03-16-1914 MinutesCOUNCIL PROCEEDINGS, REGULAR MEETING- COUNCIL EETING-COUNCIL CHAMBER, SALINA, KANSAS. MARCH, 16p 1914. ---- Second regular monthly meeting of the City Council, March 16th, 1914. Mayor Niquette presiding, City Attorney H. C. Tobey and the fol- lowing named councilmen answered to roll call: Miller, Hansen, Dodds, Brick, Swedenburg, Hanly, Stevenson, Studebaker and Benson. Councilman Peck absent. The minutes of the First Regular Monthly Meeting of Mach 2nd, 1914, were read and approved as read. - Mrs. Harry Yoder appeared before the Council, and asked to have the Council remit the balance of the fine._ and costs of the case of Harry Yod- er on the non-payment of poll tax. Councilman Dodds moved that the re- quest be granted. After the matterwas generally discussed in regard to remitting the fine and costs in all cases where parties were arrested for non-payment of poll tax; it was finally decided to refer the matter to the Street and Alley Committee; and have a report from the Police Judge of all fines collected. Mrs. V. S. Farrar appeared before the Council, and called the at- tention of the Council to the need of a rest room for women, and stated that she had a room that could be used for that purpose; and only asked the city to expend money to have the room papered. She would furnish the room, and there would be no further expense to the city for at least six months. The matter was referred to the Building Committee, with power to act. Claims and Expenditure Committee reported by ordinance entitled, "An ordinance making an appropriation for the payment of certain claims". Otto Peterson presented a claim for $1,552.00; 80% payment for the con- struction of the Ash street sewer. The City Engineer stated that he did not care to 0. K. the bill. On motion of CouncilMan Dodds, the a- mount of $1,000.00 was allowed and added to the ordinance; the amount to apply on sewer contract,. On motion of Councilman Stevenson the ordinance was read and adopted by sections, and on its final adoption the roll was called and the following vote was had; Ayes: Miller, Hansen, Dodds, Brick, Swedenburg, Hanly, Stevenson, Studebaker and Benson. (Nine) Nays; (None) Councilman Peck absent. The Mayor approved the same and is numb- ered 1751. Street and Alley Committee reported favorable on the petition for the paving, curbing and guttering of College avenue, from the north side of Ash street to the south side of Elm street; and according to a cert- ificate from bonded abstractors, certifying that there were fourteen res- ident property owners, and ten having signed the petition. Bids were received for pulling hedge in the Military Addition, from Chas. IF. Buck and P. W. Shaffer. On motion of Councilman Stevenson the contract was awarded to P. W. Shaffer at 70ki per rod; provided, that he removes all brush and rubbish from the ground. City Engineer, P. G. Wakenhut, stated that he had received a prop- osition from H. C. Smither, president of the street car company; to place concrete under and between ties at the crossing of Mulberry, South street, Prescott avenue and Crawford avenue, on the Santa Fe line; providing, ' the city would lay the brick on said crossings. On motion of Councilman Dodds, the proposition was accepted. The following resolution was introduced: Be it resolved by the Mayor and Councilmen of the City of Salina, that the Salina Waterworks Company is hereby required to lay a six inch water main on Prescott avenue bat ween Tenth and Twelfth street; a four inch water main on Walnut street connecting at the corner of Second and Walnut street, and running east on said Walnut street to connect with main on Front street, east of the Walnut street bridge, crossing the Smoky Hill River; and a four inch main on Oak Dale avenue between Iron avenue _ and Gypsum avenue. I T PAZ On motion of Councilman Studebaker the resolution was adopted by the following vote; Ayes: Miller, Hansen, Dodds, Brick, Swedenburg, Hanly, Stevenson, Studebaker and Benson. (Nine) Nays; (None) Coun- cilman Peck absent. Councilman Hansen of the Building Committee, stated that the Con- venti6n of Dentists wished to use the third floor of the City Building for a meeting. Permission was granted, provided, that all large pack- ing boxes be excluded from the building. An ordinance was entitled, "An ordinance amending sections, two, three, four and six of Ordinance No. 1617, passed and approved July, 17, 1911, and all other parts of said ordinance No. 1617 in conflict wth this ordinance, and repealing such sections two, three, four and six and other parts of such ordinance so amended". On motion of Council- man Stevenson the ordinance weds read and adopted by sections, and on its final adoption the roll was called and the f ollwing vote was had; Ayes: Miller, Hansen, Dodds, Brick, Swedenburg, Hanly, Stevenson, Studebaker and Benson. (Nine) Nays; (None) Councilman Peck absent. The Mayor approved the same and is numbered 1752. On motion of Councilman Hanly, Fireman T. P. Anderson was grant- ed another month's pay, ending April 15, 1914. Profdssor Harne and F. L. Martin appeared before the Council, and asked that the sewer on Phillips street be extended south about 300 feet. The matter was referred to the Sewerage and Drainage Committee with in- structions to have an ordinance authorizing and letting the contract for the proposed sewer at the next meeting. An ordinance was introduced entitled, "An ordinance changing the character of material for the construction of the Ash street sewer now being built in the city of Salina, allowing the contractor building such sewer for the difference in cost made by such change, and repealing so much of Ordinance No. 1736 as conflicts with the provisions of this ordinance". On motion of Councilman Stevenson the rules of order were suspended for Its consideration by the following vote; Ayes: Miller, Hansen, Dodds, Brick, Swdeenberg, Hanly, Stevenson, Studebaker and Ben- sAn. (Nine) Nays; (None) Councilman Peck absent. On motion of Councilman Dodds the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; (Ayes) Miller, Hansen, Dodds, Brick, Swedenburg, Hanly, Stev- enson, Studebaker and Benson. (Nine) Nays; (None) Councilman Peck abeent. The Mayor approved the same and is numbered 1753. An ordinance was introduced entitled, "An ordinance amending part of Ordinance No. 1746, passed and approved February 16, 1914, and repealing ouch part of such section (one) so amended." On motion of councilman Studebaker, the rules of order were suspended for its con- sideration by the following vote; Ayes: Miller, Hansen, Dodds, Brick, Swederiburg, Hanly, Stevenson, Studebaker and Benson. (Nine) Nays; (None) Councilman Peck absent. On motion of Councilman Mill- er the ordinance was read and adopted by sections, and on its final adoption the roll was called and the following vote was had; Ayes; Miller, Hansen, Dodds, Brick, Swedenburg, Hanly, Stevenson, Studebak- er and Benson. (Nine) Nays; (None) Councilman Peck absent. The Mayor approved the same and is numbered 1754. A petition for the paving, curbing and guttering of Highland av- enuefrom Prescott avenue to the south side of Republic avenue, was received and referred to the Street and Alley Committee. A petition for the construction of a cement sidewalk on the east side of Highland avenue, from Jewell avenue to Kirwin avenue, was re- ceived and referred to the Sidewalk Committee. The resignation of J. H. Tulliss, as City Marshal, was read as follows: Salina, Kansas, Mch. 9, 1914. To the Hon. Mayor and Council of the City of Salina, Kansas. I hereby tender for your acceptance, my resignation as City Marshal of the City of Salina, to be and become effective on and after the 25th day of March, 1914, J. H. Councilman Studebaker called the attention to a proposition to purchase a car for the use of the Police and Fire Department. The matter was referred to a special committee composed of Councilmen Stu- debaker, Benson and Hanly.
