COUNCIL PROCL DING,'>, REGULAR 'IEETING.

SALINA, KANSAS.
DECECtIBER 3rd, 1917.
Regular semi-monthly meeting of the City Council, December,
3rd, 1917. I'vlayor I.,°athews presiding, city Attorney G. A. Spencer
and the following named councilmen answered to roll call; Under-
wood, Grimes, Henry, IIisizler, Reed, Brown, Todd. and Peters. Coun-
cilmen Smith and Waite absent.
The minutes of the Regular semi-monthly meeting of november
19tho 1917, and the Special Session of November 19th, 1917, were
read and approved as read.
Fred S. Abel, of the Lee Hardware Company, appeared before
the Council. and asked for a special permit to construct an iron
storage building on the south side of Lot 57 on Santa Fe Avenue.
On motion of Councilman henry a special permit was granted.
F. H. Quincy, appeared before the Council and stated t'_�at the
Robinson Plillin Company have obtained options on certain pieces
of ground on North Ninth and Eighth Streets, and are desirous to
have a portion of Eighth Street and an alley vacated.
Councilman Reed moved that the regquest be granted.
An ordinance was introduced entitled: "An ordinance vacat-
ing a portion of Eighth Street in the city of Salina, Kansas."
On motion of Councilman Reed the rules of order were suspend-
ed for its consideration by the following vote; ;yes: Underwood,
Grimes, Henry, Nlishler, Reed, Brown, Todd and Peters. (8) ?gays:
(0) Councilmen Smith and 'Vaite absent.
On motion of Councilman Brown the ordinance was read and
adopted by sections and on its final adoption the roll was called
and the following vote was had; ;yes: Underwood, Grimes, Henry,
Mishler, Reed, Brown, Todd and Peters. (8) hays: (0) Council-
men Smith and Waite absent. The Mayor approved the same and is
numbered 2112.
An ordinance was introduced entitled: "Ari ordinance grant-
ing the Right of Way to the Union Pacific Railroad Company for a
switch track across certain streets in the city of Salina.." j
On motion of Councilman Brown the rules of order were suspend-
ed for its consideration by the following vote; Ayes: Underwood,
Grimes, Henry, I%4ishler, Reed, Brown, Todd and Peters. (8) rays:
(0) Councilmen Smith and Vlaite absent .
On motion of Councilman %lishler the ordinance was read and
adopted by sections and on its final adoption the roll was called
and the following vote was had; Ayes: Underwood, Grimes, Henry,
Miishler, Reed, Brown, Todd and Peters. (8) hays: (0) Council-
men Smith and Waite absent. The P:iayor approved the same and is
numbered 2113.
An ordinance was introduced entitled: "An ordinance grant-
ing the right of way to the Atchison, Topeka and Santa Fe Railroad
Company to build a switch track along upon and across certain
streets in the city of Salina, Kansas."
On notion of Councilman Brown the rules of order were sus -
)ended for its consideration by the following vote; Ayes: Under-
wood, Grimes, Henry, Lishler, Reed, Brown, Todd and Peters. (8)
Flays: (0) Councilmen Smith and Waite absent.
On motion of Councilman Todd the ordinance was read and adopt-
ed by sections and on its final adoptionthe roll was called and
the following vote w.as had; Ayes: Underwood, Grimes, Henry,
I?ishler, Reed, Brown, Todd and Peters. (3) hays: (0) Council-
men amith and s'Taite absent. The Mayor approved the same and is
numbered 211_4.
�. A. Lovitt appeared before the Council and presented a claim
of damac;e from Jos. Lambotte for injuries received by falling into
a cellar at the corner of Elm Street and fourth Street, at the Ball.
Manufacturing Building.
On motion the matter was placed in the hands of the Ways and
Means Committee .
Representatives of The Saline County Poultry Association ap-
peared before the Council and asked the Council if the City would _
furnish a room in which to hold said poultry show, commencing
December 31st, 1917.
Councilman Brown moved that the matter be placed in the hands
of the Ways and Means Committee.
Councilman Todd of the Special Committee, to whom was refer-
red the matter of establishing a Benefit District, for the opening
of Ninth and Tenth Street, from South Street to Morrison Avenue,
reported as follows:
Me, your Committee, to whom was referred the matter of re-
porting upon the boundarues of the proposed Benefit District to be
created, to which a part or all of the costs of the opening of
Putnam Avenue, may be assessed, beg to report that the committee
advised that such Benefit District be bounded as follows:
On the north, by the south side of South Street; on the east,
by the ~Wrest side of Ninth Street; on the south, by the north side
of IvIorrison avenue; and on the west by the east side of Tenth Street.

