Mayor Mathews presiding, City Attorney Buzick and the followingr named council_nen ans.vered to roll call: Dyar, Givens, Spaeth, Howell, Campbell, 1Jaite, Brad- ford, Barbee and larver. . Councilman _Marne absent . The minutes of the 'regular Semi-monthly meetiiiE of April 4th, 1921, and the canvassing Board Meeting of L',pril 8th, 1921, were read and approved as read. Ari ordinance was introduced entitled: "An ordinance mak- ing an appropriation for the payment of certain claims:" On motion of Couricilnan Howell the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Dyar, Giv- ens, Spaeth, Howell, Campbell, Waite, Bradford, Barbee and Carver. (9) Naysi. (0) Councilman Harrne absent. The b'ayor approved the same and is numbered 2381. Comic i.l:nan Dyar of the Special Committee to whom eras referred the matter of vacating a portion of Oakdale Avenue, south of. Elm Street reported as follows: Salina, Kansas. April 18th, 1921 To the Hon. Ilayor and Council, City of Salim_, Kansas. Gent lemen: Ne, the Special Committee make the following recommen- dations regarding request of earl Johnson reference to loca- tion for store on City property: "vVe recommend that we lease the grouril on the west side of Oakdale Avenue for a period of five (5) years with the pri- vile-e of renewal for the consideration of One ("1.00) Dollar per year. .de recommend the following restrictions: That the store be set not closer than 10 feet from the south side of sidewalk line extending west on Elm 6treet, also that store be set not less than 5 feet west of curb line on Oakdale Avenue. That he be given permission to use 65 feet south from sidewalk line on south side of Elm 'Itreet . That he be required to keep premises clean and that no rub- bish be thrown over the river bank. Should property cease to be used for the purpose of this lease that the lease automatically is cancelled." F. S. Dyar, J. H. i�pae th, Special Committee. Councilman Givens moved that the report of the Conul:it- Lee be accepted. Councilman Waite of the Side ,,alk Committee reported that in their opinion all sideaala petitions that had not been act- ed on should be deferred and referred to the nevrly elected Board of Commissioners. CityEngineer, P• G• �Jakerihut, submitted plans and spe- cifications for the construction of certain sewers. Councilman Givens moved that the :natter of se';rer con- struction be deferred until the newly elected Board of Commis- sioners have qualified and taken char -e of City matters. A petition was received asking for the construction of a sewer on University Place from a point east of the Missouri Pacific nail:ray to the alley west of Chicago Street also for lateral servers in the alleys running north and south in Blocks 4, 7 and 13, in Leavenworth hddit ion. Same eras referred to the Board of Commissioners, � A petition was received asking for the construction of a side4ialk on the east side of Penn -venue, north of Elm Street in front of Lots 15-17 and 19, Block 2, Riverside Park Addition. Same was referred to the Board of Commissioners. A cormmunication was received from Mrs. J. T. Carson, in reference to City Jarrant, issued her February 22nd, 1921, in the amount of X57.50, same appears to have been lost or destroyed. Councilman Campbell moved that the City Clerk be in- structed to issue a duplicate for said warrant. The monthly reportes of the City Clerk, City Treasurer, Police judge and Fire Chief were received and ordered filed. Councilman Givens moved that the City clerk write to the newly elected Board of Commissioners assuring them that the retiring I,Iayor and uouncilriien extend to them their hearty co-operation and best wishes, and, at any time called upon would be pleased to give them any assistance they might be in position to render. IJayor 1r1athews expressed his appreciation for the hearty support given him during the last administration by the mem- bers of the Council, City nttorney and City Clerk, assuring all that it dvas a pleasure to preside over a body that worked as harmoniously as the last administration has done. Councilman i4aite moved that the retiring Council tender to Y,ayor PV.athews a vote of thanks for his courtesy and fair ruling to all meriibers of the administration, There being; no further business appearing, on motion of Councilman Howell, the retiring Mayor and Council adjourned and the newly elected Board of Commissioners being present the oath of office eras administered by the City Clerk to F. S. Dyar, L. T. Campbell, and J. S. Hargett, after which the Commissioners were called in session by the City Clerk and nominations for presiding officer and h"ayor was received. nom -On motion of Comiiiissioner Hargett, F. S.
