Board of Commissioners met in regular session, Ivon- day, December 12th, 1921. 1,.�eeting was called to order by Mayor Dyar, the roll was called and Commissioners Camp- bell, Dyar and Hargett and city Attorney Buzick responded. The minutes of the regular meeting of December 5th, 1:;21, and the special called meeting of December 8th, 19211 were read and approved as read. The following resolution was introduced for first reading: "Designating City Depositories". On motion of Co-mmiss ioner Campbell same was referred to the Board of Commissioners. The following ordinance was introduced for first reading entitled: "An ordinance providing for the con- demning and removal of certain buildings and structures in the City of Salina, Kansas." On motion of Commissioner Hargett same was referred to the Board of Commissioners. City Clerk made a report on the recall petitions filed December 2nd, 1921, as follows: OFFI"LE OF THE CITY CLERK ) SS. CITY 0 _i'' SALINA, KANSAS ) V!HERE:IS, there was heretofore and on the 2nd day of December, 19211, filed with me the City Clerk of Salina, KRnsas, and in my office as such, certain petitions pray- ing that the Board of Commissioners of the City of Salina, call an election for the purpose of electing successors to the offices of Commissioners of said City now held by Jas. S. Hargett and F. S. Dyar, and `THEREAs, I have carefully examined said petitions and in regard to the petitions so filed praying for the calling of an election to vote for a successor to the office now held by said Jas. S. Hargett, and find that said pe- titions have begn signed by 381 'persons, who are electors of the City of alina, Kansas, and entitled to vote for a successor to the present incumbent of said office; and have examined the petitions filed praying for the calling of an election to vote for a successor to the office of Commissioner now held by F. S. Dyar and find that said petitions have been sunned by 399 electors of the City of alina, entitled to vote for a successor to the office of Commissioner now held by said F. S. Dyar, and ':IHEREAS, Section 1473 of the General Statutes of Kansas 1915, provides that any petition so filed and ask- ing for the calling of such special election as above men- tioned shall be signed by twnety-five (25j�)) per centum of the entire vote for all candidates for office of iaayor at the last preceding General Municipal Election, and 'N {REAS, the City of Salina is a City of the first class having the Commission-14anager form of government, as provided by Chapter 86 of the Laws of -ansas for 1917, and is governed by a Board of three Commissioners, none of whom are elected by the electors of said City as Mayor and , WHEREAS, by reason thereof at the last preceding General Municipal Election held in the City of Salina in 1921, no Mayor was elected, and f'HE'RE-.S, the Attorney General of the State of Kansas, and on the 8th day of December, 1921, rendered to the of- ficers of the City of Salina, an opinion to the effect that because of the non -election of any ?Mayor of said City at the lastlreceding General Municipal Election it is impos- sible to make any determiniation as to the number of signers 2bPGG required upon the recall petitions heretofore mentioned, and impossible by reason thereof to determine in any manner the sufficiency or insufficiency of the same. j TH-Ii-R4'FORE, I, the undersigned, City Clerk of the j City of Salina, Kansas, find it impossible to make any de- termination as to the sufficiency or insufficiency of said petitions, or either of them, or to make or file any certi- ficate as to the sufficiency or insufficiency of the same. Commissioher Hargett moved that the Commissioners meet 1 the representatives of the Salina "eater 7orks Company in a Conference as soon as agreeable to said Company. { Commissioner Campbell moved that the Commissioners extend a vote of thanks to Chas. A.. AMorrison of The Inter- national harvester Company for the use of their truck, to replace the fire truck that was temporarily placed out of commission. n request was received from The Salvation fumy for permission to locate booths on Santa Fe_venue for the col - j lection of Christmas funds. On motion of Commissioner Campbell, permission was granted. i City Engineer was instructed to prepare plans and j specifications for drainage sewer in the alley t^rest of Ninth Street from Harsh to Hamilton, a distance of about i 450 feet.
