Mayor Niquette presiding, City Attorney H. C. `1'obey and the rollowing named councilmen answered to roll call: IY4iller, Hansen, Dodd, Brick, Swed- enburg, Hanly, Stevenson, Studebaker and Benson. Councilman Peck absent. The minutes of the regular adjourned meeting of November 24th, 1913, and special called meeting of December 9th, 1913 was read and approved as read. Claims and expenditure committee reported by ordinance entitled, "An ordinance making an appropiration for the payment of certain claims". On motion of Councilman Stevenson the ordinance was read abd adopted by sect- ions, and on its final adoption the roll was called and the following vote was had: Ayes; Miller, Hansen, Dodds, Brick, Swedenburg, Hanly, Stevenson, Studebaker and Benson. (dine) Nays; (None) Councilman Peck absent. A protest from J. S. Cobb protesting against the opening of an alley on the south side of Lot (103) on Seventh Street, was received arid ordered filed. Street and Alley Committee made the following report on opening an alley on the south side of Lot (103) on Seventh Street, as follows: "We, your committee to whop: was referred the within ordinance beg leave to report unfavorable". On motion of Councilman Miller the rep,)rt was received and ordered On motion of Councilman Dodds the City Engineer was instructed to have the curbing, at the corner of Ialnut and Ninth Street, that had been damaged by the Street Car Company, repaired at once. Councilman Steverson called the attention of the condition of Gyp - sun! Avenue, along the sand pit. The City Clerk, was instructed to notify the board of Greeley Township to investigate. An ordinance was introduced entitled,"An ordinance providing and cal- ling a special election in the city of Salina, Kansas, fro the purpose of submitting to a vote of the electors of said city the proposition to adopt the provisions of Chapter 62, Laws of Kansas of 1909, being an act entitled" An act amending and supplemental to Chapter 123 of the laws of Kansas of 1907, and repealing said chapter in � nd so far as inconsistent and in con- flict with this act, so far as the same relates to cities of the second class which adopt the provisions of this act". The ordinance was read and referred to the Street and Alley Committee. Councilman Stevenson moved that the 'Street Commissioner be instructed to - et the location of defective water -ways under the railroad tracks, and report same to City Clerk, who should at once notify the railroad companies to repair the same. Councilmen Dodds moved that the Street Commissioner contract for 300 loads of dirt from Ed. Schumaker at 30 � per load. Mayor Niquette submitted his veto to ordinance No. 1736 as follows: Salina, Aransas. Dec. 15, 1913. To the City Council, Sjalina, Kansas. Gentlemen: I herewith respectfully return to you with my veto and disaproval Ordinance No. 1736, being an ordinance, letting the contract for the exten- sion of the Ash Street sewer, for the reasons that, in my judgment it will be unwise to expend the necessary _mount of money for which such a contract will call to build a sewer over the line suggeLted and described in said ordinace, since that that p�,:_rt of such sewer as crosses the Smoky Hill River will at all times be in danger of being wa:;hed out, and the expense necess- ary to be expended from time to time in replacing such river crossing will in time amount to as much as the difference in expense that it would cost at this time to run the proposed sewer by the northern route heretofore sug[;ested and receonranended by the city engineer; and that at the end of a 23 24 few years the connection between the two sides of the river will be carried or washed away by high water and drift in the river and abandoned and some three thousand feet of sewer pipe will be lying under the ground east of the river, unfit for use and abandoned, representing a useless waste of the peo- ples money. Respectfully, V. E. Niquette, Mayor. Councilman Miller moved that Ordinance No. 1736 be re -read and passed over the Mayor's veto. On its final adoption the roll was called and the following vote was had; Ayes: Miller, Hansen, Dodds, Brick, Swedenburg, Han- ly and Stevenson. (Seven) Nays : Studeba,er and Benson. (Two) Councilman Peck absent. A communication from Otto Peterson was read as follows: Salina, Kansas. Dec. 15, 1913. To the Mayor and Councilmen of the City of Salina: Wheraas, upon November, 24th, 1913, I, the undersigned, submitted and filed with the City Clerk of the City of Salina, Kansas, a bid for the construction of the Ash Street sewer for the sum of "13,160.00; and 'Whereas, the mayor and Councimen of said city have failed and neg- lected to accept such bid by me made; and 6rhereas, conditions have so changed that I cannot construct such sewer under the terms of said bid; Now therefore, I hereby withdraw my said bid and I hereby demand the immediate return to me of my certified check in the sum of w500.00 which accompanied said bid. Otto Peterson On motion of Councilman 'Stevenson the communication was laid on the table. Councilman Hanly moved that a committee of five members of the Council, one from each ward, be appointed to investiGate the rumor and differences be- tween the Mayor and the police force. Mayor Niquette called Councilman Stu- debaker, President of the Council to preside. Motion was then made as a- bove and adopted. Councilman Studebaker, President of the Council, appoint- ed the following committee: Hansen, Todds, Brick, Stevenson nd Benson. May- or Niquette again resumed the chair. An ordinance was introduced and read, entitled, "An ordina ce providing for and calling a special election in the city of Salina, Kanas, for the purpose of J submitting to the electors of said city the proposition of auth- orizing the Mayor and Council of said city to issue bonds in tie sum of 14,000.00 as a contribution toward the cost of building and constructing, by Saline, County, Iiarisas, a cement brid-e across the Smoky Hill lover on Iron Avenue in the city of Salina". The ordinance was referred to the Street and Alley Committee. An ordinance was introduced and read, entitled, "An ordinance provid- ing for the condemnation and appropriation of certain real estate in the city of Salina, Kansas, for the prupose of opening an alley between Ii'if'th Street and Santa h'e Avenue north of Iron Avenue". The ordinance was refer- red to the Street and Alley Committee. An ordinance was introduced entitled, "An ordinance fixing the time of meetings of the City Council, and repealing Ordinance No. 123, passed and approved April 21, 1874". On mot..on of Councilman Stevenson the rules of order were suspended for its consideration by the following vote; Ayes: Viller, Hansen, Dodds, Brice, Swederiburg, Hanly, Stevenson, Studebaker and Benson. (dine) Nays: (hone) Councilman Peck absent. On motion of Coun- cil;,.an i}liller the ordinance was read and adopted by sections, and on its final adoption the roll was called and the following vote was had; Ayes: Miller, Hansen, Dodds, Brick, SwederiburE, Hanly, Stevenson, Stucaeba'rer and Benson.
