12-17-1917 Minutes21)P('G COUNCIL PROCEEDINGS, REGULAR MEETING. i COUNCHIL CHAMBER, SALINA, KANSAS. DECEMBER 17th, 1917. Regular semi-monthly meeting of the City Council December 17th) 1917. Mayor Mathews presiding, City Attorney G. A. Spencer and the following named councilmen answered to roll call; Under- wood, Grimes, Henry, Smith, Mishler, Brown, Waite, Todd and Peters. Councilman Reed absent. The minutes of the regular semi-monthly meeting of December 3rd, 1917, were read and approved as read. An amended petition asking for the construction of a sewer on Eleventh Street, about 250 feet south of the center of Charles Street was presented and referred to the Sewer and Drainage Committee. Server and Drainage Committee reported and recommended that said sewer be constructed according to the bid that was submitted by C. T. Snyder, November 19th, 1917, same being stricken from the bid on mo- tion, at the regular meeting of December 3rd, 1917. On motion, the report and recommendations of the Sewer and Drainage Committee was adopted and the City Engineer was instructed to include the same in the original plans and specifications, and the City Attorney was instructed to prepare the necessary ordinance, letting the contract for the above sewer. i C. W. Anderson appeared before the Council and asked for a special permit to construct an iron shed at the rear of his build- j ing on Fifth Street, between Iron Avenue and Ash Street. a a On motion of Councilman Brown a special permit was granted. a Mr. Wood appeared before the Council and asked for a special permit to enlarge his building on North Thirteenth Street, by adding a second story, same being in the fire limits. I On motion of Councilman Brown a special permit was granted. Councilman Todd of the `Nays and Means Committee reported that the committee had affected a settlement with Jos. Lambotte in the sum of .``,100.00, and recommended that the mayor instruct the police to strictly enforce the regulations requiring contractors excavating near the sidewalk to put up the proper barricades. On motion of Councilman Henry the report of the committee was adopted. An ordinance was introduced entitled: "An ordinance making an appropriation for the payment of certain claims." On motion of Councilman Henry the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Underwood, Grimes, Henry, I Smith, Mishler, Brown, Waite, Todd and Peters. (9) Nays: (0) Councilman Reed absent. The Mayor approved the same and is numbered j 2120. Councilman Brown moved that the Mayor interview the Police Judge in reference to fine of E. H. Walton's, assessed against him in the amount of $5.00 and the costs of said case was not collected; and report his findings to the Council at the next Regular Meeting. An ordinance was introduced entitled: "An ordinance vacating a portion of certain streets in the city of Salina, Kansas." On motion of Councilman Brown the rules of order were suspend- ed for its consideration by the following vote; Ayes: Underwood, Grimes, Henry, Smith, Iliishler, Brown, Vaite, Todd and Peters. (9) Nays: (0) Counciliian Reed absent. i On motion of Councilman Todd the ordinance was read and adopt- !, ed by sections and on its final adoption the roll was called and the following vote was had; Ayes: Underwood, Grimes, Henry, Smith, Mishler, Brown, Waite, Todd and Peters. (9) Nays: (0) Councilman Reed absent. The Mayor approved the same and is numbered 2121. Street and Alley Committee to whom was referred the petition asking for the curbing, guttering, excavating, grading and paving - of Phillips Street from South Street to Morrison Avenue, reported that according to an abstract furnished by a bonded abstracter they find that a majority of the resident property owners have signed said petition, and recommended that the prayers of the petitioners be granted. On motion of Councilman Henry the report of the committee was adopted. An ordinance was introduced entitled: "An ordinance providing for the paving, curbing, guttering and excavating of Washington Avenue from the west side of Ninth Street to the east side of Tenth Street in said City, specifying the manner of construction and pro- viding for the cost thereof and the manner of payment." On motion of Councilman Henry the rules of order were suspend ed