ORDINANCE NUMBER 01-10066
AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF THE
UTILITY EASEMENT LOCATED ON THE SOUTH PROPERTY LINE OF LOT 4, BLOCK
5, TWIN OAKS III SUBDIVISION OF THE CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on November 26, 2001, the governing body conducted a public hearing
on the petition of Bob Haworth, President of Lee Haworth Construction Company, Inc. ("Petitioner")
requesting vacation of a portion of the utility easement located on the south property line of Lot 4,
Block 5, Twin Oaks III Subdivision in the City of Salina, Saline County, Kansas, more particularly
described as follows:
The twenty (20) foot easement located on the south property line of Lot 4,
Block 5, less the west ten (10) feet, Twin Oaks III Subdivision to the City of
Salina, Saline County, Kansas.
Section 2. That the governing body finds from the evidence presented at the public
hearing that:
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by vacation of the utility
easement.
(c) In justice to the Petitioner vacation of the utility easement should be
granted.
Section 3. Said easement is hereby vacated and shall revert back to the
owners of Lot 4, Block 5, Twin Oaks III Subdivision in accordance with K.S.A 13-443.
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
