Mayor Mathews presiding, City Attorney G. A. Spencer and the following named councilmen answered to roll call; Under- wood, Grimes, Henry, Smith, ,iishler, Reed, Brown, Waite, Todd and Peters. The minutes of the Regular Semi -I: onthly I�41eeting of April ist, 1918; Canvassing Board i:Teeting of A,)ril 5ti, 1918; and Ad- journed Meeting of April 5th, 1918, were read and approved as read. F. H. Quincy appeared before the Council and asked the Council to remit carnival license for the carnival to be held in Salina, j:ansas, I:iay 13th to 18th inclusive, under the auspic- es of the Isis Patrol. Councilman Smith moved that the request be granted. Motion adopted. i:ayor Mathews stated that he thought it would be proper thing for the Council to make a donation to The Grand Army of the Republic, to help defray expenses of-emori.al Day exercises. Councilman Todd moved that y50.00 be donated. Councilman Todd of The 7!ays and Means Committee, to whom was referred the matter of providing a site for a voting Mace in the south precinct of the Third Ward, asked for further time. On motion, further time was Sranted. An ordinance was introduced entitled: "An ordinance making an appropriation for the payment of certain claims -.11 On motion of Councilman meed the ordinance was read and adopted by sections and on its final adoption the roll was called and the foollowing vote was had; Ayes: Underwood, Grir:-:es, Henry, Smith, ,l ler, Reed, Brown, aite, Todd and Peters. Special Committee, to whom was referred the matter of incor- porating highland Court Addition into the City of Salina, Kan- sas, submitted the following report: To the Ilon . ilia yor and C ounc i lrmen of the City of Salina: Gentlemen: We, the Committee to whom was referred the matter of incor- porating within the limits of the City of Salina that tract of land known as the Wallerius Tract consisting of approximately 80 acres beg to report as follows: lst . That we take said tract of land within the corpor- ate limits of the City of Salina. 2nd. We recommend that a sewer be run along Ninth Street adjoining this property on the east for the accomodation of the peple living along both sides of such street, such sewer to be attached to the sewer now extending from Highland Avenue to Ninth Street, the same being about four and one-half (4_) feet in depth. 3rd. We further recommend that the City build and construct four spurs extending into the 71-.1lerius Tract a distance of ap- proximately 150 feet and connect with the sewer to be laid on _ Ninth Street; the spurs of sewer to be laid shall be of such depth as to give proper drainage with the sewer to which they are to be connected. We also recommend that the City cause to be installed sufficient water mains to distribute water upon said tract co -extensive with the sewer to be built and construct: d and recommend that in the future the City of Salina cause to be built and constructed sewers and water mains in accordance with the policy which has been adopted and now prevailing in said City for the extension of such sewer and water. 2bPGG tide understand that the owners of the 1,11allerius Tract are to execute and deliver in escrow to the president of The Salina Chamber of Commerce a good and sufficient warranty deed for a tract of land on the west side of the 'vllallerius Tract, consisting of approximately 20 acres conveying to the City of Salina for nark purposes such 20 acre tract, said deed to be delivered by the said, the presideint of The Salina Chamber of Commerce to the City of Salina as soon as said Cit'is ready, to begin the improvement of such tr_..ct as a public park. i ie also understand that the owners of said tract of land agree to build and construct on the grade to be given them by the City Engineer of the City of Salina and in accordance with the present ordinances of said City, upon and along such protions of said tract as public improvements may be built, good cement sidewalks and curb and guttering and also to build and construct good cement cross -walks along and upon the streets to be laid out and. dedicated in said contract. U )on the acceptance of the terms and conditions set forth herein by the owners of the Nallerius Tract, we recommend that that tract of land be incorporated within the city li:-its in accord- ance with the statutes as soon as practicable. Councilman Brown of the "treet and Alley Committee asked for further time to report on the petition asking for the extension of the tdhite 'May on Fifth Street from Walnut Street to Ash Street. On motion further time was granted. City Clerk was instructed to notify Erickson Brothers of LindsUorg, ansas, to repair the cement guttering in front of the Lee Mercantile Building. Councilman Waite moved that. The Union Pacific Railroad Com- pany be instructed to construct sidewalk crossings across their tracks on the south side of South Street opposite the foot bridge. The following resolution was introduced: 17HEREAS, it is deemed necessary, and is hereby declared to be necessary that The Eberhardt ConstructionPompany (now build ing the new Shellabarger