for its consideration by the following vote; Ayes: Underwood, Grimes, Henry, Smith, Mishler, Brown, Waite, Todd and Peters. (9) Nays: (0) Councilman Reed absent. On motion of Councilman Brown the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Underwood, Grimes, Henry, Smith, Mishler, Brown, Waite, Todd and Peters. (9) Nays: (0) Councilman Reed absent. The Mayor approved the same and is numbered 2122. City Engineer, P. G. Wakenhut, submitted plans and specifica- tions and estimate of cost for the curbing, guttering, excavating, grading and paving of Washington Avenue from the west line of Ninth Street to the east line of Tenth Street, abd on motion the same were adopted and approved by the Council. An ordinance was introduced entitled: "An ordinance specifying and selecting the material to be used and letting the contract for the curbing and guttering of certain streets in the City of Salina." On motion of Councilman Todd the rules of order were suspend- ed for its consideration by the following vote; Ayes: Underwood Grimes, Henry, Smith, Mishler, Brown, Waite, Todd and Peters. (91 Nays: (0) Councilman Reed absent. On motion of Councilman Smith the ordinance was read and adop ted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Underwood, Grimes, Henry, smith, Mishler, Brown, Waite, Todd and Peters. (9) Nays: (0) Council- man Reed absent. The TJayor approved the same and is numbered 2123. An ordinance was introduced entitled: "An ordinance specifying and selecting the paving material to be used and letting the con- tract for the paving and excavating of certain streets in the city of Salina, Kansas. On motion of Councilman Smith the rules of order were suspend- ed for its consideration by the following vote; Ayes: Underwood, Grimes, Henry, Smith, I�Iishler, Brown, Waite, Todd and Peters. (9) Nays: (0) Councilman Reed absent. On motion of Councilman Mishler the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Underwood, Grimes, Henry, Smith, Mishler, Brown, Waite, Todd and Paters. An ordinance was introduced entitled: "An ordinance vacating a portion of certain streets in the city of Salina, Kansas." On motion of Councilman Peters the rules of order were suspend- ed for its consideration by the following vote; Ayes: Underwood, Grimes, Henry, Smith, IvIlishler, Brown, 'Waite, Todd and Peters. An ordinance was introduced entitled: "An ordinance levying and assessing special assessments on certain lots and pieces of ground in the city of Salina, Kansas, to pay the cost of excavating, curbing, guttering and paving Otis Avenue from the east line of Santa Fe Avenue to the west line of Ninth Street in said City, and relating to and providing for the collection of such assessments. " On motion of Councilman Brown the rules of order were suspend- ed for its consideration by the following vote; Ayes: Underwood, Grimes, Henry, Smith, Mishler, Brown, Waite, Todd and Peters. (9) Nays: (0) Councilman Reed absent. On motion of Councilran Mishler the ordinance was read and adopt- ed by sections and on its final adoption the roll was called and the following vote was had; Ayes: Underwood, Grimes, Henry, Smith, Mishler, Brown, Waite, Todd and Peters. (9) Nays: (0) Councilman Reed absent. The Mayor approved the same and is numbered 2126. Councilman Mishler mentioned that there are streets that could be paved under the law authorizing the Mayor and Council to connect up two parallel streets already paved. On motion, the matter was referred to the Street and Alley Committee for recommendations. Councilman Smith of the Public Health Committee stated that the committee would meet the plumbers on Thursday evening, December 27th, 1917, at the City Iiall, and any member of the Council is invited to participate at said meeting. Councilman Todd of the Nays and Means Committee reported that the Committee would recommend that the City appropriate the sum of $50.00 f'or room rent for the Poultry Show that is to be held in Salina, Kansas, commencing December 31st, 1917. On motion, the report and recommendations of the committee was adopted. The monthly reports of the City Clerk, City Treasurer, Police Judge and Fire Chief were received and ordered filed. On motion, Council adjourned until Friday, December 21st, 1917, at 8 o'clock P. M. City Clerk. 1! 3
