handle the assets and obligations of said bank and to
liquidate the same, said indebtedness from said bank to
the City of Salina being confirmed by an auditor's report
made on October 31st, 1921, and
7_7_.TREAS, The Peoples State Bank of Salina, Kan-
sas, aforeasid, was on the dates aforesaid, at the time
of the desposit of said sums and now a bank participating
in the Bank Depositors Guaranty Fu -Id of the State of Kan-
sas as provided by Article 2 of Chapter 11 of the General
Statutes of Kansas for 19151, and
VVI ER EAS, by reason of the participation of said
bank in the Bank Depositors Guaranty Hind of the State
Of Kansas aforesaid it was at the time of deposit of said
sum Three Thousand Fight Hundred and Sixty-nine Dollars and
Forty-two cents in said bank, (r;hich amount has been Paid
the City of Salina by certificate of the Sank Commission-
er of the State of Kansas upon the bank deposit guaranty
fund of said State) unnecessary that said bank provide
to the City of Salina any bond to secure the deposit of
said sum as otherwise provided for b,r law, said exemption
being provided -by Section 611, General Statutes 1915.
NO:` T?I--- PLFOR.E, BE IT ;iiSOLVED by the Board of
City Commissioners of the City of Salina, that Henry
Eberhardt, City Treasurer of said City, be and he is here-
by relieved and absolved of any liability to the City of
:Salina by reason of or on account of the deposit of said
sum in The Peoples State Bank of Salina, Kansas, without
having required in connection there=with any bond from said
bank in favor of said City, to the end that no liability
or obligation shall attach to said Henry =�berhardt, in any
manner by reason of the non -execution and non-delivery of
said bond.
Passed and approved this 20th day of December, 1921.

REQUEST FOR PASSAGE OF Rr,SOLUTION
AT FIRST READING.
To the City Commissioners of the
City of Salina, Kansas:
It is hereby requested that the above and foregoing
resolution introduced on this 20th day of December 1921,
for first readirif be finally passed said day for the reason
that the resolution is in every respect meet and proper, and
for the further reason that the passage of such resolution is
necessarJT, before the bond of the City Treasurer, 1-Ienry H.
Eberhardt, as such City Treasurer, required by lata, may be
issued to the City of Salina, Kansas; the necessity of said
bond, being required by law, constituting; a public emer-
gency.

Commissioner Campbell moved that the resolution be
declared an emergency measure, and that same be adopted
as read by the following vote: Ayes: Campbell and Dyar
(2) Nays: (0) Commissioner Hargett absent.
Commissioner Campbell moved that the Commissioners
adjourn until Tuesday, December 27th, 1921 at 7:30 o'clock