Mill) be per:rnittea to connect to and take water from Fire Plug No. 12, located in the Shellabarger mill. yard, and VJIIZRl.xS, The Salina ,Fluter 'bsl rks Company is willing to grant such connection and use, provided; that the Tal and Coun- cilmen pass a resolution authorising the same, and holding The Salina :!later Works Company blameless in case that any danger or curtailment of fire ptotection should result from such connection and use: NO'v`1 THERIEFORE) BE IT RESOLVED, By the Mayor and Coun- cilmen of The City of Salina, that The Salina Water Tlorks Company be, and it is hereby authorized to permit the connection and use prayed for, and that the City of Salina, will hold The Salina 'eater .lorks Company blameless of any curtailment or failure of fire pro- tection resultant therefrom. (10) flays: (0) The following resolution was introduced: '17HEI EAS, it has been shown to the Mayor and Councilmen that there are two persons on 11orth Columbia Avenue, north of Elm Street in the city of Salina, Kansas, who desire to beocome tenants of The Salina dilater 'works Company for domestic purposes only, and that in order to permit such persons to become tenants of such Company, it will be necessary for said Company to extend their water main a distance of not to exceed 120 feetm, Now Therefore, BE IT RESOLVED, By the 1viayor and Councilmen of the City of Salina, that The Salina 'Nater Works Company be and it is hereby instructed to lay and install a two-inch water pipe for domestic purposes, from their present main on North Columbia Avenue fo a distance of not to exceed 120 feet to enable such persons to become tenants of such company for domestic purposes only. On motion of Councilman Mishler the rules of order were sus- pended for its consideration and the resolution be adopted as read by the following vote; Ayes: Underwood, Grimes, Henry, smith, Mishler, Reed, Brown, Waite, Todd and Peters. (10) Mays: (0) Councilman Underwood of the Building Committee reported tha t the roof on the City mall was in need of paint . Councilman Henry moved that the matter be referred to the Building Committee with power to act. Councilman Peters of the Sewer and Drainage Committee report- ed favorably on the following petitions: For a sewer on Faulkner Street from 'jalnut Street north, thence east to Eleventh Street; For a sewer in the alley between Second and Third Streets from Iron Avenue, south to the river. On motion of Councilman Brown the report of the Committee was adopted. Sewer and Drainage Committee asked for further time to report on the petition asking for the const --ruction of a sewer between Tenth and Eleventh Street, north of South Street. On motion fur- ther time was granted. D. X21. Dunne L Company of Wichita, Kansas, submitted a written proposition for the bonds to be issued by the City of Salina, dur- ing the next six months, offering par and accrued interest on five per cent (5,) bonds, with the privilege of having the bonds issued bearing interest at the rate of 4-3/4j;, allowing said Company ac- crued interest for 90 days, same being equal to a 5j basis. On motion of Councilman Brown the proposition was accepted. An ordinance was introduced entitled: "An ordinance provid- ing for the issuance of Sewer Improvement Bonds of the city of Sa- lina, Kansas, in the sum of ,9,848.35." On motion of Councilman Brown the rules of order were sus- pended for its consideration by the following vote; Ayes: Under- wood, Grimes, Henry, S . ith, P:lishler, Reed, Brown, Waite, Todd and Peters. An ordinance was introduced entitled: "An ordinance requiring the payment of certain sums into the City Treasury and providing for the certification to the County Clerk of Saline County, Kansas, of certain sums not paid in and to be assessed and taxed against certain land." on motion of Councilman Smith the rules of orderwere suspended for its consideration b;r the following vote; ryes: Underwood, Grimes, Henry, Smith, Mishler, Reed, Broilin, 1.7aite, Todd and Peters. (10) Trays: (0) On motion of Councilman Brown the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was and; Ayes: Underwood, Grimes Henry, Smith, iMishler, Reed, Brown, ',Vaite, Todd and Peters. (103 Mays: (0) The Mayor approved the same and is numbered 2172. The matter of locating the automobile show tent on Fifth Street covering a portion of the sidewalk was referred to the Mayor with power to act. On motion, C. T. Snyder, was relieved from the contract to con- struct the sewer along the river bank east of the City, and the certified check ,f 4'500.00 was returned. A petition was received asking for the extension of White ','lay on Iron Avenue, from Seventh to Ninth Streets. Same was referred to the Street and Alley Committee. A petition eras received asking for the excavating and paving of Elm Street from Third Street to Second Street. Same was referred to the Street and Alley Committee. There being no further business, and the newly elected Coun- cilmen being 1�resent, the oath of office was administered by the City Clerk to the following persons elect: Counci-J_man, First,v'lard, L.