Councilman hiishler moved that the report of the Committee be
adopted.
The Sidewalk Committee and City Bngineer, to whom was refer-
red the matter of re -locating the sidewalk at South and Tenth
Streets, submitted by LaRue Royce at the last meeting, reported
that the committee recommends that the new cement walk be construct-
ed in line of the present brick walk, and same should be the
permanent line for such walk.
On motion, the report and recommendations of the committee
was adopted.
An orc'inance was introduced entitled: "An ordinance estab-
lishing and creating a Benefit District and fixing the boundaries
thereof."
On motion of Councilman Brown the rules of order were sus-
pended for its consideration by the following vote; Ayes: Under-
wood, Grimes, Henry, Mishler, Reed, Brown, Todd and Peters. (8)
Nays: (0) Councilmen Smith and Waite absent.
On motion of Councilman Henry the ordinance was read and
adopted by sections and on its final adoption the roll was called
and the following vote was had; Ayes: Underwood, Grimes, Henry,
Mishler, Reed, Brown, Todd and Peters. (8) Nays: (0) Council-
men Smith and i;daite absent. The I�Ia.yor approved the same and is
numbered 2115.
Mayor IvIathews appointed B. 0. 'fTilder, Wm. Reimold and F. G.
Houghton, as appraisers in ascertaining the damage caused on ac-
count of opening, widening and extending the alley between Ninth
and Tenth Street, from South Street to Morrison Avenue, and on motion
of Councilman Brown the appointments were confirmed.
`Nays and Ivieans Committee, to whom was referred the petition
from citizens asking an increase in the salary of the Police Depart-
ment and Fire Department reported unfavorably.
On motion of Councilman henry the report of the committee
was adopted.
Street and Alley Committee reported on the ptition asking for _
the location of an Are Light at the corner of Highland Avenue and
Woodlawn Avenue, and recommended that an incandescent light be
established at the corner of Highland Avenue and Cloud Avenue, and
that the City Clerk notify the Salina Light, Power E Gas Company
to install said light.

BE IT RESOLVED, By the Mayor and Councilmen of the City
of Salina, nansas, that the excavating, grading and paving of
Elm atreet in the city of Salina, nansas from the west line of
I Fourth atreet to the east line of Third 6treet, are each and all
i
improvements necessary to be made and done, and be it further
resolved that said Elm Street be excavated, graded and paved with-
in the limits above defined.

An ordinance was introduced entitled: "An ordinance levying
and assessing special assessments on certain lots and pieces of
ground in the city of Salina, 17.ansas, to pay the costs of curbing,
guttering, excavating, grading and paving Bishop Street from the
west line of Thirteenth Street to the east line of College Avenue,
! in said City and relating to and providing for the collection of such
assessments."
On motion of Councilman Henry the rules of order were suspend-
ed for its consideration by the following vote: Ayes: Underwood,
Grimes, Henry, IJiishler, Heed, Brown. Todd and Peters. (8) Nays:
(0) Council:;;en Smith and Waite absent.

On motion of Councilman Todd the ordinance was read and adopt-
ed by sections and on its finai adoption the roll was called and
the following vote was had; Ayes: Underwood, Grimes, Henry, Mish-
ler, Reed, Brown, Todd and Peters. (8) Nays: (0) Councilmen
Smith and Waite absent. The Mayor approved the same and is numbered
2116.
An ordinance was introduced entitled: "An ordinance levying
and assessing special assessments on certain lots and pieces of ground
in the City of Salina., Kansas, to pay the costs of excavating, curb-
ing, gutterin-, pavi ig and grading Santa Fe Avenue, from the north
line of the main line right of way of the Union Pacific Railroad to
the south line of Otis Avenue in said City and relating to and provid-
ing for the collection of such assessments.
On motion of Councilman Brown the rules of order were suspend-
ed for its consideration by the following vote; Ayes; Underwood,
Grimes, Ilenry, Mishler, Reed, Brown, Todd and Peters. (8) Iaays:

On motion of Councilman Mishler the ordinance was read and
adopted by sections and on its final adoption the roll was called

On motion of Councilman Brown the ordinance was read and adopt-
ed by sections and on its final adoption the roll was called and

The following resolution was introduced:
WH "REAS, it has been shown to the it-iayor and Coun-
cilmen of the City of Salina, that there are two persons on Park
Stret in said City who desire to become tenants of the Salina
Water Works Company for domestic purposes and that in order to
permit such persons to become such tenants that it will be neces-
sary to lay not to exceed 120 feet of pipe, Now Therefore,
E IT RESOLVED, by the ivayor and Councilmen of
the City of Salina, that the Salina dater e"forks Company be, and it
is hereby directed to lay and install on Park Street in said City,
a two-inch water main for domestic purposes only and connect the
same with its present main on Phillips Street in said City, and
run said pipe north from said Phillips Street on said Park Street
a distance not to exceed 120 feet to permit such pereons to become
tenants of such company.

On motion of Councilman 1.ishler the rules of order were
suspended for its consideration and the resolution adopted as read
by the following vote; Ayes: Underwood, Grimes, Henry, hlishler,
Reed, Brown, Todd and Peters. (8) Nays: (0) Councilmen Smith
and Waite absent.
The following resolution was introduced:
HE LEAS, it has been shown to the Iuayor and Council-
men of ti -ie City of Salina, that there are two persons on Kirain
Avenue, in the said City, who desire to become tenants of the Salina
`dater Works Company for domestic purposes only and that it will be
necessary for said Company to lay, not to exceed 120 feet of pipe
to enable such persons to become such tenants of such Company.
NOW THEREFORE, be it resolved, by the Mayor and Councilmen
of the City of Salina, that the Salina water Works Company be, and
it is hereby directed to lay and install a two-inch water pipe for
domestic purposes on Kirwin Avenue and connect the same to its pre-
sent main on Sant_ Fe Avenue, running said. pipe west for a distance
of not to exceed 120 feet to enable such persons to become tenants
for domestic purposes of the Salina Water Vdorks Company.

On motion of Councilman Mishler the males of order were sus-
pended for its consideration and the resolution adopted as read by
the following vote; Ayes: Underwood, Grimes, Henry, Mishler, Reed,
Brown, Todd and Peters. (8) Nays: (0) Councilmen Smith and
Waite absent.
Councilman Brown moved that the Fire Chief deliver the old
Chief's auto to the Overland -Salina Company and have the same gone
over, and Eet an estimate and price on the repairing of the same.
Motion adopted.
An ordinance was introduced entitled: "An ordinance providing
for the construction of certain sewers in the city of Salina, Kan-
sas; letting the contract therefor, and providing for the payment
of the cost of the same."
On motion of Councilman Reed the rules of order were suspend-
ed for its consideration by the following vote; Ayes: Underwood,
Grimes, Henry, Mishler, Reed, Brown, Todd and Peters. (8) plays:
(0) Councilmen Smith and 1,11aite absent.

The ordinance was then read and on motion of Councilman
Brown, sewer section Number seven (7) for 565 feet of ten -inch
sewer on Eleventh 17treet from Charles Street to Crawford Avenue
was stricken out, and on roll call the motion was adopted.
On motion of Councilman Henry the roll was called on the
j final adoption of the ordinance as amended, and the following vote
was had; Ayes: Underwood, Grimes, henry, Mishler, Reed, Brown,
Todd and Peters. (8) Nays: (0) Councilmen Smith and Waite
absent. The Mayor approved the same and is numbered 2119.
Mayor Mathews to whom was referred the matter of settlement
with D. J. Murray, for the release of Kenwood Park, reported that
he had the replease, in payment of the sum of x,25.00, and on motion
of Councilman Henry the action of the Mayor was sustained.
Councilman Reed moved that the Payor and Council extend a
vote of thanks to Park Commissioner, L. B. Kemper, for the decorations
placed in the Council. Chamber, and on vote the matter was unanimous-
ly adopted by the Council.
The appraisers report for the paving of Front Street from
Iron Avenue to a point running 65 south of the south line of the
alleys running east and west through Block 14 in Oakdale Addition
to Salina, Kansas, was received, and on motion of Councilman Brown,
Monday evening, December 17thm 1917; at 7:30 o'clock -was designated
as a Special Meeting at which time the appraisers report will be
taken up and acted upon b;,, the Council and all persons affected by
such improvements can be present and heard if they so desire, and
that the City Clerk give notice in the official city paper as pro-
vided by law.
A petition was received asking; for the location of an Are
Light at the corner of Iron Avenue and Delaware Streets. Same
was referred to the Street and Alley Committee.
A petition was received asking for the curbing, guttering,
excaysting, grading and paving of Phillips Street from South Street
to ?.orrison Avenue. Same was referred to the Street and Alley Com-
mittee.
On motion of Councilman Henry, Council adjourned.
